FULL AND GENERAL RELEASE OF ALL LIABILITY

For and in consideration of the mutual covenants herein, and for other valuable consideration, the receipt and sufficiency of which is acknowledged by both parties, Stillwater Lakes, Inc. (Stillwater Lakes), a Florida corporation, and the undersigned and his or her parent or legal guardian (collectively the “Undersigned”) agree as follows:

1. Stillwater Lakes is a private homeowner association that owns two man-made waterski lakes and surrounding roads and real estate (the “Stillwater Lakes Property”). The homeowners that are members of Stillwater Lakes own one or more of 18 lots that surround the man-made lakes (the “Homeowner’s Property”). Together the Stillwater Lakes Property and the Homeowner’s Property comprise about 66 acres and shall hereafter be known as the “Premises”

2. Stillwater Lakes agrees to allow the Undersigned to enter the Stillwater Lakes Property for the purpose of water-skiing, boating and related activities, all subject to the rules, regulations, and fees that may be established from time to time by Stillwater Lakes.

3. The Undersigned agrees, understands, and appreciates the inherent danger and risk of serious bodily injury, death, and paralysis involved in water skiing, boating and related activities, and simply walking on the Premises or observing any activities on the Premises. Such risks and danger of serious bodily injury, death, and paralysis, include, but are not limited to, extreme physical stress from skiing at speeds which may exceed 50 mph; extreme physical stress related to trick skiing, which may involve placing a tow rope on the foot and not wearing a flotation jacket; extreme physical stress while water ski jumping, which involves impacting a six foot high floating ramp and sudden impacts to the body of great force caused by crashes at speeds which may exceed 60 mph, extreme physical stress while wakeboarding, which involves jumping high into the air, flipping, and riding over manmade and natural objects; the possibility of striking natural or manmade objects in or under the water, including other persons; as well as the risk of serious bodily injury, death, or paralysis resulting from propeller injuries, equipment injuries, jet ski injuries, impacts with objects on shore or the lake bottom, danger of striking the shoreline or bottom because the ski rope length will exceed the distance from the towboat to the shoreline at almost all times due to the narrow lake width, trip hazards located on the land, both natural and man-made, and being struck by broken ropes, ski handles, and other equipment. As a result of the understanding and appreciation of the great risks involved with these activities, the Undersigned agrees to assume and bears full responsibility and sole liability for any death, bodily injury, or property damage occurring on the Premises that are incurred by Undersigned, even if caused in whole or part by the acts, omissions, errors or NEGLIGENCE of Stillwater Lakes, its employees, representatives, directors, officers, agents, contractors, independent contractors, volunteers, tournament judges, boat drivers, or officials, other skiers, technical persons such as course surveyors or technical controllers, the Stillwater Lakes’ homeowners or members, successors, assigns, or anyone else regardless if such persons are related in any manner to Stillwater Lakes.

4. The Undersigned agrees that it is the Undersigned’s sole obligation to purchase and to keep in full force medical, accident, and/or other insurance coverage covering personal injuries or property damage which may result from the Undersigned’s activities on the Premises, and agrees that no claims of any nature will be made against Stillwater Lakes, its employees, representatives, directors, officers, agents, contractors, independent contractors, volunteers, tournament judges, boat drivers, or officials, other skiers, technical persons such as course surveyors or technical controllers, the Stillwater Lakes’ homeowners or members, successors, assigns, or anyone else regardless if such persons are related in any manner to Stillwater Lakes.

5. The Undersigned certifies to Stillwater Lakes that he or she has the requisite skill, training, physical strength and conditioning, knowledge, and that the Undersigned has carefully inspected and is familiar with the Premises to undertake the activities in which the Undersigned will be engaged, and upon inspection of the facilities and equipment to be used, will immediately report any unsafe or defective condition therein and will refrain from participating in any activity which will or may adversely be affected by such facilities or equipment.

6. The Undersigned acknowledges and fully understands that he or she will be engaged in activities that involve great risk of serious personal injuries, including permanent disability and death, and that severe social and economic loss which may result from the action or inactions of the Undersigned, Stillwater Lakes, its employees, representatives, directors, officers, agents, contractors, independent contractors, volunteers, tournament judges, boat drivers, or officials, other skiers, technical persons such as course surveyors or technical controllers, the Stillwater Lakes’ homeowners or members, successors, assigns, or anyone else regardless if such persons are related in any manner to Stillwater Lakes, that may result from the condition of the Premises, facilities, the equipment used, boats, motor vehicles, or from other unforeseen risks, including acts of God, and the Undersigned agrees to fully assume all of the liability, responsibility, and consequences of such risks, regardless of the NEGLIGENCE of Stillwater Lakes, its employees, representatives, directors, officers, agents, contractors, independent contractors, volunteers, tournament judges, boat drivers, or officials, other skiers, technical persons such as course surveyors or technical controllers, the Stillwater Lakes’ homeowners or members, successors, assigns, or anyone else regardless if such persons are related in any manner to Stillwater Lakes.

7. The Undersigned hereby waives liability on the part of, discharges and covenants not to sue, or to execute upon any judgment against, and releases Stillwater Lakes, its employees, representatives, directors, officers, agents, contractors, independent contractors, volunteers, tournament judges, boat drivers, or officials, other skiers, technical persons such as course surveyors or technical controllers, the Stillwater Lakes’ homeowners or members, successors, assigns, or anyone else regardless if such persons are related in any manner to Stillwater Lakes from any and all liability, loss, damages, costs, expenses, including costs and attorney’s fees, causes of action, and claims of any kind or type, which may have arisen, arise, or may arise while the Undersigned is present on the Premises or otherwise, and specifically agrees to hold Stillwater Lakes and the aforesaid parties harmless from any and all liability for same including the NEGLIGENCE, acts, or omissions of Stillwater Lakes and/or the aforesaid parties.

8. It is the intent of the Parties that the Undersigned shall be solely responsible for his or her death, bodily injuries and damage to the Undersigned’s personal property and equipment, regardless of cause, fault, or NEGLIGENCE of Stillwater Lakes, its employees, representatives, directors, officers, agents, contractors, independent contractors, volunteers, tournament judges, boat drivers, or officials, other skiers, technical persons such as course surveyors or technical controllers, the Stillwater Lakes’ homeowners or members, successors, assigns, or anyone else regardless if such persons are related in any manner to Stillwater Lakes.

9. The Undersigned agrees that the venue for any dispute arising from any participation in the above described activities or concerning this Release in any way shall be litigated exclusively in the Courts of Brevard County, Florida and that no claims or actions shall be brought in any other jurisdiction against Stillwater Lakes, its employees, representatives, directors, officers, agents, contractors, independent contractors, volunteers, tournament judges, boat drivers, or officials, other skiers, technical persons such as course surveyors or technical controllers, the Stillwater Lakes’ homeowners or members, successors, assigns, or anyone else regardless if such persons are related in any manner to Stillwater Lakes.

10. The Undersigned hereby acknowledges my option to sign a new release on each date that I enter the Premises of Stillwater Lakes. However, I elect to forego that option and I therefore acknowledge and specifically intend that this release and waiver of rights shall be effective not only on the date hereof, but also on all occasions subsequent hereto when I shall enter the Premises of Stillwater Lakes.

I HAVE READ THE ABOVE AGREEMENT AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING THIS AGREEMENT AND HAVE SIGNED THE AGREEMENT VOLUNTARILY.
