GENERAL LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK

Directions: Please read carefully, fill in all blanks and initial each paragraph before signing at bottom.

For SDI Scuba Discovery training program under sanction through SDI.

I,

hereby affirm that I have been advised and thoroughly informed of the inherent hazards of scuba diving activities


 Further, I understand that diving with compressed air or oxygen enriched air (nitrox) involves certain inherent risks including decompression sickness, embolism, oxygen toxicity, inert gas narcosis, marine life injuries or other barotrauma/hyperbaric injuries can occur that require treatment in a recompression chamber. I further understand that the open water diving trips, which are necessary for training and certification, may be conducted at a site that is remote, either by time of distance or both, from such a recompression chamber. I still choose to proceed with such instructional dives in spite of the possible absence of a recompression chamber in proximity to the dive site.


I understand and agree that neither my Instructor(s) Referenced in the Divers Supply Member Addendum, the facility through which I received my Instruction, Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc. DBA Divers Supply, International Training and Scuba Diving International, nor the officers, directors, shareholders, affiliated companies, employees, agents, or assigns of the above listed entities and/or individuals, nor the authors of any materials including texts and tables expressly used for training and certification (hereinafter referred to as “Released Parties”) may be held liable or responsible in any way for any injury, death, or other damages to me or my family, heirs, or assigns that may occur as a result of my participation in this diving class or as a result of the negligence of any party, including the Released Parties, whether passive or active.


In consideration of being allowed to enroll in this course, I hereby personally assume all risks in connection with said course, for any harm, injury, or damage that may befall me while I am enrolled as a student of this course, including all risks connected therewith, whether foreseen or unforeseen.


I further agree to save, defend, indemnify, and hold harmless said course and Released Parties from any claim or lawsuit by me, anyone purporting to act on my behalf, my family, estate, heirs or assigns, arising directly or indirectly out of my enrollment and participation in this course including both claims arising during the course or after I receive my certification even if such claims may be groundless, false or fraudulent.


I also understand that diving activities are physically strenuous and that I will be exerting myself during this diving course, and that if I am injured as a result of heart attack, panic, hyperventilation, oxygen toxicity, inert gas narcosis, drowning, etc. that I expressly assume the risk of said injuries and that I will not hold the above listed individuals or companies responsible for the same, and I agree to defend, indemnify, and hold harmless said course and Released Parties for any such injuries incurred by me.


I understand that these activities may place me deeper than I am able to safely execute a free (without breathing gas) ascent from.


I understand that I may be required to furnish my own equipment and that I am responsible for its operating condition and maintenance.


I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian.


I understand that the terms herein are contractual and not a mere recital, and that I have signed this document of my own free act. Further that

I understand and agree that, in the event that one or more of the provisions of this agreement, for any reason, is held by a court of competent jurisdiction to be invalid or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof, and this agreement shall be construed as if such invalid, illegal or unenforceable provision or provisions had never been contained herein.

IT IS THE INTENTION OF

INSTRUCTORS, Referenced in the Divers Supply Member Addendum (AND OTHERS), THE FACILITY THROUGH WHICH I RECEIVED MY INSTRUCTION Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc. DBA Divers Supply, THE TRAINING AGENCY AND INTERNATIONAL TRAINING AND SCUBA DIVING INTERNATIONAL, AND ALL OTHER RELATED ENTITIES AND RELEASED PARTIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, OR ARISING OUT OF, DIRECTLY OR INDIRECTLY, INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK BY READING IT BEFORE SIGNING IT ON BEHALF OF MYSELF AND MY HEIRS.

This document is required for all courses and Specialties taught under sanction by Scuba Diving International. No alterations, changes, omissions or revisions may be made.

Assumption of Risk and Liability Release 

This Liability Release is a release of your right to sue.  This release will be used against you in a court of law, if you sue any party or person listed in this release. 

Please read carefully before signing.  If you have any questions please have them answered to your satisfaction before signing this release.  Your signature indicates that you fully understand this release and it is your intention to exempt and release Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply and all of their officers, managers, staff members, PADI, IANTD, NAUI, SDI, TDI, PDIC, SSI, YMCA, all certification agencies, all dive instructors, dive masters, boats, boat crew, boat owners and all other related persons or entities from all liability or responsibility whatsoever for personal injury, property damage or wrongful death however caused, including but not limited to, the negligence or the gross negligence of the released parties, whether passive or active.

I, the participant hereby affirm that I have been advised and thoroughly informed of the inherent hazards of diving and using compressed gases underwater.  That using compressed air, NITROX, or any mixed gases, predisposes me to certain hyperbaric problems, Squeeze, Vertigo, Arterial Gas, Embolism, Mediastinal and Subcutaneous Emphysema, Pneumothorax, Nitrogen Narcosis, Oxygen Toxicity, Decompression Sickness, Compression Pains, and other hyperbaric problems.  Hypoxia, Hypothermia and Drowning are also a danger when diving.  Hyperbaric injuries require treatment in a recompression chamber.  Diving trips for fun, training and/or certification may be conducted at locations remote from a recompression chamber facility.  It could take a long time to reach a chamber facility, and I still choose to proceed with my diving activities.         

I understand and agree that neither my instructor(s) or Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply, PADI, IANTD, NAUI, SDI, TDI, PDIC, SSI, YMCA, all certification agencies, all dive instructors, dive masters, boats, boat crew, boat owner, and all other related persons or entities, any training facility or association or any of their respective employees, officers, owners, agents or assigns, (hereinafter referred to as “Released Parties”) may not be held liable or responsible in any way for any injury, death, or other damage to me or my family, heirs, or assigns that could occur as a result to my participation in diver training, diver activities or any activities with the Released Parties.  

For being allowed to participate in diver training and/or activities, I hereby assume all risk in connection with all aspects of diving activities whether foreseen or unforeseen to include the transportation required to get to the dive sites before, during, and after the diving event.  I further save and hold harmless said “Released Parties” from any claim by me, my family, estate heirs or assigns, arising out of my participation in training or diver activities during, before, or after such activities. 

I also understand that if I am being transported by company owned or privately owned vehicles to any dive site before, during, and after a diving event that I further save and hold harmless all said “Released Parties”. 

I further state that I am of lawful age (over 18 years of age) and legally competent to sign this release or I have acquired written consent of a legal guardian who has signed below.  These terms are contractual and not a mere recital and I have signed this document of my own free will.  It is my intention as the participant and legal guardian to exempt and release all said “Released Parties”.

Coronavirus/COVID-19 

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. 

I further acknowledge that Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. 

I further acknowledge that Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply can not in any way guarantee that I will not become infected with the Coronavirus/COVID-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff/instructors, and other store clients and their families. 

I voluntarily seek services provided by Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while engaging in dive activities. I attest that: 

* I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. 

* I have not traveled internationally within the last 14 days. 

* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. * I have not been diagnosed with Coronavirus/COVID-19 and not yet cleared as non-contagious by state or local public health authorities. 

* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19. I hereby release and agree to hold Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the store, or that may otherwise arise in any way in connection with any services received from Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply. I understand that this release discharges Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply from any liability or claim that I, my heirs, or any personal representatives may have against the store with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply. This liability waiver and release extends to the store together with all owners, partners, and employees.

-DIVERS SUPPLY PUBLICITY RELEASE AGREEMENT- I hereby grant full permission to Outdoor Adventures Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply, and its representatives to use, reproduce, publish, distribute and exhibit my name, picture, portrait, likeness or voice, or any or all of the in or connected to Outdoor Adventures Inc , Charlie Marketing Inc., Divers Supply Inc.. DBA Divers Supply. I acknowledge that the above-named entities own all rights to the images and recordings in any medium, including but not limited to, print media and electronic media (including website, social media, etc.). I hereby waive any right to inspect or approve the use of the image or recording. I further waive all moral rights, I also waive any right to royalties or other compensation arising from or related to the use of the images, recordings, or material. I hereby release, waive, forever discharge, and covenant not to sue the above named entities, its governing board, officers, agents, employees, and any students acting on behalf of these entities from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or in composite form that occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution.
