WAIVER, RELEASE AND INDEMNIFICATION AGREEMENT

In consideration of hosting an event at Soulful Prairies and/or lodging at Soulful Prairies, and/or being allowed to attend and participate in personal/professional counseling, consultation, seminars, events and workshops with Linda Bruce and Soulful Prairies, LLC and their animals, employees, agents, assistants, independent contractors, co-sponsors, volunteers, and affiliates located at 4706 Alden Road, Woodstock, McHenry County, Illinois, I hereby agree to RELEASE, WAIVE, DISCHARGE and HOLD HARMLESS,, Robert and Linda Bruce, RLB Farms, L.L.C., Soulful Prairies, LLC, their animals, agents, employees, assistants, volunteers, independent contractors, co-sponsors, and affiliates, of any liability whatsoever related to my attendance at and participation in the personal/professional coaching, consultation, coaching session, seminar or workshop or to learn their trainingmethods. I execute this release with the express intention of effecting the legal consequences, that is, the release of all liability associated with participating in the Soulful Prairies, LLC activities and events as set forth above provided under Illinois law, including, but not limited to the release of ​Robert and Linda Bruce, RLB Farms, L.L.C.and Soulful Prairies, LLC and their animals, employees, agents, assistants, independent contractors, co-sponsors, volunteers, and affiliates for any and all liability associated with my attendance at and participation in these activities.

This WAIVER, RELEASE AND INDEMNIFICATION AGREEMENT (“Release”) shall constitute the full and complete understanding between the parties and shall supersede any prior or contemporaneous representations or agreements, oral or written. This Release is irrevocable and shall be interpreted pursuant to and governed by the laws of the State of Illinois. It is agreed that the venue for any such action at law or equity is McHenry County, Illinois. No assignment of this Release is permitted and any attempt to assign all or any rights, obligations or duties granted under this Release shall be null and void.

Consistent herewith, I hereby forever RELEASE and INDEMNIFY, and FOREVER DISCHARGE, Robert and Linda Bruce RLB Farms, L.L.C. and Soulful Prairies, LLC​, their animals, agents, employees, assistants, independent contractors and co-sponsors and affiliates, of any liability whatsoever, whether known or unknown at the time of signing, related to my attendance at and participation in the aforementioned activities on this or any other day.

I hereby take this action for myself, my executors, administrators, heirs, next of kin, successors and assigns.

I acknowledge that I have been given the opportunity to ask questions regarding any aspect of the Release contained herein, and by signing below, do acknowledge that I have carefully and completely read and fully understand all aspects of the Release and agree to these terms in their entirety. I hereby agree that should any legal proceeding arise relating to this Release and agreement, the disallowance of any term or condition will not prevent the legal enforcement of all other terms and conditions of said Release and agreement. Having been so apprised, I hereby elect to and do assume all of the risk for claims heretofore or hereafter arising, whether known or unknown, from my participation.

I hereby give my consent and permission for Soulful Prairies, LLC to take and use my picture, name and likeness for any lawful purpose, including but not limited to display on Soulful Prairies’ website, advertising, marketing and press releases. Soulful Prairies is not required to identify me, contact me nor compensate me for this use.

RELEASE OF LIABILITY AND HOLD HARMLESS -  EQUINE ACTIVITY AGREEMENT

UNDER THE EQUINE ACTIVITY LIABILITY ACT OF ILLINOIS LAW, EACH PARTICIPANT WHO ENGAGES IN AN EQUINE ACTIVITY EXPRESSLY ASSUMES THE RISK OF AND LEGAL RESPONSIBILITY FOR INJURY, LOSS OR DAMAGE TO THE PARTICIPANT OR THE PROPERTY RESULTING FROM THE RISK OF EQUINE ACTIVITIES.

BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT THERE ARE INHERENT RISKS IN BEING NEAR TO AND ENGAGING WITH HORSES. THOSE RISKS INCLUDE BODILY INJURY AND DEATH. I UNDERSTAND THAT HORSES ARE UNPREDICTABLE AND CAPABLE OF SUDDEN, UNEXPECTED, AND POTENTIALLY DANGEROUS MOVEMENTS DESPITE THEIR PRIOR HISTORY. I FURTHER UNDERSTAND THAT HORSES ARE EASILY FRIGHTENED BY SOUND, SUDDEN MOVEMENT, UNFAMILIAR OBJECTS, SMELLS, PERSONS OR OTHER ANIMALS. THEY MAY RUN BITE, BUCK, OR KICK. HORSES MAY ALSO ENCOUNTER NATURAL HAZARDS SUCH AS SURFACE OR SUBSURFACE CONDITIONS AND MAY REACT UNPREDICTABLY. THEY MAY EVEN COLLIDE WITH OTHER OBJECTS, PERSONS OR ANIMALS.

In consideration for the permission and privilege to use and/or be around horses and participate in the equine activities with Linda Bruce and Soulful Prairies, LLC and to remain on those premises, located at 4706 Alden Road Woodstock, McHenry County, Illinois, I voluntarily agree to the terms of this RELEASE OF LIABILITY AND HOLD HARMLESS. I have acquainted myself with rules of safety applicable to any involvement with horses and their environment, and I understand that it is not anyone else’s obligation to teach them to me. I have read and understand the warnings listed above regarding horses and their environment. I further understand that it is my responsibility to refrain from acting in any manner that may cause or contribute to injury to myself or to others while participating in activities on the above-stated principles.

I hereby represent that I am capable of using and being in closer proximity to horses and their environment. I further represent that I am competent and capable to participate in the activities I will be participating in and agree to act within the limits of my abilities.

I hereby RELEASE, WAIVE, DISCHARGE and HOLD HARMLESS, both jointly and severally; Linda Bruce, Robert Bruce, RLB Farms, L.L.C., Soulful Prairies, LLC and their animals, agents, employees, assistants, volunteers, independent contractors, co-sponsors, and affiliates from any and every claim, demand, action, known or unknown, death or property damage resulting during my presence or the presence of my family or spectators at Soulful Prairies, providing such injury, property damage, or death is caused by negligence.

This release shall be governed by the laws of the State of Illinois.  If any portion of this release is held invalid by a court, it is agreed that the remainder of this release shall continue in full legal force and effect notwithstanding the invalidity of any portion of it.

This release is given on behalf of myself, spouse, legal representatives, administrators, executors, heirs, and assigns and in the case of any child or children of mine, on behalf of them and their legal representatives, administrators, executors, heirs, and assigns. This release is an ongoing release and remains in effect until I have revoked it in writing.

I understand that this document is a contract and agree that if a lawsuit is filed against Linda Bruce, Robert Bruce, RLB Farms, L.L.C., Soulful Prairies, LLC, both jointly and severally; their animals, agents, employees, assistants, volunteers, independent contractors, co-sponsors, affiliates for any injury or damage in breach of this contract, I will pay all attorney’s fees and costs incurred to defend that lawsuit.

I hereby give my consent and permission for Soulful Prairies, LLC to take and use my picture, name and likeness for any lawful purpose, including but not limited to display on Soulful Prairies' website, advertising, marketing and press releases. Soulful Prairies, LLC is not requred to indentify me, contact me nor comepnsate me for this use.

I ACKNOWLEDGE AND AFFIRM THAT I HAVE CAREFULLY READ THE CONTENTS OF THIS RELEASE, FULLY UNDERSTAND ITS MEANING AND SIGN THIS RELEASE VOLUNTARILY.

I HAVE READ THIS DOCUMENT. I UNDERSTAND IT IS AN AGREEMENT AND PROMISE NOT TO SUE AND RELEASE AND INDEMNIFY AND HOLD HARMLESS FOR ALL CLAIMS. I ACKNOWLEDGE AND AFFIRM THAT I HAVE CAREFULLY READ THE CONTENTS OF THIS RELEASE, FULLY UNDERSTAND ITS MEANING AND SIGN THIS RELEASE VOLUNTARILY.
