Dakota Cat Café Lounge Participation Waiver

DAKOTA CAT CAFÉ and FURRY FRIENDS ROCKIN’ RESCUE (hereinafter collectively referred to as the “Cat Café”) provide access to cats for guest interaction. By signing this release, I acknowledge that I am voluntarily participating in these activities, including playing with or being in the presence of cats, in exchange for the opportunity to do so and any applicable fees. I agree to be bound by the terms of this release.

I understand that the behavior of cats can be unpredictable, and that injuries, whether caused directly or indirectly by the cats, are not the responsibility of the Cat Café, its owners, employees, volunteers, affiliates, or any associated vendors (collectively referred to as the “Releasees”).

I acknowledge that I am solely responsible for any risks associated with participating in these activities, including, but not limited to, injury, allergic reactions, property damage, or other losses. I accept full responsibility and agree to hold the Releasees harmless from any claims arising from my participation.

I acknowledge that I have been informed of and will follow all rules and instructions provided by Cat Café staff. I understand that failure to comply may result in immediate removal from the premises, without refund, and that future entry may be denied.

I understand that Cat Café makes no guarantees regarding supervision or control of the cats. While staff and volunteers may be present to monitor general activity or answer questions, they are not responsible for my personal interaction with the cats or any outcomes resulting from that interaction.

I voluntarily release, waive, and discharge the Cat Café and all associated parties from any and all liability related to injury, loss, or damage that may occur during my visit. This includes but is not limited to, injuries caused by cats or conditions on the premises, whether due to negligence or otherwise. I accept all risks associated with participating in activities at the Cat Café.

I authorize Cat Café staff or volunteers to administer basic first aid if needed and, if necessary, to arrange emergency medical care or transportation at my own expense. I understand that the Cat Café does not carry medical insurance for participants and that I am solely responsible for any and all medical expenses incurred as a result of my visit. I agree that it is my responsibility to carry personal medical insurance to cover such expenses.

This waiver is intended to be as broad and inclusive as allowed under the laws of the state of North Dakota. If any portion is found to be unenforceable, the remaining provisions will remain in full effect.

I agree to fully indemnify and hold harmless the Releasees from any and all liability or financial responsibility arising from my interaction with the cats, or any matters covered in this waiver. If I, or anyone action on my behalf, choose to legally challenge any portion of this waiver, I remain responsible for covering any resulting legal costs, including attorneys’ fees.

I confirm that by signing this waiver, I waive the right to bring future claims based on the issues addressed in this waiver.

Notice of Photography/Video Recording

By entering the Dakota Cat Café and Lounge, you acknowledge that photography, video and audio recording may occur on the premises.

Your presence constitutes your consent to be photographed, filmed, and/or otherwise recorded. This includes potential use of your likeliness in promotional materials, such as social media, our website, news content, or advertising.

By entering the premises, you also waive any rights or claims related to the use of this media by the Cat Café.

If you do not consent to photography or video, please let a staff member know when you arrive, and we will make every reasonable effort to exclude you from recorded media.

Minors and Waiver Requirements

For the safety and well-being of all visitors and animals, the Cat Café has the following policies regarding minors:

Any guests under the age of 18 are considered a minor and must be accompanied by a parent or legal guardian at all times while on the premises.

By signing this waiver on behalf of a minor, the undersigned affirms that they are the minor’s parent or legal guardian, and they accept full responsibility for the minor’s behavior, safety, and compliance with all café rules.

Each adult may supervise a maximum of two (2) minors during a visit. This ensures that adequate supervision in maintained in the café environment.

A separate waiver must be completed and signed for each adult visitor. Additional minors beyond the two-per-adult limit require additional adults present with signed waivers.

Parents or guardians signing on behalf of a minor agree to the same terms of liability release, risk assumption, and indemnification as outline in this waiver as they apply to minors.

These guidelines help us maintain a safe, calm, and respectful environment for all guests, human and feline.

By signing below, I confirm that I have read and fully understand this waiver and release of liability. I acknowledge that I am voluntarily choosing to enter Dakota Cat Café and participate in its activities at my own risk. I agree to comply with all posted guidelines and staff instructions, and I accept full responsibility for myself – and for any minors listed below – for any consequences resulting from our visit. I understand that this waiver is legally binding and intended to be enforceable under applicable North Dakota law.
