WITNESS THIS AGREEMENT this November 21, 2024 by and between Hayden Acres LLC , hereinafter referred to as MANAGER and Rider, and, if Rider is a minor, Rider's parent or guardian. . In consideration received, and in return for the use, today and on all future dates of the property, facilitiesand services of Manager, Manager's instructors, employees and agents; Rider, Rider's heirs, assigns, and representatives, hereby agree as follows: 1. Inherent Risks and Assumption of Risk. The undersigned acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability. Rider acknowledges that horses, by their very nature are unpredictable and subject to animal whim, which may include behavior including but not limited to their propensity to kick, bite, shy, buck, stumble, bolt, rear or general unpredictability. Rider assumes all risks in connection therewith, and expressly waives any claims for any injury or loss arising therefrom. Rider agrees to abide by and follow Manager's rules and regulations which, shall be posted and/or available from time to time. Rider further acknowledges that the behavior of any animal is contingent to some extent upon the ability of Rider. Rider assumes all risks therefor and warrants a full and fair disclosure of Rider's abilities has been made to Manager. Rider expressly releases Manager from any and all claims for personal injury or property damage, even if caused by negligence (if allowed by the laws of this State) by Manager or its representatives, agents or employees. ATTENTION An equine owner or an agent of an equine owner who regardless of consideration allows another person to take control of an equine is not liable for an injury to or the death of the person if: - The person has taken control of the equine from the owner or agent when the injury or death occurs.
- The person or the parent or legal guardian of the person if the person is under eighteen years of age has signed a release before taking control of the equine.
- The owner or agent has properly installed suitable tack or equipment or the person has personally tacked the equine with tack the person owned, leased or borrowed. If the person has personally tacked the equine, the person assumes full responsibility for the suitability, installation and condition of the tack.
- The owner or agent assigns the person to a suitable equine based on a reasonable interpretation of the person's representation of his skills, health and experience with and knowledge of equines.
- RIDER (OR RIDER’S PARENT OR GUARDIAN) AGREES TO HOLD HARMLESS, INDEMNIFY AND DEFEND MANAGER AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, JUDGMENTS, ORDERS, COSTS OR EXPENSES, INCLUDING ATTORNEY'S FEES, WHICH MAY IN ANY WAY ARISE FROM OR BE IN ANY WAY CONNECTED WITH RIDER'S USE OF OR PRESENCE UPON THE PROPERTY OF MANAGER AND THE FACILITIES LOCATED THEREON. In the event rider is a minor, the parent or guardian shall further indemnify, defend and hold Manager harmless from any such claims by said minor child, regardless of any statute of limitations or contractual limitation of actions..
- In the event Rider is using Rider's own horse, or a horse(s) not owned by Manager, Rider warrants said horse(s) shall be free from infection, contagious or transmittable diseases. Manager reserves the right to refuse access or use of any horse upon the premises that does not appear to Manager to be in good health, or is deemed dangerous or undesirable.
- Any action brought under this agreement shall be brought within one (1) year of the incident or accident giving rise to said claim. Rider agrees that damages shall be limited to $250 for property damage, medical or other actual expenses incurred, and a maximum of $10,000 for damages such as pain and suffering.
- Rider agrees to waive the protection of any applicable statutes in this jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing said release.
CAMPS The undersigned represents that I am the parent and/or guardian of child/children listed below.
I hereby give permission for my child to participate in all of the activities of the Hayden Acres Camps (“HA”). I understand that Hayden Acres LLC is not a licensed child care facility or day care. I agree and understand that I must report immediately to the HA staff any injuries to my child that become known to me. It is further agreed that HA shall not be liable to me, my child, or our respective heirs, and executors, for any claims, demands, injuries, damages, actions, or causes of action whatsoever, arising from any injury or damage to my child’s person or property arising out of or connecting with the activities of HA, or the use of the services, facilities or premises of HA by my child. Further, for myself and for my child and our respective heirs, and executors, I do expressly hereby forever release and discharge HA and its officers, directors, volunteers, agents or employees from all claims, demands, injuries, damages, actions, or courses of action, and from all acts of active or passive negligence on the part of HA ,its officers, directors, volunteers, agents or employees. Further, I do expressly agree to indemnify, defend and hold harmless HA and its officers, directors, volunteers, agents or employees from all claims, demands, injuries, damages, actions, or courses of action, brought by on or behalf of my child and arising from or related in any way to any and all acts of active or passive negligence on the part of HA, its officers, directors, volunteers, agents or employees. To the extent necessary, I expressly waive any claim or defense of parental immunity. In the event of an emergency and injury to my child, I authorize any officer or director of HA to engage the services of a physician, medical doctor, hospital or other facility to provide emergency medical care for my child. I agree to pay all costs, fees and expenses related to or arising from such emergency medical treatment and I expressly agree indemnify, defend and hold harmless HA against any and all claims for such costs, fees and expenses.

Barn Rules
- Helmets must be worn while riding and by children any time they handle a horse.
- Please do not run, scream, or throw anything- this is for the safety of everyone and the horses.
- DO NOT approach any horse from directly in front of or directly behind them.
- No Smoking on property.
- Only shoes that fully enclose the foot are permitted on the farm.
- Please do not park in front of gates.
- Please clean up after you and your children. (trash, clothes, horse tack, etc.)
- Children must be supervised by parents at all times.
- All guests MUST sign a liability form.
- Staff or horse owner(s) are only ones allowed in the pasture.
- Make sure you close your horse's door and latch it tight.
- Put all tack and other items away when you're finished using them.
- Pick up any manure your horse makes in the aisle or other common areas
- Please be kind and courteous of others on property
- Please DO NOT feed any horses/animals unless given permission by owner or stable manager/instructor.
- DO NOT go in any stall or animal pen without permission from staff/owners.
- Do not climb on fences or gates.
- No dogs or other animals on property please unless given permission by barn owners
- PLEASE address any concerns, complaints or suggestions to barn owners! We want to know if there is something wrong so we can try to fix it.
Riding Attire and Rules
Students agree to come dressed to ride in proper riding attire consisting of: 1. Long pants: Jeans, breeches or riding tights. *Exceptions are made during the summer for hot weather 2. Riding boots or closed toed shoes, at minimum: Boots with a smooth sole and defined heel not more than 1½ inches high. (Under no circumstances will students wearing sandals or flip flops be allowed to participate in ANY Equine Activities.) 3. Fitted/Semi Fitted Shirt: Students will not be permitted to ride in loose or billowing clothes or dangling jewelry as it can pose a safety risk should loose items get caught/snagged on saddle or horse. 4. Appropriate accessories for the weather/season (sun screen, gloves, ear warmers, cooling towel, etc.). 5. Riding Helmet: An ASTM approved riding Helmet must be worn at all times while participating in mounted Equine Activities. Stable owned helmets are available for student use. NOTE: Failure to arrive at lessons in proper riding attire including ASTM riding helmet will result in student not being permitted to ride or participate in that day’s Equine Activities and will be subject to $25 cancellation fee. 6. Hayden Acres LLC will provide helmet if student does not have one, but we recommend purchasing and bringing your own once you are taking consistent lessons. 7. All parents, siblings, friends of students should remain outside of the arena during lessons unless invited in by the instructor. Please limit contact with a student during their riding lesson. 8. Rider(s) or their parent/guardian agree to address any concerns or questions with the owner(s) of Hayden Acres. If you are unhappy or unsure- WE WANT TO KNOW! We have several instructors that may be a better fit or can help you with different disciplines.
Lesson Payments: Riding lessons are to be paid in full prior to or at time of lesson. We accept Venmo, Zelle or cash. We also accept ESA/Classwallet . Venmo- @haydenacresaz Zelle- haydenacres6@gmail.com
Cancellation and Make-Up Policy Considerable time goes into planning lessons with instructors and reserving horses for riders, therefore it is the responsibility of the rider to come to lessons on time. In the event Hayden Acres or the instructor cancels a lesson, a make-up lesson will be re-scheduled at the convenience of the rider. - Your lesson time reserves the exclusive use of a school horse for that designated time slot, cancellations for any reason must be made at least 24 hours prior to your lesson time.
- If you do not cancel a lesson and do not show up for it, it will be considered a "No Show" and you will be charged the full amount of the lesson.
- Failure to give 24-hour notice when making a cancellation will result in a “No Show” and you will be charged the full amount of your lesson
- Students that miss 2 lessons in a row without notice or excuse may lose their weekly spot should trainer have a waitlist for vacancies
- If running late to a lesson please contact us, riders more than 15 minutes late with no notice will be marked absent from the lesson.
- If running late- please be advised your lesson will be shortened and end at your originally scheduled time and will still be charged at your regular rate. We cannot disrupt scheduled lesson times that take place after your lesson.
- Cancellations made with at least 24-hour notice may be rescheduled, subject to availability.
- Any lessons cancelled by Hayden Acres will be rescheduled
- Cancellations may be made thru online scheduling system or by phone, email, Facebook page or text.
*Please note that in the event Hayden Acres is closed for competitions, holidays or events, make-up lessons will be given for any displaced classes. In Case of Emergency:
Should a student fall, please remain quiet and out of the arena/round pen. Screaming or running out into the ring may cause the horse(s) to spook. The instructor will direct the student/class along with other barn help and if needed will call you into the ring, at which time you should walk quietly out to the student. As long as the student is not injured, it is our policy to get them right back on the horse.
Guests ALL guests MUST sign a liability waiver, located in tack room. Any adults or children that accompany you or your child to the stable from this day forward, are your sole responsibility. Hayden Acres LLC is not responsible for any injury or damages to guests and will not be held liable. By signing this contract/waiver you agree to indemnify, defend and hold harmless Hayden Acres LLC at 40859 and 40779 N Kenworthy Rd in San Tan Valley, AZ 85140 and any and all of its employees, operators and affiliates for and from any litigation, claims, damages, expenses and or losses arising from their presence at Hayden Acres LLC.
