Release of Liability

Activity Description and Risks

KPK Enterprises, LLC d/b/a/ Valley Corn Maize, offers a fun-filled outdoor agritourism experience featuring a variety of seasonal attractions, rides, climbing and play structures, and yard games, which may change from time to time and may include, without limitation, mazes, wagon rides, pumpkin and produce picking, zip lines, climbing nets, playground and tire equipment, ropes courses, and similar amusement, agricultural, and recreational activities. These activities take place in an outdoor agricultural setting, which may include uneven terrain, dirt paths, corn stalks, mud, and other natural elements such as insects, spiders, or small animals. While we strive to maintain a safe environment, participation in these activities involves inherent risks, including but not limited to slips, falls, minor injuries, or allergic reactions. Pursuant to Minnesota Statutes, Section 604A.40, agritourism activities carry inherent risks, and participants assume the risks of injury, damage, or loss arising from their participation in such activities. KPK Enterprises, LLC has taken reasonable precautions to ensure safety, but cannot eliminate all risks. By participating, you acknowledge these risks and agree that KPK Enterprises, LLC, its employees, owners, or affiliates cannot be held liable for any incidents, as provided under Minnesota law.

Release of Liability

I understand that Minnesota Statutes, Section 604A.40 provides that KPK Enterprises, LLC is not liable for injury, damage, or death resulting from the inherent risks of agritourism activities, as defined by that statute, and I assume those inherent risks as a participant.

Separately, and in addition to the statutory protection described above, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE KPK Enterprises, LLC, its employees, owners, and affiliates (collectively, "Releasees") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while participating in activities at Valley Corn Maize, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASEES. This release does not extend to injury, damage, or death caused by the Releasees' gross negligence, willful or wanton misconduct, or intentional acts. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury that may occur.

Indemnity and Hold Harmless

I further AGREE TO INDEMNIFY AND HOLD HARMLESS the Releasees from any loss, liability, damage, or costs, including court and attorney fees, that they may incur due to my participation in these activities, whether caused by negligence of the Releasees or otherwise. This agreement binds my family, spouse, heirs, assigns, and personal representatives and is construed in accordance with the laws of the State of Minnesota.

Photo Release

I understand that photographs and videos may be taken during activities at Valley Corn Maize. By signing this waiver, I consent to the use of my image or likeness in marketing materials, including but not limited to social media, website content, flyers, and promotional videos, without compensation.

Assumption of Risk Related to COVID-19

Coronavirus (COVID-19) is a contagious disease that may spread through person-to-person contact. KPK Enterprises, LLC has implemented measures to reduce the risk of transmission, such as enhanced cleaning and distancing protocols, but cannot guarantee that you, your guests, or your family will not be exposed to or contract COVID-19. By participating, I acknowledge the risk of exposure or infection, which may result in illness, injury, disability, or death. I voluntarily assume all such risks and accept sole responsibility for any resulting claims, including medical expenses or other costs, whether caused by the negligence of the Releasees or otherwise. I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Releasees from any claims, liabilities, or expenses arising out of COVID-19 exposure or infection, whether occurring before, during, or after participation in Valley Corn Maize activities. This includes claims resulting from the negligence or gross negligence of the Releasees.

Severability and Third-Party Beneficiaries

If any provision of this agreement is deemed unenforceable, the agreement will be amended to the extent necessary to make it enforceable, and the remaining provisions will remain valid. If a court declines to amend, the invalid provision will not affect the enforceability of other provisions. The Releasees are third-party beneficiaries and may enforce this agreement.

Acknowledgment

I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT, HAVE HAD THE OPPORTUNITY TO REVIEW IT WITH LEGAL COUNSEL, AND AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE KPK ENTERPRISES, LLC FOR CLAIMS, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF THE ACTIVITIES.

By signing this waiver, you understand and agree to the terms and conditions stated above.
