WAIVER AND RELEASE OF LIABILITY -- READ BEFORE SIGNING

In consideration of the risk of injury while participating in guided fly fishing (the “Activity”), with Lazy River Fishing Tours, LLC (“Lazy River”), a Wyoming limited liability company, and as consideration for the right to participate in the Activity and its related events and activities, I, the undersigned Participant (or if the Participant is under the age of 18, I, on the Participant’s behalf), understand, acknowledge and contractually agree as set forth below (the Agreement):  

1. Lazy River has informed me that participating in guided fly fishing, which experience involves activities in, on, and adjacent to wild rivers, including travel by boat on rivers and ground-based transportation to and from rivers is not without risk. Certain risks are inherent to the Activity and cannot be eliminated or controlled without destroying the adventurous character of the Activity. I understand, acknowledge, and agree that participation in the Activity involves certain inherent dangers and risks, which risks can be the cause or loss or damage to my equipment, physical injury, or in extreme cases, permanent trauma or death. I agree that the following dangers or risks are inherent to the Activity, but that the following list is not exhaustive, and that there may be other dangers or risks that are inherent not listed below: water immersion; growing; hyperthermia; slipping, tripping, or falling in, around, or from boats; all commonly understood risks of riding in a vehicle; being struck or other injuries contact with vehicles; negligence, intentional misconduct, or malice by other participants; extreme weather, wind, hailstorms, and lightening, sun-exposure; all manner of injuries including heat exhaustion, heatstroke, dehydration, asphyxiation, and high-altitude sickness; allergic reaction to insects or plants; allergen exposure; exposure to or attack by wildlife; lack of readily accessible medical resources or care; poorly executed or failed rescue attempts; failure or lack of communication equipment or cell phone service. I agree that while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,  

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE

RELEASEES or others, and assume full responsibility for my participation; and,  

3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of Lazy River immediately; and,  

4. I hearby authorize Lazy River to undertake any emergency medical care for Participant, authorize any and/or their authorized personnel to call for medical care for the Participant or to transport the Participant to a medical facility or hospital or, in the opinion of such personnel, medical attention is needed.   

5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Lazy River, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARENT/LEGAL GUARDIAN OF PARTICIPANTS OF MINORITY AGE

This is to certify that I, as parent/legal guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my child and our heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
