Warm Springs Farms Release of Liability

ACCIDENT WAIVER AND RELEASE OF LIABILITY

1. RISK ACKNOWLEDGMENT: I, the undersigned, understand that participating in activities at Warm Springs Farms LLC and or our DBA Palm Creek Ranch picnic area involves certain inherent risks. These include, but are not limited to:

  • Swimming & Water Activities: Risk of drowning, near-drowning, slips on wet surfaces, and injuries from diving. I acknowledge there is NO LIFEGUARD ON DUTY and I swim at my own risk.
  • BBQ & Grilling: Risk of burns, smoke inhalation, and fire-related injuries.
  • Outdoor Risks: Potential for foodborne illness, insect bites, heat exhaustion, and uneven terrain.

2. VOLUNTARY PARTICIPATION: I confirm that my attendance and participation in these activities are strictly voluntary and are not a condition of my attendance.

3. RELEASE AND WAIVER: In consideration for being permitted to use the facilities, the undersigned hereby waives, releases, and discharges Warm Springs Farms LLC and or our DBA Palm Creek Ranch, its officers, and employees from any and all liability for death, disability, personal injury, or property damage which may occur during the event, including those caused by the negligence of the releasees.

4. INDEMNIFICATION: The participant agrees to indemnify and hold harmless  from any liabilities or claims made by other individuals or entities as a result of their actions during this event.

5. ALCOHOL CONSUMPTION (If Applicable): If alcohol is consumed, it must be done so responsibly. The participant accepts full responsibility for any injury or damage resulting from impaired judgment or physical ability.

6. MEDICAL TREATMENT: Consent is hereby given to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

7. GUARDIANSHIP AND RESPONSIBILITY: Any adult signing on behalf of a minor or dependent person acknowledges they have the legal authority to do so and agrees to all terms of this release on behalf of said individual.
