CONTRACTUAL ASSUMPTION ACKNOWLEDGEMENT OF RISKS AND LIABILITY WAIVER
AND RELEASE AGREEMENT

IN CONSIDERATION of being permitted to participate in the charter/rental provided by RJDATX Holdings LLC DBA Disco Cowgirl Boat Rentalifor myself and/or any minor children for whom I am the legal parent/guardian or otherwise responsible, and for my/our heirs, personal representatives, or assigns:

ACKNOWLEDGEMENT OF RISKS

I fully acknowledge that some, but not all of the risks of participating in the charterin which I am about to engage may include (1) wind shear, inclement weather, lightning, variances and extremes of wind, weather and temperature; (2) any sense of balance, physical condition, ability to operate equipment, swim and/or follow directions; (3) collision, capsizing. sinking or other hazard which result In wetness, injury, exposure to the elements, hypothermia, impact of the body upon the water, injection of water into my body orifices, and/or drowning; (4) the presence of and/or injury, illness or death resulting from insects, animals and marine life forms; (5) equipment failure, operator error, transportation accidents; (6) heat or sun related injuries or Illness, including sunburn, sunstroke or dehydration; (7) fatigue, chill, and/or dizziness which may diminish my/our reaction time and increase the risk of an accident; (8) slippery decks and/or steps when wet; (9)Sightseeing boat charter, as well as docking off so passengers can get into water to swim with floatation devices.ii



I specifically acknowledge that I have been given instructions/training in the safe use of the type of equipment used during this charter to my complete satisfaction, I understand them fully and I am physically/mentally able to participate in the charter which I am about to engage.



I understand that past or present medical conditions may be contraindicative to my participation in the charter/rental. I affirm that I am not currently suffering from a cold or congestion or have an ear infection. I affirm that I do not have any infectious disease or illness (e.g., COVID or similar variants). I affirm that I do not have a history of seizures, dizziness, or fainting, nor a history of heart conditions (e.g., cardiovascular disease, angina, heart attack). I further affirm that I do not have a history of respiratory problems (e.g., emphysema or tuberculosis). I affirm that I am not currently suffering from back, spine and/or neck injuries. I affirm that I am not currently taking medication that carries a warning about any impairment of my physical or mental abilities.



CONTRACTUAL/EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY

I fully agree to assume all responsibility for all the risks of the [RJDATX Holdings LLC DBA Disco Cowgirl Boat Rental] ivto which I am about to engage, whether identified above or not (I FULLY UNDERSTAND THAT I UNDERTAKE EVEN THOSE RISKS ARISING OUT OF THE NEGLIGENCE OF THE RELEASEES NAME BELOW). My/Our participation in the charteris completely voluntary. I assume full responsibility for myself and any of my minor children for whom I am responsible. This responsibility that I assume on my behalf and that of my minor children, or those children for whom I am legally responsible, extends to any bodily injury, accidents, illnesses, paralysis, death, loss of personal property and expenses thereof as a result of any accident which may occur while we participate in the activity. I COMPLETELY UNDERSTAND AND AGREE TO ACCEPT ALL RESPONSIBILITY ON BEHALF OF MYSELF AND MY MINOR CHILDREN, OR THOSE CHILDREN FOR WHOM I AM LEGALLY RESPONSIBLE, EVEN IF THESE INJURIES, DEATH, OR LOSS OF PERSONAL PROPERTY ARE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES NAMED BELOW.



This Agreement shall be governed by the laws of United States of America and Travis County v Any legal action relating to or arising out of this agreement against or with respect to RJDATX Holdings LLC DBA Disco Cowgirl Boat Rentalvi shall be commenced exclusively in United States of America. Any legal action relating to or arising out of this Agreement against or with respect to any of it RJDATX Holdings LLC DBA Disco Cowgirl Boat Rental affiliated or related companies shall be commenced exclusively in the Court of Western District of Texasvii.  I agree that I will reimburse in full any attorney feesincurred by the assured or their Insurers to defend any legal action under this agreement.

I HEREBY RELEASE RJDATX Holdings LLC DBA Disco Cowgirl Boat Rental THEIR AFFILIATED AND RELATED COMPANIES, THEIR PRINICIPALS, DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, AND VOLUNTEERS, THEIR INSURERS, AND EACH AND EVERY LANDOWNER, MUNICIPAL AND/OR GOVERNMENTAL AGENCY UPON WHOSE PROPERTY AND ACTIVITY IS CONDUCTED, AS WELL AS THEIR INSURERS, IF ANY, EACH AND EVERY CRUISELINE OR COMPANY WHO FACILITATED PARTICIPATION AND/OR PURCHASE OF TICKETS, OR FROM ANY AND ALL LIABILITY OF ANY NATURE FOR ANY AND ALL INJURY, PROPERTY LOSS OR DAMAGE (INCLUDING DEATH) TO ME OR MY MINOR CHILDREN AS WELL AS OTHER PERSONS AS A RESULT OF MY/OUR PARTICIPATION IN THE ACTIVITY, EVEN IF CAUSED BY MY NEGLIGENCE OR BY THE NEGLIGENCE OF ANY OF THE RELEASEES NAMED ABOVE, OR ANY OTHER PERSON (INCLUDING MYSELF).



I have read this assumption and acknowledgement of risks and release of liability agreement I understand fully that it is contractual in nature and binding upon me personally. I further understand that by signing this document I am waiving valuable legal rights including any and all rights I may have against the owner, the renter/charterer, the operator named above, or their employees, agents, servants or assigns. I FULLY AGREE IN CONSIDERATION FOR BEING ALLOWED TO PARTICIPATE IN THE CHARTER TO HOLD HARMLESS AND INDEMNIFY THE OWNER, THE OPERATOR NAMED ABOVE OR THEIR EMPLOYEES, AGENTS, SERVANTS OR ASSIGNS FOR ANY INJURY WHICH MAY BEFALL ME, MY MINOR CHILDREN OR THOSE CHILDREN FOR WHOM I AM LEGALLY RESPONSIBLE (INCLUDING DEATH).

i     Insured's name will be the name as detailed on the policy including any DBA names. I.e. Fred Smith DBA Freddie's Fishing Trips.

ii   Include any risks specific to your business that are not included above in 1-8.

iii  Participants must initial each section throughout the document.

iv  This will include the name of the Charter/Rental if it has one. i.e. Freddie's Fish Adventures if there is no name Charter/Rental can remain.

v   This is the country as detailed on the policy.

vi  Assured's name will be the name as detailed on the policy including any DBA names. I.e. Fred Smith DBA Freddie's Fishing Trips.

vii Please state the court, for your locality e.g. Circuit in and for Miami-Dade County Florida/Western District of New York. viii Each and every participant must sign and initial the release and complete the details. One document for each participant.


I. WAIVER AND RELEASE OF LIABILITY AGREEMENT DISCLAIMER

This Waiver and Release Agreement is applicable to all renters, operators, passengers, and users of services provided by Disco Cowgirl Boat Charters ("Disco Cowgirl"). For purposes of this Waiver and Release, the term "Disco Cowgirl" includes all owners, directors, officers, employees, agents, representatives, assigns, successors, insurers, and subsidiaries of Disco Cowgirl Boat Charters. If any other agreement is supplemented with this Release, the provisions of this Release will prevail over any inconsistent clauses in the other agreement. The undersigned agrees that he/she is also signing this Release on behalf of any minor children accompanying them. The renter agrees to disclose all potential operators, passengers, and users of the chartered boat. Failure to do so may result in personal liability for any damages or injuries sustained by undisclosed individuals, even if such damages arise due to the negligence or fault of Disco Cowgirl.


II. ACKNOWLEDGEMENT OF RISKS

The undersigned acknowledges that participating in boating and water activities involves inherent risks, including but not limited to:

1.    Changing water conditions, including tides, currents, and wave action.

2.    Collisions with boats, docks, or other natural or manmade objects.

3.    Equipment failure or operator error.

4.    Slipping, tripping, or falling on wet surfaces.

5.    Exposure to extreme weather conditions, including heat, sunburn, dehydration, wind, and storms.

6.    Encounters with insects or marine life.

7.    Risk of injury, drowning, or death due to unforeseen incidents.

8.    The effects of alcohol and other impairments on judgment and coordination.

The undersigned understands that this list is not exhaustive and that other unforeseen risks may exist.

III. EXPRESS ASSUMPTION OF RISK

The undersigned voluntarily assumes all risks associated with participation in activities related to Disco Cowgirl, including but not limited to injuries such as sprains, fractures, cuts, contusions, head injuries, drowning, and other potential harm. The undersigned accepts full responsibility for any personal injury, illness, property damage, or financial loss, regardless of the cause, including negligence or fault of Disco Cowgirl.


IV. ALCOHOL AND RELEASE OF LIABILITY POLICY

Disco Cowgirl does not provide or sell alcohol but allows passengers to bring their own alcoholic beverages. Passengers assume all risks associated with alcohol consumption, including increased risks of injury, impaired judgment, and accidents. Passengers must arrange safe transportation after the charter ends and agree not to operate a motor vehicle while under the influence. By signing below, the undersigned acknowledges full responsibility for any harm or injuries sustained while consuming alcohol and releases Disco Cowgirl from liability related to alcohol use.


V. WAIVER/RELEASE OF LIABILITY

By signing this Release, the undersigned voluntarily releases and agrees to indemnify and hold harmless Disco Cowgirl from any and all liability for injuries or damages sustained while participating in the boat charter experience. The undersigned acknowledges that Disco Cowgirl is not responsible for loss or theft of personal property.

This Waiver and Release applies even in cases of negligence by Disco Cowgirl, except in cases of gross negligence or intentional misconduct.


VI. LIABILITY TO THIRD PARTIES

The undersigned agrees to indemnify and hold harmless Disco Cowgirl for all personal injuries, property damage, or any other harm sustained by third parties as a result of participation in Disco Cowgirl activities, even if such damages arise from the negligence of Disco Cowgirl.


VII. VIDEO/PHOTOGRAPHY RELEASE FORM

I grant permission to Disco Cowgirl and its representatives to use photographs and/or videos taken during the charter for promotional, advertising, or trade purposes. I waive any rights to compensation or claims related to such use.


VIII. ACKNOWLEDGEMENT OF WAIVER AND RELEASE

The undersigned has had sufficient time to review this Waiver and Release, understands its contents, and signs voluntarily. The undersigned acknowledges that participation in a Disco Cowgirl boat charter is contingent upon signing this Release.


IX. MINORS AND NON-SWIMMERS

All minors must wear life jackets at all times unless otherwise exempt under Texas law. The undersigned acknowledges responsibility for ensuring compliance. Disco Cowgirl assumes no liability for injuries to non-swimmers or individuals not wearing life jackets.


X. HEALTH AND FITNESS ACKNOWLEDGEMENT

The undersigned certifies they are physically fit and not under the influence of any drugs or other substances that could impair their ability to participate safely. They agree to inform the Captain of any relevant medical conditions before departure.


XI. SEVERABILITY

If any provision of this agreement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.


XII. GOVERNING LAW AND JURISDICTION

This agreement shall be governed by and construed under the laws of the State of Texas. Any legal action arising from this agreement shall be brought exclusively in the courts located in Travis County, Texas.


XIII. ACKNOWLEDGEMENT ON BEHALF OF GROUP

The person signing this Waiver (“Renter”) acknowledges and agrees that they are signing this agreement both individually and, to the maximum extent allowed by law, on behalf of all passengers, guests, invitees, and participants (collectively, “Participants”) who accompany them. The Renter affirms they have the legal authority to bind all such Participants to the terms of this Waiver and Release.

In the event any Participant has not signed this Waiver, their presence on the vessel or participation in the charter shall constitute acceptance of and agreement to all terms of this Waiver and Release.


XIV. DEEMED CONSENT BY PARTICIPATION

Any individual who boards the vessel, enters the dock area, or otherwise participates in any aspect of the charter, whether or not they have personally signed this Waiver, shall be deemed to have read, understood, and agreed to all terms of this Waiver and Release. By their actions, such individuals assume all associated risks and waive any and all claims against Disco Cowgirl.


XV. RENTER RESPONSIBILITY

The Renter assumes full responsibility for informing all Participants of the terms of this Waiver. The Renter agrees to indemnify and hold harmless Disco Cowgirl from any claims brought by any Participant who fails to sign this Waiver or who claims they were unaware of its terms.
