CAMPSITE RULES. GENERAL RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISKS AND HOLD HARMLESS AGREEMENT & WAIVER OF LIABILITY RELATED TO CORONAVIRUS / COVID-19

 

 CAMPSITE RULES

PETS

  • No pets allowed. We love animals! Unfortunately, our insurance does not cover them on our premises. 

SERVICE ANIMALS

  • Good animal behavior is required. Animals of any breed that are hostile or aggressive will be asked to leave the campground, along with their owners.
  • Animals may not be left unattended at any time.
  • Dogs must be kept on leashes no longer than 6 feet when outside their owners' vehicles or campsite. Do not leave a tethered dog unattended. 
  • Service animals are not allowed on any furniture on the premises. 
  • Animals must have their own designated sleep space (bed, cage, kennel, etc.) provided by the owners. 
  • Constant barking that disturbs the peace of other campers and/or neighbors will not be tolerated. If your pet is too vocal, you'll need to find other accommodations.
  • Our area of the hill country has (but not limited to) coyotes, foxes, hawks, wild hogs, coral snakes, rattle snakes, kissing bugs, etc. that can be harmful/deadly to you and/or your service animal. Bringing a service animal is at your own risk. You, as the animal owner, agree to hold harmless RMZ Properties, LLC, its employees, owners, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising from injury and/or death to my animal.

 

PERSONAL TRANSPORTATION POLICY 

  • RMZ Properties LLC does not allow visitors to bring any motorized vehicles on the property. Motorized vehicles include, but are not limited to, ATV's, motorbikes, mini-bikes, motorized scooters, etc. Children are not allowed to operate any motorized vehicles. Approved operators must have a valid driver’s license.
  • Vehicles must be parked in the designated parking area. No driving around the land without pre-approval. 

QUIET TIME

  • Between the hours of 10 PM - 8 AM, quiet time is strictly enforced. Violators will be required to depart the premises without a refund. 
  • Quiet voices, no music, no loud games, tent walls are thin.

 

 

CAMPFIRE

  • Campfires should never be unattended. 
  • When a burn ban is in effect, NO OPEN FIRE IS PERMITTED. You may check for burn bans daily at: https://www.bexar.org/630/Fire-Marshal 
  • All fires must be extinguished by midnight. 
  • Pre-packaged firewood is allowed.
  • We provide one bundle of 6-7 pieces for campfire s’mores.

 ALCOHOL & TOBACCO

  • Alcohol may only be consumed on your campsite by adults aged 21 and older.
  • No smoking inside tents or near the tent entrance/exit
  • No motorized vehicle should be operated under the influence or while consuming alcohol on campsite property. 

EMERGENCY

  • In conjunction with your use of campsite property, the undersigned acknowledges that this is an open, outdoor park that provides staffing for administrative and guest services based on occupancy. The campsite does not provide emergency service personnel or security. In the event of an emergency, you must call 911 and report your call. Also call the office when open or the afterhours emergency phone number.

PHOTOS

  • Entrance onto the campground property constitutes permission for the management of RMZ PROPERTIES, LLC, and its agents to photograph the visitors while on the premises and to use any resulting pictures for any lawful purpose without compensation to the visitor.
  • I release RMZ Properties, LLC, and its agents from all forms of claims and liability related to my photo usage. I hereby waive any right to inspect or approve the finished photos that may be used in conjunction therewith or me eventual use that it might be applied.
  • I hereby certify that I am the parent and/or guardian of the Minor campers/participants, registered on my site. I further certify the subject(s) is an infant/minor under the age of eighteen years. I hereby consent that any photographs, which have been taken, may be used by the photographer for the purposes set forth in original release hereinabove.

 

DAMAGE/DESTRUCTION

  • No cutting of live trees or vegetation
  • No damaging other people’s property
  • No damaging any campsite property 

SAFETY ON THE PREMISES / EXPLORATION

  • Closed toes shoes are highly encouraged anytime you are exploring the property
  • You may not enter, without permission, any other campsite on the premises other than the one you were assigned to.
  • Guns are not permitted on our grounds. Any other forms of protection must be disclosed on arrival to the grounds. 

MINORS

  • Minors, if permitted, must remain with their legal guardian/s at all times.
  • When at play, minors must be monitored at all times.

CELEBRATION PAVILION

  • The celebration pavilion (The Venue 88) is off limits unless prior arrangements have been made. Please, do not enter this restricted area.

SPECIAL NOTES

  • Consent must be completed for anybody visiting or staying on the campsite premises within 48 hours of the reservation.
  • Visitors are not permitted on the premises without prior written consent.
  • We ask that all food, candy, drink items be left in the trash can outside of your campsite with the lid closed to ensure no rodents or critters infest the tent
  • Kerosene lanterns are not permitted on the property. 
  • AC cannot be in use while the Keurig or microwave are in use. Only one of these items at a time. 
  • Campground is not responsible for items left behind. Items left in campsites will be assumed to be abandoned if not claimed within 14 days. Storage fees may be incurred. Unclaimed items will be donated to charity after 14 days

GENERAL RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISKS AND HOLD HARMLESS AGREEMENT & WAIVER OF LIABILITY RELATED TO CORONAVIRUS / COVID-19

In consideration of crossing, renting, participating in programs, using or otherwise being present on the property of RMZ PROPERTIES, LLC dba UNDER STARS GLAMPING AT Z RANCH located at 8860 CROSS MOUNTAIN TRAIL, SAN ANTONIO TX 78255. 

I, for myself and my estate, heirs, administrators, executors, and assigns, hereby release, forever discharge and hold harmless RMZ PROPERTIES, LLC, its directors, officers, employees, volunteers, contractors, agents and representatives called the “RELEASEES” from any and all liability and responsibility whatsoever, however caused, for any and all damages, claims, demands, costs or expenses or causes of action that I, my estate, heirs, administrators, executors, or assigns may have for any loss, illness, personal injury, death, or property damage arising out of, connected with, or in any manner pertaining to my presence on the property of 8860 CROSS MOUNTAIN TRAIL, including programs and/or services provided by 3rd parties, whether caused by negligence of the RELEASEES, accident, omissions or otherwise.

COVID-19. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, social distancing is recommended. RMZ Properties, LLC has put in place preventative measures to reduce the spread of COVID-19; however, RMZ Properties, LLC cannot guarantee you, your family or visitors will not become infected with COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my party and I may be exposed to or infected by COVID-19 while at UNDER STARS and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at UNDER STARS may result from the actions, omissions, or negligence of myself and others, including, but not limited to, RMZ Properties, LLC employees, volunteers, and other campers. I voluntarily agree to assume all the foregoing risks and accept sole responsibility for any injury, illness or death to myself or anyone in my party. On behalf of myself and my party, I hereby release, covenant not to sue, discharge, and hold harmless RMZ Properties, LLC, its employees, owners, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages costs or expenses of any kind arising out of or relating thereto.

I fully understand and assume all risks and danger incidental to the activity of camping in a rustic outdoor environment including specifically, but not limited to, the danger of being injured or killed by insects, poisonous plants or other animals, of being injured while participating in recreational activities, such as hiking, swimming or other outdoor sports at the campground and/or being injured as a result of inclement weather conditions, fallen trees, forest fires, and agrees that my presence to be on the property of 8860 CROSS MOUNTAIN TRAIL is voluntary and I assume all risks and responsibility for loss, property damage, illness and personal injury, including death whether caused by negligence of the RELEASEES, accident, omission or otherwise. 

I further hereby agree to indemnify and hold harmless the RELEASEES from any loss, liability, damage, judgment, settlement, or costs, including court costs and attorney fees, or medical fees that they may incur due to my presence or participation on the property of 8860 CROSS MOUNTAIN TRAIL, including programs or services provided by 3RD parties, whether caused by negligence of the RELEASEES, accident, omissions or otherwise.

I AGREE TO COMPLY WITH ALL CAMPGROUND RULES & REGULATIONS: This property is privately owned. RMZ Properties, LLC, and its agents, reserve the right to refuse service to anyone and will not be responsible for loss of money or valuables of any kind. I have also received, read, and will abide by Campground Rules. 

I agree to pay any additional charges for any item(s) purchased or requested from the campground staff, late departure, or any damage(s) to campground property caused by myself or any member of my party. If fees/charges are not paid before my departure, I consent to have this fee (if applicable) charged without notification to the same credit card provided for the campsite.

 

This is a legally binding agreement. By signing this agreement, I acknowledge and represent that I have read and understand it; that I sign it voluntarily; no oral representations, statements or inducements have been made. I am at least eighteen (18) years of age and fully competent. 

I HAVE READ AND UNDERSTAND THE ABOVE WAIVER AND RELEASE.  I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING THIS DOCUMENT AND I VOLUNTARY SIGN IT AND AGREE TO BE BOUND BY IT.
