 ASSUMPTION OF RISK, RELEASE OF LIABILITY & HOLD HARMLESS AGREEMENT

 PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT AFFECTS LEGAL RIGHTS.

The Primary Registered Guest acknowledges responsibility for ensuring that all persons occupying or visiting the registered campsite comply with the Rules and Regulations, safety requirements, posted signs, and instructions of Salt Lick Cove Campground.

Each adult eighteen (18) years of age or older must individually read, acknowledge, and sign this Agreement for themselves.

The signature of the Primary Registered Guest  does not constitute a waiver or release executed on behalf of another adult member of the party.

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK

 I understand that camping and recreational activities involve inherent and other risks that may result in property damage, personal injury, serious bodily injury, illness, disability, drowning, or death.

 These risks may include, but are not limited to:

●     Swimming and use of the swimming pool;

●     Lake and waterfront activities;           

●     Fishing;          

●     Use of the boat launch and docks;    

●     Boating and watercraft activity;

●     Slips, trips, and falls;

●     Wet or uneven surfaces;

●     Campfires and grills;  

●     Playground and recreational equipment;

●     Planned campground activities and events;

●     Golf carts, bicycles, motorcycles, scooters, and other vehicles;

●     Campground roads, parking areas, and speed bumps;

●     Dogs and other animals;

●     Wildlife, insects, snakes, and other naturally occurring hazards;

●     Trees, limbs, rocks, terrain, weather, storms, lightning, and other natural conditions;        

●     Showers, restrooms, pavilion areas, and common areas;

●     Acts or conduct of other guests, campers, visitors, or third parties; and

●     Other risks normally associated with camping, outdoor recreation, and campground facilities.

 I understand that Salt Lick Cove Campground cannot eliminate all risks associated with camping and recreational activities.

 I voluntarily choose to enter and use the campground and its facilities and  knowingly assume the risks associated with my participation and use of the property and facilities.  saltlickcovecampground@gmail.com

 2. SWIMMING POOL/LAKE — SPECIFIC ASSUMPTION OF RISK

 I specifically acknowledge and understand that:

 NO LIFEGUARD IS ON DUTY. SWIM AT YOUR OWN RISK.

 I understand that swimming in the lake and use of a swimming pool involve risks including, but not limited to:

● Drowning or near-drowning;

● Slipping and falling;   

● Collision with other swimmers or objects;     

● Injuries resulting from entering or exiting the pool/lake;

● Water-related illness; 

● Weather-related hazards;

● Serious bodily injury; and

● Death.

 I acknowledge that I have received or have been given access to the  Salt Lick Cove Campground Swimming Pool Rules and Regulations .

 I agree to obey all posted signage around the lake, pool rules, operating hours, safety requirements, and instructions from Salt Lick Cove Campground staff or management.

 I understand that violation of pool rules may result in immediate removal from the pool area and suspension or permanent loss of pool privileges.

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by Alabama law, I voluntarily release and discharge Salt Lick Cove Campground and its owners, operators, management, employees, agents, representatives, and volunteers from claims for personal injury, property damage, or death arising from my participation in campground or recreational activities or my use of campground facilities,  including claims arising from the ordinary negligence of a released party, to the extent such claims may lawfully be released.

This Agreement is  not intended to release or waive liability that cannot lawfully be released or waived under Alabama law , including conduct for which a release is prohibited by applicable law.

 4. HOLD HARMLESS AND INDEMNIFICATION

To the fullest extent permitted by Alabama law, I agree to indemnify and hold harmless Salt Lick Cove Campground and its owners, operators, management, employees, agents, representatives, and volunteers from claims, damages, losses, or expenses arising from:

1.             My own acts or omissions;

2.             My violation of campground Rules and Regulations;

3.             Damage to campground property caused by me;

4.             The acts of my pets or animals for which I am responsible; or

5.             Claims arising from persons for whom I am legally responsible, but only to the extent permitted by applicable law.

Nothing in this provision is intended to create an obligation prohibited by Alabama law.

 5. PERSONAL PROPERTY

I understand that I am responsible for securing my personal property, vehicles, recreational equipment, RV, camper, boat, watercraft, and other belongings.

Salt Lick Cove Campground is not responsible for lost, stolen, or damaged personal property except to the extent responsibility cannot legally be disclaimed.

6. RULES AND REGULATIONS ACKNOWLEDGMENT

I acknowledge that I have received, reviewed, or have been provided reasonable access to the current:

Swimming Pool Rules and Regulations

I agree to comply with these rules and with posted signs and reasonable instructions issued by campground staff or management.

I understand that violations may result in warnings, loss of privileges, removal of visitors, or termination of my stay or tenancy in accordance with applicable campground agreements, policies, and law.

 7. PET ACKNOWLEDGMENT

I certify that every pet brought onto Salt Lick Cove Campground property by me or any member of my party complies with all campground pet rules and applicable vaccination requirements.

As the Primary Registered Guest, I accept responsibility for ensuring that all pets within my party are properly supervised and controlled. I further accept responsibility for any injury, property damage, or other loss caused by a pet within my party, to the extent permitted by applicable law.

 8. PHOTOGRAPHY / VIDEO CONSENT

I acknowledge and consent that photographs and/or video recordings may be taken during my stay at Salt Lick Cove Campground and may be used for lawful campground advertising, marketing, social media, website content, and other promotional purposes. Salt Lick Cove Campground will not disclose or publish the names or personal identifying information of photographed or recorded individuals without separate permission.

 9. ADULT SIGNATURE REQUIREMENT

EVERY PERSON AGE 18 OR OLDER MUST SIGN FOR THEMSELVES.

By signing below, each adult signer individually represents that:

● I am at least eighteen (18) years old;

● I have read this entire Agreement;    

● I understand its terms;

● I have had an opportunity to ask questions before signing;

● I understand that I am giving up certain legal rights to the extent permitted by Alabama law; and

● I am signing voluntarily.

10. MINOR CHILDREN / DEPENDENTS

The following minor children are participating in campground activities or using campground facilities under my supervision:

PARENT/GUARDIAN ACKNOWLEDGMENT

I represent that I am the parent or legal guardian of, or otherwise have lawful authority and responsibility for, the minor child or children identified above.

I acknowledge that camping, swimming, lake activities, recreational activities, and use of campground facilities involve risks of injury, drowning, illness, property damage, and death.

I agree to properly supervise the minor child or children under my responsibility and ensure that they comply with all Salt Lick Cove Campground Rules and Regulations and Swimming Pool Rules.

I understand that  NO LIFEGUARD IS ON DUTY  at the Salt Lick Cove Campground swimming pool/lake, and that children must be actively supervised as required by the Swimming Pool Rules.

This parental acknowledgment is intended to operate only to the fullest extent permitted under Alabama law and  is not intended to waive any legal right of a minor that Alabama law does not permit a parent or guardian to waive.
