Liability Waiver and Guest Responsibility Agreement

631 Beverly Street Unit 101  Elizabeth Colorado 80107  SGL-FUA-2026-11-01-v7

READ BEFORE ACCEPTING. This Agreement releases ordinary-negligence claims and creates personal payment obligations for Guest damage and covered claims. Section 11B can require a sponsor to reimburse adult Guest claims if the Guest lacks a Required Waiver for that booking, including Summit's own ordinary negligence, without a fixed dollar cap, subject to its exceptions. Each adult must personally accept before entry for each booking. The required Golf918 checkbox can sign this full Agreement as provided in Sections 13 and 15; a booking or door code alone does not clear other people.

1 Agreement Scope and Definitions

1.1 Parties and Facility. This Liability Waiver and Guest Responsibility Agreement (“Agreement”) is between Summit Golf Lab LLC (“Summit”) and the adult who signs it (“Participant”). Summit operates an indoor golf simulator and training facility at 631 Beverly Street, Unit 101, Elizabeth, Colorado 80107 (the “Facility”). In exchange for permission to enter, participate, and sponsor Guests, Participant agrees to these terms.

1.2 Scope and duration. This Agreement covers entry, presence, simulator golf, practice, putting, spectating, lounge use, fitness or warm-up activities, lessons, clinics, Guest visits, private events, and use of Facility equipment, amenities, access systems, and common areas. It applies only after signing. Summit requires fresh acceptance for each booking: a member signs at each Golf918 checkout, each adult Guest submits a new Required Waiver, and each child needs a new addendum authorization for that booking. An earlier booking's record does not provide current-booking clearance. Previously accepted agreements and obligations remain effective according to their terms for covered incidents; this repeat-acceptance requirement does not retroactively cancel them. Written revocation ends future authorized access until new acceptance. Material changes require new affirmative acceptance and do not retroactively change terms for an earlier incident.

1.3 Individual acceptance. Every adult age 18 or older, including members, Guests, spectators, instructors, and event attendees, must personally complete a Required Waiver for the applicable booking before entry. One adult cannot accept for another adult. A parent or another person legally authorized under Colorado law must complete a new Parent and Minor Participation Addendum authorization for each child under 18 for each booking. A family electronic submission may include multiple children only as provided in the addendum, with each child individually identified. An adult entering with a child must also personally accept the adult Agreement, even if only supervising or spectating.

1.4 Definitions. A "Guest" is an adult or minor Participant invites, brings, registers, authorizes, or knowingly admits under Participant's membership, pass, reservation, event, or access privileges, including family and nonplaying companions. Another person is not a Guest merely because both are present. A "Sponsoring Participant" is the member, pass holder, booking holder, event organizer, or other Participant who sponsors that Guest.

A "Required Waiver" is this Agreement, or another individual waiver Summit approves in writing, in a version Summit accepts, personally accepted for the applicable booking by the adult concerned through a handwritten signature or legally effective electronic assent. Summit authorizes its Golf918 acceptance process for the adult booking holder and Smartwaiver for Guests and child authorizations. The full Agreement must be presented or clearly identified and conspicuously linked before acceptance, which must expressly cover it. A required Golf918 checkbox may supply the adult booking holder's own signature under Sections 13 and 15. A general policy acknowledgment does not accept an undisclosed agreement or sign for a group. The retained evidence should identify the signer, accepted terms, signing date, and booking by reference or scheduled date and time. An omitted nonessential administrative field does not, by itself, cancel a release or payment promise validly accepted.

"Cleared" means that a specifically identified adult has completed a Required Waiver for the current booking, as confirmed by authorized Summit staff, Summit's authorized Golf918 or Smartwaiver process, or another system Summit designates in writing. Personally completing Golf918's required full-Agreement acceptance process may confirm that booking holder's own completion. For a Guest, accepted proof is an individual completion receipt, signed copy, or completed-status record from an authorized source matching the Guest, current booking, and accepted version, with a signing date or record identifier. For a child, it must identify the child and authorized signer under the addendum. Required email or identity verification must be complete. A prior booking's waiver does not provide clearance for a later booking. A pending notice, blank form, generic link, booking without that person's acceptance, payment, another person's waiver, door code, or unlocked door is not clearance. If identity, booking, source, completion, or version is unclear, contact Summit before admission.

2 Risks and Assumption of Risk

INDOOR GOLF AND UNATTENDED FACILITY USE INVOLVE RISKS OF SERIOUS BODILY INJURY, DISABILITY, DEATH, AND PROPERTY DAMAGE. Risks include being struck by golf clubs, golf balls, ricochets, mis-hit shots, or flying objects; collisions with other people or objects; slipping, tripping, or falling, including on turf or flooring transitions; equipment malfunction or misuse; screens, enclosures, projectors, cables, electronics, and furniture; exercise or overexertion; preexisting health conditions; fire, electrical hazards, and power loss; acts or omissions of other users; and delayed discovery of injuries or delayed emergency response when staff are not present. These risks can arise during ordinary use, in restrooms or common areas, and during entry and exit.

Participant understands that risks may be known or unknown, inherent or otherwise, and may arise partly from the ORDINARY NEGLIGENCE of Summit or other Released Parties. Ordinary negligence means failure to use reasonable care. Participant must check the immediate area and equipment for obvious hazards before use, stop if unsafe, and report concerns. Participant voluntarily accepts these risks to the fullest extent Colorado law permits.

3 Release of Ordinary Negligence Claims

3.1 Release and agreement not to sue.

TO THE MAXIMUM EXTENT PERMITTED BY COLORADO LAW, PARTICIPANT, FOR PARTICIPANT AND PARTICIPANT’S HEIRS, ESTATE, SURVIVORS, PERSONAL REPRESENTATIVES, AND ASSIGNS, AND ANYONE ELSE CLAIMING THROUGH OR ON BEHALF OF PARTICIPANT, KNOWINGLY AND VOLUNTARILY RELEASES AND DISCHARGES SUMMIT GOLF LAB LLC AND ITS OWNERS, LLC MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, CONTRACTORS, SERVICE PROVIDERS, EQUIPMENT LESSORS, LANDLORDS, PROPERTY OWNERS, PROPERTY MANAGERS, AFFILIATES, SUCCESSORS, AND INSURERS, AND ANY INSTRUCTOR OR EVENT ORGANIZER AUTHORIZED IN WRITING BY SUMMIT WHILE ACTING WITHIN THAT AUTHORIZATION (“RELEASED PARTIES”), FROM CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY LOSS OR DAMAGE (INCLUDING LOSS OF OR DAMAGE TO PERSONAL BELONGINGS) ARISING FROM OR RELATING TO PARTICIPANT’S USE OF OR PRESENCE AT THE FACILITY, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE RELEASED PARTIES’ ORDINARY NEGLIGENCE. PARTICIPANT AGREES NOT TO SUE THE RELEASED PARTIES FOR SUCH RELEASED CLAIMS.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS CONDUCT, WILLFUL OR WANTON MISCONDUCT, INTENTIONAL WRONGDOING, OR CLAIMS THAT CANNOT LAWFULLY BE RELEASED, INCLUDING NONWAIVABLE STATUTORY OR REGULATORY DUTIES. IT APPLIES ONLY TO EVENTS OCCURRING AFTER PARTICIPANT SIGNS AND ONLY TO THE EXTENT ENFORCEABLE UNDER APPLICABLE LAW.

3.2 Costs of a released claim. If a final court determination establishes that a claim Participant brought is released by Section 3.1, Participant agrees to reimburse reasonable attorneys' fees and defense costs attributable to that released claim, only to the extent permitted by law. This does not apply to unreleased claims, a minor's own injury claim, or a claim derived from a minor's injury, and creates no payment obligation for a nonsigner who is not otherwise legally bound.

4 Health, Unstaffed Access, and Emergencies

4.1 Health and medical expenses. Participant must assess fitness to participate, obtain medical advice when needed, and stop if dizzy, injured, impaired, or otherwise unable to participate safely. Summit provides no medical screening or on-site medical supervision. Participant remains responsible for medical expenses except as required by law or separately agreed. This Agreement neither promises insurance benefits nor restricts benefits otherwise available under an applicable policy.

4.2 Unstaffed access. The Facility may operate 24 hours a day with no staff or intermittent staffing. Cameras, entry logs, and remote support do not mean someone is watching or able to respond immediately. Summit does not guarantee emergency response.

4.3 Emergencies. Call 911 first, give the Facility address, and then notify Summit when safe. Keep exits clear; do not prop doors or interfere with alarms, fire equipment, or other emergency equipment. Participant authorizes reasonably necessary emergency care and remains responsible for charges to the extent permitted by law.

5 Facility Rules and Safe Golf Conduct

Follow posted rules, booking and emergency instructions, staff directions, and manufacturer safety guidance. Only one person may swing or hit in a designated hitting area at a time; others must remain behind and outside the swing zone. Check that the bay and surroundings are clear before every swing. Never hit toward a person, outside an approved hitting area, or while someone retrieves balls.

No horseplay, throwing clubs, intentional damage, climbing structures, moving sensors or projectors, changing cabling, or unauthorized equipment repairs. Wear appropriate footwear. Keep food and drinks away from computers, launch monitors, touchscreens, and hitting surfaces. Animals are not permitted except service animals as required by law. Stop using, and promptly report, damaged equipment, unsafe conditions, incidents, and injuries.

Children under 18 must remain under continuous, direct supervision of a parent or legally authorized signer age 18 or older, or an adult supervisor Summit specifically approves in writing for that child. The supervisor must remain present, within sight and close enough to intervene. No unattended or independent minor access is permitted. A signed minor addendum alone does not approve a different supervisor.

6 Access and Responsibility for Guests

6.1 Access and reservations. A booking holder must personally complete a Required Waiver for each booking and may do so at Golf918 checkout under Sections 1.4, 13, and 15. A booking, payment, membership purchase, or access code does not by itself establish another person's acceptance. Each adult needs a Required Waiver and each child under 18 needs the required addendum for that booking before entry. Summit may verify completion before activating or continuing access. Memberships and Flex Passes are personal privileges subject to separately accepted purchase terms. Do not share accounts or access credentials, prop doors, or admit unauthorized visitors. A regular booking allows the booking holder plus a maximum of three Guests, counting all children and nonplaying companions. A different private-event arrangement requires Summit's written approval and compliance with applicable occupancy limits. Published purchase terms otherwise govern Guest fees and booking limits.

6.2 Guest completion, confirmation, and supervision. The Sponsoring Participant is responsible for ensuring that every adult Guest personally submits a new Required Waiver and every child has a new authorized addendum submission for each booking before entry. The Smartwaiver submission must identify the Guest or child, host member, and booking reference or scheduled date and time. No separate Guest list in Golf918 booking Notes is required; Notes are optional and do not replace acceptance. Before admission, the sponsor must check genuine, named completion confirmation matching each Guest or child, the current booking, and accepted version under Section 1.4. A verbal assurance or pending-verification notice is insufficient. Provide the confirmation or record identifier to Summit when requested. Explain the rules, remain personally present while Guests are inside, and take reasonable steps to ensure safe conduct. A different arrangement requires Summit's written approval. Follow Section 5 and the addendum for minor supervision; signing alone does not approve an alternate supervisor. An uncleared Guest must remain outside. If already inside, stop participation and complete clearance or leave safely. Contact Summit if completion or identity is unclear. Ordinary, properly cleared Guests do not require separate staff approval for each booking.

6.3 Signed and returning Guests. Every returning adult Guest must personally submit a new Required Waiver for each booking; each returning child needs a new authorized addendum submission for that booking. An earlier booking's receipt is not current-booking clearance. A Guest's own waiver applies only after personal acceptance, and previously accepted agreements remain effective according to their terms. At age 18, the person must personally accept the adult Agreement; a minor addendum is insufficient. The Sponsoring Participant's obligations under Sections 9 and 11A continue even when the Guest signs or separately pays.

6.4 When an adult Guest lacks the current booking waiver. Section 11B separately allocates covered claim costs to the Sponsoring Participant if an incident occurs before the adult Guest completes a Required Waiver for that booking, even if the Guest signed for an earlier booking. That promise expressly includes Summit's own ordinary negligence, subject to Section 11D and the reasonable-reliance exception in Section 11B. It does not authorize unsigned access. A sponsor's signature does not sign for another adult or release a nonsigning Guest's rights.

7 Lessons, Instructors, and Private Events

7.1 Authorized activities. This Agreement applies to authorized lessons, clinics, demonstrations, open houses, coaching, and private events. Paid instruction and organized events require Summit's written authorization. Event participation does not grant ongoing access.

7.2 Independent instructors. Before providing paid services, an independent instructor must have a written agreement with Summit and provide proof of liability insurance meeting Summit's written requirements, including any required additional-insured endorsement and indemnity. A certificate or this waiver does not itself create insurance coverage. Instructors may require additional waivers.

7.3 Event organizers. An organizer is a Sponsoring Participant for event Guests and must use Summit's registration and confirmation process for each adult and each minor. A group booking, attendee list, organizer signature, or event payment does not replace individual adult acceptance and properly authorized minor addenda. Summit may require a separate event agreement, deposit, insurance, and vendor conditions. Separate event terms govern fees and logistics; this Agreement governs participation risks and Guest responsibilities, subject to Section 14.2.

8 Alcohol, Impairment, and Prohibited Conduct

No alcohol is permitted during ordinary member, Flex Pass, or other regular simulator sessions. This Agreement does not authorize alcohol at any event. A private-event exception exists only under a separate written event agreement and specific Summit approval after applicable legal, licensing, and insurance requirements have been satisfied. Until those conditions are met, alcohol remains prohibited, including BYOB. No one under 21 may consume alcohol. Approval does not itself establish legal compliance or insurance coverage, and Summit may stop alcohol-related activity or unsafe participation.

Smoking, vaping, cannabis use, illegal drugs, and unsafe, harassing, unlawful, or disruptive conduct are prohibited. Do not participate while impaired by alcohol, cannabis, medication, or another substance. Arrange safe transportation. Firearms and other weapons are prohibited except on-duty law enforcement or as required by law. Summit may end unsafe participation.

9 Property Damage and Personal Belongings

9.1 Personal responsibility. Participant is responsible for property damage Participant causes. As a separate personal contractual promise, a Sponsoring Participant also agrees to reimburse Summit for damage a Guest causes, including accidental damage, negligence, misuse, rule violations, and intentional damage, to the extent permitted by law. This applies even if the sponsor did not cause the damage, the Guest never signed, or the Guest fails to pay. Summit need not first collect from the Guest. Responsibility for a minor's conduct remains subject to law.

9.2 Covered amounts. Reimbursement is limited to reasonable, documented repair costs or, when repair is unreasonable, comparable replacement accounting for age and condition; reasonable cleanup and restoration; and documented direct net loss of income during a reasonable repair period. Normal wear, preexisting damage, and damage attributable to a Released Party's own negligence or other fault are excluded. No fixed dollar cap is created by this Agreement.

9.3 Normal wear versus damage. Ball impact on the designated impact screen, hitting mats, nets, and turf during proper use is normal wear. Damage is not normal wear when it is caused by a ball or club striking projectors, sensors, enclosure frames, walls, lighting, ceilings, or other equipment outside the designated impact area; club strikes to screens or equipment; thrown clubs; forced or unauthorized adjustment; liquids on electronics; or other misuse.

9.4 Invoices and payment authorization. Summit will provide an itemized invoice with supporting documentation and will not recover twice for the same loss. Undisputed amounts are due within 30 days after receipt. Participant may raise a good-faith dispute in writing; disputed responsibility or amounts require written agreement or a final court determination. This Agreement, a general booking or membership disclaimer, and the mere storage of a card do not authorize automatic damage or policy-violation charges. Any damage charge to a stored card requires a separate, specific written authorization, advance itemized notice, an opportunity to dispute, and compliance with law and payment terms. Properly disclosed recurring membership charges and fixed booking or cancellation fees remain governed by separately accepted purchase terms. Section 11 claim costs, settlements, and legal fees may not be automatically charged to a stored card.

9.5 Personal belongings. Personal belongings are brought at the owner’s risk. Summit is not a bailee or insurer of unattended property. The release in Section 3 applies to loss of or damage to belongings caused by ordinary negligence to the same extent as other property loss.

10 Security Monitoring and Privacy

Summit may use disclosed security cameras in lawful public/common areas and retain entry logs, booking history, incident reports, and waiver records for safety, security, operations, and claims. No restroom recording or unlawful recording is authorized. Audio recording or processing of biometric identifiers requires any separate notice and consent applicable law requires; this Agreement supplies no blanket consent. Monitoring is not continuous live supervision. Personal information is handled under applicable law and Summit's posted Privacy Policy. Promotional use of a likeness requires separate consent.

11 Indemnification and Unsigned Adult Guests

11A Participant and Guest conduct. To the extent Colorado law permits, Participant personally agrees to indemnify and hold harmless the Released Parties against third-party bodily-injury, death, and property-damage claims, but only to the extent caused by Participant's or a Guest's negligence, recklessness, intentional or unlawful conduct, rule violations, or Participant's breach of Section 6.2. This applies whether or not the Guest signed. It does not cover a Released Party's own negligence; the separate promise in Section 11B addresses unsigned adult Guest claims.

11B Separate personal promise for an adult Guest without the required booking waiver. If an incident occurs before a sponsored Guest age 18 or older personally completes a Required Waiver for the applicable booking, including a returning Guest who signed for an earlier booking, and the Guest or someone claiming from that Guest's injury, death, or property loss asserts a claim against a Released Party concerning the Facility presence or activities in Section 1, the Sponsoring Participant personally agrees to reimburse the covered amounts in Section 11C. This payment promise is given in exchange for the privilege to sponsor Guests. It applies even if the sponsor did not cause the incident, was not present, or did not know the current booking waiver was missing. It does not depend on proof that a hypothetical signed waiver would have defeated the claim. The reasonable-reliance exception below and Section 11D apply.

SECTION 11B EXPRESSLY INCLUDES COVERED CLAIMS AND LOSSES CAUSED IN WHOLE OR IN PART BY A RELEASED PARTY'S ORDINARY NEGLIGENCE, INCLUDING SUMMIT'S OWN ORDINARY NEGLIGENCE. THE SPONSOR ACCEPTS THIS PERSONAL PAYMENT OBLIGATION EVEN WITHOUT PERSONAL FAULT. THERE IS NO FIXED DOLLAR CAP IN THIS AGREEMENT. SECTION 11D EXCLUDES GROSS NEGLIGENCE AND OTHER PROHIBITED LIABILITY, AND THE CONFIRMATION EXCEPTION BELOW PROTECTS REASONABLE RELIANCE ON GENUINE GUEST-SPECIFIC CLEARANCE.

Reasonable-reliance exception. Section 11B does not apply if the sponsor reasonably relied before admission on guest-specific confirmation for the current booking satisfying Section 1.4, including an accepted Smartwaiver completion receipt, and neither knew it was incorrect nor caused an error by misrepresentation or bypassing the required process. A sponsor who follows that process is not responsible under Section 11B solely because Summit or its authorized system later discovers an administrative or technical error in that confirmation. A door code, reservation, staff presence, another booking's receipt, or confirmation for someone else does not qualify. Any other release of the Section 11B obligation must be expressly approved by Summit in writing for the identified Guest.

A Guest's own waiver governs covered incidents after that Guest signs according to its terms, including later in the same visit; Sections 9 and 11A continue to apply. Signing after an incident does not create a retroactive release or cancel Section 11B for that earlier incident. A prior waiver does not supply current-booking clearance or eliminate Section 11B merely because it was signed for an earlier booking. Summit need not first seek payment from the Guest. A nonsigning Guest may still assert a claim against Summit; this section concerns the sponsor's separate reimbursement obligation and does not prevent that claim or replace applicable insurance.

11C Covered amounts and insurance. Sections 11A and 11B cover eligible damages, judgments, reasonable settlements, and reasonable, documented attorneys' fees, court costs, investigation expenses, and defense costs, including eligible defense expenses when a claim is dismissed. Section 11A covers only the portion attributable to Participant/Guest conduct; Section 11B also covers the Released Parties' ordinary-negligence share. No loss may be recovered twice. Insurance payments and recoveries must be accounted for without impairing an insurer's lawful recovery rights. These promises survive the end of membership/access for incidents after Participant signs.

11D Exclusions and preserved rights. No indemnity applies to a Released Party's gross negligence, recklessness, willful or wanton misconduct, intentional wrongdoing, or liability Colorado law prohibits shifting, including statutory or regulatory liability to that extent. A Released Party's ordinary negligence is covered only as expressly stated in Section 11B. No parent or sponsor must reimburse liability or defense costs for a sponsored minor's own injury claim or a claim derived from it. Section 11B applies only to adults. No term releases a nonsigner's rights or transfers legal duties owed to an injured person.

11E Claim handling. Summit must give reasonably prompt written notice and supporting information and allow a reasonable opportunity to participate through counsel or an insurer. A settlement for which reimbursement is sought must be reasonable and made in good faith. Participant need not take over the defense and has no right under this Agreement to control or veto an insurer's defense or settlement. Applicable insurer rights must be preserved; nothing changes a policy, promises coverage, or authorizes Summit to disregard policy conditions. Disputed reimbursement requires written agreement or a final court determination. No automatic card charges are authorized.

11F Separate promises and acceptance. The release in Section 3 and payment promises in Sections 9, 11A, and 11B are separate and independently subject to law and severability. Participant's signature or affirmative electronic acceptance under Sections 13 and 15 accepts all those promises and the Section 15 acknowledgments. This Agreement does not require separate initials or an additional checkbox for Section 11B when the full Agreement is made available and the release and unsigned adult Guest payment obligation are prominently disclosed before acceptance. No general card-on-file authorization permits automatic collection of Section 11 claim costs.

12 Access Suspension and Purchase Terms

12.1 Access decisions. Summit may deny or suspend access, end a session, or require departure for safety risks, rule violations, nonpayment, unauthorized access, or misuse, subject to law and separate purchase terms.

12.2 Purchase terms and material changes. Separately accepted written terms govern membership fees, renewals, cancellations, Flex Pass expiration, Guest fees, booking limits, and event charges, subject to the specific refund provision in Section 12.3. Material changes to this Agreement require new affirmative acceptance before future access; operational rules may change prospectively with reasonable notice. Changes do not rewrite a previously signed version for an earlier incident.

12.3 Reviewing or declining the Agreement. Summit will make this Agreement available for review before purchase or booking. A person may decline to accept and not participate. Personally completing the required Golf918 full-Agreement acceptance process may sign this Agreement during booking. A booking made without that acceptance, including one made by staff or another person, remains subject to personal acceptance before entry. Before first using the Facility, a person who declines may cancel and receive a refund of amounts that person prepaid for unused membership time, passes, or bookings, less only nonrefundable fees clearly disclosed before purchase and lawfully retained. This specific pre-use refund right controls any conflicting general no-refund statement. Other refunds remain governed by purchase terms and applicable law.

13 Electronic Signatures and Records

Participant may sign by hand or electronically. When Summit presents the full Agreement, or clearly identifies and conspicuously links it, with express acceptance language, Participant may personally check the initially unchecked, required Golf918 box and complete checkout to sign the whole Agreement and Section 15 acknowledgments for that booking. This action is required each time the member books. No additional handwritten signature, separate initials, or extra Section 11B checkbox is required by this Agreement. Each adult must act personally using accurate identity information; staff or another person cannot supply that adult's assent. Retained evidence may include account and booking identifiers, completion date and time, exact terms and notice, and documentation of the mandatory acceptance process. A separately labeled acceptance event in booking history is not required by this Agreement. Summit may retain verification and audit information and provide a copy under law and the Privacy Policy. Each Guest must submit a new Smartwaiver for each booking. Each child needs a new individually identified authorization for each booking. A combined electronic family form may establish the signer's own adult acceptance and authorization for identified children when both capacities are explicit and the required child-specific and booking records are retained; it does not accept for another adult.

14 Governing Law and Agreement Terms

14.1 Governing law and venue. Colorado law governs this Agreement, without regard to conflict-of-laws rules. Any legal action must be filed in the state courts located in Elbert County, Colorado, or, if federal jurisdiction exists, the United States District Court for the District of Colorado, subject to mandatory venue and jurisdiction law.

14.2 Severability and complete agreement. Any unenforceable provision is limited or severed only as law permits, without eliminating nonwaivable rights. This Agreement is the complete agreement on participation risks, release, Guest responsibility, property damage, indemnity, and waiver confirmation. It controls conflicting summaries or disclaimers on those subjects, including damage-collection limits in Section 9.4 and the specific pre-use refund in Section 12.3. Separately accepted purchase terms and the Privacy Policy otherwise remain applicable. A separate specific payment authorization must comply with Section 9.4 and cannot authorize automatic Section 11 claim-cost charges. Participant does not rely on inconsistent oral statements. Delayed enforcement is not a waiver.

15 Acknowledgment and Adult Acceptance

BY SIGNING OR ELECTRONICALLY ACCEPTING, I ACKNOWLEDGE THAT I AM AT LEAST 18 YEARS OLD; HAVE READ THIS ENTIRE AGREEMENT; UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR INJURIES CAUSED BY ORDINARY NEGLIGENCE; HAVE HAD AN OPPORTUNITY TO ASK QUESTIONS; AND VOLUNTARILY AGREE WITHOUT COERCION. I UNDERSTAND THAT ACCEPTANCE IS A CONDITION OF PARTICIPATION AND THAT I MAY DECLINE TO PARTICIPATE INSTEAD.

Whenever I sponsor a Guest, I personally accept Sections 6, 9, and 11. I UNDERSTAND THAT SECTION 11B CAN REQUIRE ME TO PAY COVERED CLAIMS AND LEGAL COSTS IF AN ADULT GUEST LACKS A REQUIRED WAIVER FOR THIS BOOKING, EVEN IF THAT GUEST SIGNED FOR AN EARLIER BOOKING. THIS INCLUDES CLAIMS BASED ON SUMMIT'S OWN ORDINARY NEGLIGENCE, WITHOUT A FIXED DOLLAR CAP AND EVEN IF I AM NOT PERSONALLY AT FAULT OR DID NOT KNOW THE CURRENT SIGNATURE WAS MISSING. The reasonable-reliance exception and Section 11D apply. Each adult Guest must still sign individually. My signature does not waive another adult's rights or authorize automatic damage or claim-cost charges to a stored card.

My one signature or required electronic acceptance covers this entire Agreement, including assumption of risk, the ordinary-negligence release, Guest damage responsibility, indemnification, and the unsigned adult Guest payment obligation disclosed above. Separate initials are not required.

Golf918 acceptance: each time I personally check Summit's required acceptance box and complete checkout after the full Agreement and acceptance notice are made available, I intend to sign this Agreement electronically for myself for that booking. This does not sign for another adult or complete a minor's addendum.

Parent and Minor Participation Addendum

One individual record per child  SGL-MINOR-2026-11-04-v11

Summit Golf Lab LLC  631 Beverly Street Unit 101  Elizabeth Colorado 80107

Read this addendum and the adult Agreement, SGL-FUA-2026-11-04-v11. A NEW authorization is required for EACH booking. Paper: one copy per child. A family electronic form may cover multiple children if each named child (the "Minor") has a retained birth date, authorized signer, acceptance, and current-booking record with the full terms. One signature may establish the signer's adult acceptance and child authorizations only when both capacities are explicit. Signing solely for a child is not personal adult acceptance. No one accepts for another adult. A Golf918 checkbox alone does not complete this addendum.

Authority, Participation, and Supervision

For each Minor, I am a parent, court-appointed guardian, or other person authorized under C.R.S. section 13-22-107, will provide proof if requested, and know of no restriction on my authority. Hosting or supervising alone does not authorize signing. I permit the Section 1 activities after signing, subject to restrictions. A completed child record is required before entry. No independent access or drop-offs are permitted.

Club swings, flying or ricocheting balls, collisions, falls, equipment misuse or failure, overexertion, electrical hazards, others' acts, and delayed unstaffed emergency response can cause serious injury, disability, death, or property damage, including through Released Parties' ordinary negligence. My decision is voluntary and informed. I will supervise personally or arrange an adult age 18 or older Summit approves in writing for this child before visiting. The supervisor must accept the adult Agreement, stay within sight and close enough to intervene, enforce rules, and keep the child outside others' swing zones. Parent permission or a waiver alone does not approve another supervisor.

Parental Release of Ordinary Negligence Claims

TO THE EXTENT C.R.S. SECTION 13-22-107 PERMITS, I KNOWINGLY AND VOLUNTARILY RELEASE THE NAMED MINOR'S PROSPECTIVE PERSONAL-INJURY, DEATH, AND PROPERTY-DAMAGE CLAIMS AGAINST THE RELEASED PARTIES ARISING FROM THE MINOR'S FACILITY PRESENCE OR PARTICIPATION, INCLUDING THEIR ORDINARY NEGLIGENCE. FOR MYSELF, I ALSO RELEASE MY OWN CLAIMS ARISING FROM THAT PARTICIPATION, INCLUDING MEDICAL-EXPENSE CLAIMS, TO THE EXTENT PERMITTED BY LAW. THESE RELEASES EXCLUDE GROSS NEGLIGENCE, RECKLESSNESS, WILLFUL OR WANTON CONDUCT, INTENTIONAL WRONGDOING, NONWAIVABLE STATUTORY OR REGULATORY DUTIES, AND OTHER NONWAIVABLE CLAIMS.

No parent or sponsor must reimburse this Minor's injury claims or related defense costs, including claims derived from that injury. Section 11B covers adults only; Section 9 and law govern property damage. I authorize necessary emergency care if unreachable and remain responsible for lawful charges. This authorization permits only the identified booking after signing. Each later booking requires a new authorization; prior records do not provide current-booking clearance. Earlier accepted agreements remain effective according to their terms for covered incidents. Written revocation ends future authorized access. At 18, the participant must personally accept the adult Agreement before further entry.

By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
