WAIVER OF LIABILITY AND PERMISSION FORM

 

 

I understand that I, and if applicable my child, will be participating in activities with the Agua Hedionda Lagoon Foundation (AHLF) in conjunction with the Carlsbad Strawberry Company (CSC). The AHLF is a California public benefit corporation and that in the course of such activities me and my child may have direct contact with the outdoors and trail terrain, as well as loud noises and lighting displays in addition to guests from the public coming through the maze. I further understand that while precautions and systems (see Safety Protocol 200 HCM Document for details) are taken to ensure participant safety, outdoor terrain, technology and guests are unpredictable. In consideration for the participation by my child in such activities, I hereby WAIVE, RELEASE, AND DISCHARGE from any and all liability (including but not limited to, liability arising from the negligence or willful misconduct of the entities or persons released) AHLF, the Carlsbad Strawberry Company, the City of Carlsbad and/or its directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers.

 

In the event that my or my child is injured, I hereby give the AHLF and CSC the authority to seek emergency medical treatment for me and my child and intend that the foregoing release shall apply to any cause of action that arises in the course of such treatment. I hereby represent and warrant (i) that I am the parent or legal guardian of the child named below; (ii) that my child has no medical or other condition that would prevent my child from participation in activities at the AHLF; and (iii) that I have fully read and understood this release.

 

In consideration for my participation in activities organized by Agua Hedionda Lagoon Foundation and the Carlsbad Strawberry Company, I irrevocably grant to AHLF and the CSC the right to photograph me and to distribute, transmit, publish, copy, or otherwise exploit, either in whole or in part, either digitally or in any other medium now known or later discovered, any images in which I appear (“the Photographs” or “Video”). I understand and agree that the photographs and video may be used and exploited without identifying me as their subject.
