WOODSHOP RELEASE, WAIVER & DISCLAIMER OF LIABILITY

IN CONSIDERATION for access and use of the woodshop facilities, equipment, programs, classes and common use of the premises (collectively, the "Facilities") located at 3305 Grande Vista Dr., Newbury Park, California 91320, leased by Woodworkers Retreat LLC, a California limited liability company, having its office at 4238 Lost Springs Dr., Calabasas, California 91301 ("WR"), the undersigned, an individual having a mailing address at TBD and his or her personal representatives, successors, heirs, assignees, and any minor children for whom the undersigned is a parent, grandparent, legal guardian or otherwise responsible (collectively the "Releasor''), for other good and valuable considerations, the receipt and sufficiency of which are hereby acknowledged by the Releasor, hereby execute and deliver to WR this Woodshop Release, Waiver & Disclaimer of Liability (the “Release and Waiver”).

 

Release of Liability

Releasor does hereby release, waive, disclaim and forever discharge WR and all of its respective partners, affiliates and subsidiaries and their respective partners, directors, officers, agents, administrators, staff, employees, volunteers at the Facilities, shareholders, members, managers, associates, personal representatives, successors, and assigns (collectively, the "Releasees''), of and from all, and all manner of action and actions, cause and causes of action, suits, torts, damages, judgments, executions, claims, demands, strict liability, breach of duties, negligence, personal injuries, warranties, representations, defects in workmanship, product liability, violations of state and federal law, claims and demands whatsoever, in law or in equity (collectively the “Claims”), which the Releasor ever had, now has, or may have, or which the Releasor, hereafter can, shall or may have, against any or all of the Releasees associated with Releasor’s use and / or occupancy of the Facilities, from the time of Releasor’s first use and / or occupancy of the Facilities and continuing thereafter, and hereby further release, satisfy and forever discharge and hold harmless the Releasees, individually and collectively, from any or all of the above which may arise, result, occur or obtain subsequent to the date of this Release and Waiver arising out of any act or omission by any or all of the Releasees, or otherwise, and relating to, the Facilities and the use and / or occupancy of the Facilities by the Releasor. 

 

Assumption of Risks

The Releasor acknowledges having been informed that woodshop activities involve a risk of injury and even death and that the Releasor is voluntarily utilizing the Facilities with knowledge of the dangers and risks involved. The Releasor acknowledges that there are risks, known and unknown, associated with the use and occupancy of the Facilities and that the Releasor hereby expressly, knowingly and freely AGREES TO COMPLETELY AND ABSOLUTELY ASSUME ALL RISKS enumerated or referred to herein AND ACCEPTS FULL RESPONSIBILITY FORany and all personal injuries, accidents, damage, losses or illnesses, including death, loss of personal property which may occur, directly or indirectly, while using or as a result of having used any and/or all of the Facilities and further agrees to hold Releasees harmless from any and all Claims relating to the Facilities and/or the use, occupancy, maintenance and/or operation thereof. 

 

Authorizations

The Releasor: (a) hereby authorizes any emergency medical treatment in the event of any injury while utilizing the Facilities and (b) acknowledges that the Releasor either has appropriate insurance or, in its absence, agrees to pay all costs of emergency rescue and / or medical service as may be incurred on the Releasor's behalf. The Release and Waiver of the Claims set forth herein specifically includes, but is not limited to, any and all claims, known and unknown, which may arise as a result of (a) negligence on the part of any or all of the Releasees; (b) the use of the Facilities which may break or malfunction in any manner for any reason; (c) lack or improper maintenance of the Facilities or any part thereof; (d) negligent, improper and/or incorrect supervision or instruction; (e) negligent, improper and/or incorrect use of the equipment; and (f) any slip or fall by the Releasor while using the Facilities. This Release and Waiver shall be binding upon the Releasor's heirs, personal administrators, executors and assigns. 


Photo/Video Release Form

I hereby authorize Woodworkers Retreat LLC (WR) and those acting pursuant to its authority to: (i) record my likeness and/or voice on a video, audio, photographic, digital, electronic or any other medium; (ii) use my name and biographical material in connection with such recordings; and (iii) use, reproduce, exhibit, and/or distribute my name, biographical material, and such recordings in any medium (e.g., print publications, video, internet, etc.) for promotional, advertising, educational, and/or other lawful purposes. I release and waive any claims or rights of compensation or ownership regarding such uses and understand that all such recordings shall remain the property of WR. I certify that I am 18 years of age or older or that my parent/guardian has signed below.

 

Release and Waiver of California Civil Code § 1542 

Releasor understands and expressly agrees that all rights under Section 1542 of the California Civil Code, if any, are hereby expressly waived to the extent the foregoing releases constitute a general release. Section 1542 reads as follows:

 

“ A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

The waiver of Section 1542 provided by this Release and Waiver is an essential term of Releasee’s agreement authorizing Releasor’s (or any minor children for whom the Releasor is a parent, grandparent or legal guardian) use of the Facilities, without which such authorization would not have been granted.

 

I, THE RELEASOR, ON BEHALF OF MYSELF AND ANY MINOR CHILDREN FOR WHOM I AM A PARENT, GRANDPARENT, LEGAL GUARDIAN OR OTHERWISE RESPONSIBLE, HAVE READ THE FOREGOING ACKNOWLEDGMENT OF RISK, ASSUMPTION OF RISK AND RESPONSIBILITY AND RELEASE OF LIABILITY. I UNDERSTAND THAT, BY SIGNING THIS DOCUMENT, I MAY BE WAIVING VALUABLE LEGAL RIGHTS. I ACKNOWLEDGE AND SWEAR THAT I HAVE REACHED THE AGE OF MAJORITY AND, THEREFORE, AM ABLE TO ENTER INTO THIS RELEASE. I HAVE READ AND UNDERSTOOD THE ABOVE AND I HEREBY EXECUTE SUCH DOCUMENT ON THE DAY of  November 21, 2024

 

ACKNOWLEDGMENT OF WORKSHOP RULES 

I, hereby acknowledge and agree to the following terms and conditions for use of the woodshop facilities, equipment, programs, classes and the premises (collectively, the "Facilities'') located at 3305 Grande Vista Dr., Newbury Park, California 91320 (the “Premises”), which are leased by Woodworkers Retreat LLC, a California limited liability company ("WR"):

1. The Facilities, including the Premises, shall be open on the days and during the hours as may be established from time to time by WR.

2. The Facilities are available for non-exclusive recreational use only by members and guests of WR. The Facilities shall not be used for commercial or business purposes by members or their authorized guests and invitees.

3. Every member and / or guest using the Facilities must execute a Woodshop Release, Waiver and Disclaimer of Liability and an Acknowledgment of Workshop Rules (collectively, the "Workshop Agreement") in order to receive access to the Facilities.

4. The undersigned member and / or guest must "sign in" on the designated sign-in sheet prior to gaining access to the Facilities, including the Premises, during operating hours. No access will be available during non­operating hours.

5. An Operating Booklet for the Facilities’ workshop equipment is available at the Premises. The undersigned member and / or guest agrees to read all operating procedures prior to use of any equipment and exercising such equipment, represents to WR that the undersigned has read and understands such.

6. Each member and / or guest, as a condition of use of the Facilities, assumes sole responsibility for his or her person and property and that of the member’s guests and / or family members. WR shall not be responsible for any loss or damage to any private property used or stored at the Facilities.

7. All guests and/or family members must be accompanied by the undersigned member. Property or furniture belonging to WR shall not be removed from the Facilities, without proper written authorization. The undersigned member and / or guest shall be liable for any property damage and / or personal injury at the Facilities caused by the member and / or guest, any guest or any family member of the member. The cost of any damage may be charged to the undersigned member's account.

8. The undersigned member agrees to clean up any debris created when using the Woodshop Facilities or specific equipment that are part of the Facilities.

9. The undersigned member acknowledges and agrees that Woodworkers Retreat reserves the right to close the shop to its members for special events. WR will make every effort to provide advance notice of such closures with the appropriate signage. Members agree to accommodate these occasional closures and acknowledge that WR will not be liable for any inconvenience caused by these adjustments to the schedule.

10. Additional rules and regulations for use of the Facilities may be posted at the Facilities. WR reserves the right to amend or modify rules and regulations for the use of the Facilities and will notify the members or post any change.

I hereby agree to be bound by the rules and regulations for the Facilities.

DAMAGE RESPONSIBILITY DISCLAIMER

To All WR Members and Day Pass Holders:

By signing below, you agree to the following conditions regarding tool usage at Woodworkers Retreat:

You will be responsible for any breakage, damage, or replacement costs for tools if it is determined that these incidents were caused by negligence or misuse. Actions that go against the safety practices taught in our safety class, as well as incidents confirmed by staff observation or security cameras, may result in one or more of the following consequences: financial liability for the member at fault, termination of that member’s membership, and/or mandatory completion of a refresher safety course for the member involved.
