By participating in any of Lisa Garrido and/or Lisa Garrido mindbodythrive, Inc. events, teleseminars, or webinars, you understand that live events may be recorded. You agree that Lisa Garrido and/or Lisa Garrido mindbodythrive, Inc. has the right and permission to use such recordings should they include your name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification. Parental Permission

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT, YOGA, FITNESS AND COACHING WAIVER & RELEASE

IMPORTANT INFORMATION

1. I understand that I am participating in yoga, movement, mindfulness, breath work, and coaching (collectively, “Activities”) offered by Lisa Garrido, Lisa Garrido mindbodythrive, Inc., teaching assistant, Kelley Fein, and Yoga Teacher Training Students, (collectively, “Teachers”) located at 2000 N Shoreline Blvd, Mountain View, CA 94043.


2. I understand that I can rest and take child's pose or any other safe, relaxing pose for my body at any time. And, that this is fully supported and celebrated by the Teachers. I recognize that I must be in adequate physical and mental health to participate in Activities. I understand that Activities may require intense physical exertion, and I represent and warrant that I am physically fit enough to participate, and I have no medical condition which would prevent my full participation in Activities. I recognize that Activities may cause or aggravate a physical injury or medical condition. I understand that it is my responsibility to consult with a physician before my participation in Activities and have taken the physician’s advice. I understand that Teachers reserve the right to refuse my participation in any Activities on medical, fitness or any other grounds.


3. I am aware that my participation in Activities could result in high blood pressure, fainting, heartbeat disorders, physical injury, heart attack or stroke and may aggravate pre-existing injuries. I understand that I could experience muscle, back, neck and other injuries as a result of my participation in Activities. I understand my physical limitations and I am sufficiently self-aware to stop or modify my participation in any Activities before I become injured or aggravate a pre-existing injury.   


4. In consideration of being permitted to participate in Activities, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in Activities, including those which may result from the negligence of Teachers.


5. In further consideration of being permitted to participate in Activities, I knowingly, voluntarily and expressly waive any “Claim” (as defined below) I may have against the Teachers and any of Teachers’ employees, students, independent contractors or assistants (each, a “Released Party”) that I may sustain as a result of participating in Activities even if Claim arises from the negligence of Teachers and Released Party or anyone else. I agree to indemnify and hold harmless Teachers and Released Party from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of Teachers and Released Party or anyone else.

“Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that I may suffer, my spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activities.


6. MEDIA RELEASE: I authorize Teachers and Released Party to use the following personal information: 1) my picture, including photographic, motion picture, and electronic (video) images, and 2) my voice, including sound and video recordings. I hereby grant Teachers and Released Party the right to use, publish, and reproduce, for all purposes, my name, pictures of me in film or electronic (video) form, sound and video recordings of my voice, and printed and electronic copy set forth in this media release and all media including without limitation, cable and broadcast television and the internet, and for exhibition, distribution, promotion, advertising, sale, press conferences, meetings, hearings, educational conferences and in brochures, and other print media. This permission extends to all languages, media, formats and markets now known or hereafter devised. This permission shall continue forever unless I revoke the permission in writing.


7. This agreement shall be construed in accordance with, and governed by, the laws of the State of California and that all actions, suits, claims and proceedings relating to this agreement shall be brought in a court of competent jurisdiction. In case any provision of this agreement shall be held invalid, illegal or unenforceable, it shall not affect any other provision of this agreement and this agreement shall be construed as if such provision had never been contained herein.


8. HANDS-ON ADJUSTMENTS: I am aware that hands-on adjustments may be offered by Teachers, and if so, I may opt-out at any time. I understand and agree that if I choose to receive hands-on adjustments that I am responsible for listening to my body and letting Teachers know how I am doing. It is my responsibility to communicate to Teachers if any hands-on adjustment isn’t working for my body and I agree to back out of hands-on adjustments. 


9. I, my heirs or legal representatives, forever release, waive, discharge and covenant not to sue Teachers and Released Party for any Claim caused by any negligence or other acts of Teachers and Released Party.


10. COVID-19 SAFETY ACKNOWLEDGEMENT - LIABILITY AND RELEASE OF CLAIMS AND DUTY TO SELF-MONITOR: COVID-19 SAFETY INFORMATION: While participating in events held or sponsored by Teachers and Released Party, per state and local guidelines, it is strongly recommended to wear a face covering indoors to reduce the risks of exposure to COVID 19.


Teachers and Released Party cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.

In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in events of the Teachers and Released Party and/or other face to face activities. By attending these event, you certify that you do not fall into any of the following categories:

1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others;

2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or

3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID 19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public.

4. Participants and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath).

I acknowledge that I am at least eighteen (18) years of age and fully competent. If under eighteen (18) years of age, their parent/guardian agrees to complete and sign and assumes all responsibilities as set forth on behalf of their minor. 

I have carefully read this agreement and fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein. I am aware that by signing this agreement, I am giving up substantial rights, including my right to sue and certain legal rights my heirs, next of kin, executors, administrators and assigns may have against any Teachers and Released Party.


LIABILITY WAIVER AND RELEASE OF CLAIMS:

I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation and/or voluntarism with Teachers and Released Party, and I willingly engage in Activities.

RELEASE AND WAIVER. I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST TEACHERS, RELEASED PARTY, AND ITS AFFILIATED PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS, EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF TEACHERS AND RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH ACTIVITIES.
