Policies, Student Agreement and Release of Liability Waiver

PREAMBLE 

This agreement is between the undersigned (“The Student”) and MARIN RANCH SCHOOL, JESSICA PINTO, LMFT, CEIP-MH and STEPHANIE HOLDENRIED, CEIP-ED (“Ranch School”), an education program that provides equine supported experiential learning emphasizing life skills via ranch skills as well as “how to” trainings in the same model to equine facilitators, rooted in the core values of reciprocal equine-human partnership, contributing to a community, and putting the joy back into learning.  The Student agrees to abide by all Ranch School policies, procedures, and guidelines as included in this most current revision of the Student Agreement, which are subject to change, and to accept and assume any and all risks associated with entering this agreement. 


Intellectual Property and Copyright 

Jessica Pinto, Stephanie Holdenried, and Marin Ranch School and its agents and representatives are the exclusive owners of all materials created for use in this training, including but not limited to curriculums, marketing material, documents and forms, and all printed, audio, video, digital, online, and other materials (“Materials”). These Materials also include all duplicates, reproductions, and derivatives of the Materials. Ranch School retains all rights to all intellectual property developed by Jessica Pinto and Stephanie Holdenried and utilized in the training. No Materials or any portion thereof are sold or otherwise transferred except by the purchase of the Materials and/or training package, which shall be for the sole use of the purchaser. No one will disclose, duplicate, reproduce, publish, or distribute to any third party any intellectual property belonging to Jessica Pinto, Stephanie Holdenried, and Ranch School and its agents or representatives without prior written permission. No one will share any of the aforementioned intellectual property publicly or on the internet (such as a website, social media, or other file sharing service).


Privacy Policy 


Ranch School and its agents and representatives are committed to protecting your personal information and your right to privacy. During your involvement in the Ranch School training program, you trust us with your personal information. Some of this information is required as part of the registration process, while some of this information may be disclosed by students during or after the program. Information that is collected as part of the registration process helps us to process payments and registration, administer the program, track the demographics of our students, attend to student needs from an inclusion and accessibility standpoint, and to identify potential geographic areas for future in person trainings. We do not sell your information to third parties. 


All team members and students will respect confidentiality and privacy. Many team members and students are also part of a profession that requires them to abide by specific legislation and standards of practice around privacy and confidentiality, and are therefore mindful about the use of discretion related to personal information.


Choice and Consent 

Ranch School and its agents and representatives shall not be held liable or responsible for any injury or damage from a student’s participation or involvement in any aspect of the training program.


Ranch School is an experiential learning program and may incorporate experiential learning into trainings. Students are responsible for managing their own safety, voicing their needs, and may opt to “pass” at any point on any individual or group activity or demonstration that they are not comfortable with or feel is beyond their capacity. Alternatively, discomfort with an experiential component may be a clue that the student is experiencing a need that may not yet have been voiced that, if addressed, would allow them to participate. Those who agree to participate in a demonstration or during practice rounds do so voluntarily and at their own risk. 


Representation 


Students, training providers and other representatives agree to appear and act in a professional manner at all times while participating at Ranch School events.

The Ranch School training is solely intended to provide the participant an immersive experience in the program materials developed by Ranch School and the guidance necessary for the participant to apply the training and the Materials to similar activities. Completing a Ranch School training does not allow anyone to provide training in the Ranch School model to other professionals (it is not a train the trainer program), or to use Ranch School training Materials in developing their own professional development training program or course, as this would constitute both trademark and copyright infringement. If someone has created and delivers their own professional training program that is separate from Ranch School, they will ensure that the distinctions between it and Ranch School are clear to reduce confusion. Such programs will not be promoted as being affiliated with Ranch School other than indicating their training in the Ranch School model and materials in their biography data.


Scope of Practice

Individuals involved with the Ranch School program in any capacity will abide by common professional standards around how they represent or advertise their professional services. This includes being truthful, accurate, and clear in their description of their services and areas of expertise. They will not make deceptive statements about their training, credentials, licensing, professional memberships, services, fees, success rates, education, experience, affiliations, publications, media presentations, and other descriptions pertaining to themselves and their practices.


Ranch School students and approved providers will at all times be fully paid and up-to-date members of a professional association maintaining an industry- standard code of ethics and/or standards of practice (such as the Certified Board of Equine Interaction Professionals, CBEIP or the Professional Association of Therapeutic Horsemanship, PATH International) AND/OR will at all times maintain a fully paid and up-to-date professional license/registration with an applicable licensing or regulatory body and they will abide by industry standards pertaining to their status as a student within their intended profession. If someone’s profession is newer and has yet to create a professional association or regulatory/licensing body (or is offering services that do not fall neatly under one clear scope of practice), they will research relevant ethics and standards that apply to similar professions and abide by these to the best of their ability.  

Ranch School students and approved providers are responsible for ensuring that they have adequate professional and equine liability insurance to cover the inclusion of the Ranch School model and participation with the program within their scope of practice. Attending a Ranch School training does not ensure that all methods, principles or techniques taught within the program will be appropriate for inclusion in someone’s professional practice. Ranch School trainings alone will not qualify anyone to be an equine professional. Students are responsible for operating within their professional scope of practice and for abiding by provincial/state and federal laws and any applicable legislation.


Equine Experience 


Individuals involved with the Ranch School program in any capacity will accurately represent and advertise their experience with horses. All Ranch School “how to” training students are required to have prior experience with horses and possess at minimum intermediate horse handling skills, as define below, or must be working in agreed partnership with an experienced, competent horse professional(s) with intermediate horse handling skills, in order to implement the Ranch School program. While Marin Ranch School teaches life skills via ranch skills, the “How to” Ranch School training for equine professionals does not teach horsemanship skills for novice horse people. It is a professional training for equine facilitators to implement a new program in equine supported learning and/or for experienced horse people to enter the field of equine facilitation. The hours accrued in any Ranch School training can be counted towards equine facilitator certification experience such as the CEIP.  

Intermediate horse person: 

  • Able to catch, halter, saddle and mount/dismount horse independently. 
  • Able to control and calm a horse who has gone over threshold from the ground and the saddle. 
  • Is confident and in control on a moving horse at a walk, trot, and canter inside an arena. 
  • Has experience riding on trails and outside of an arena.
  • Comfortable and competent using aids to communicate with your horse. 
  • Is able to post or sit a trot and have an independent seat while trotting and cantering (doesn't hold onto the saddle). 
  • Has a plan on how to manage a bolting horse.
  • Possesses a solid understanding of horse behavior, equine communication (including calming and stress signals) and herd dynamics.


Recognition 

Ranch School and its agents or representatives make no promises or guarantees as to the recognition, regulation, or accreditation of the Ranch School training certificate or any such designation.


Payment and Refund Policy 

Ranch School trainings will be paid in full on or before the date of training and there will be no refunds for missing trainings, regardless of circumstances. Ranch School and its agents and representatives are not liable or responsible for any lost wages or fees (including but not limited to travel and accommodation) incurred as a result of having to reserve time to support any Ranch School event or activity should they be cancelled. We apologize for any inconvenience and appreciate your understanding when circumstances are beyond our control.


Audiovisual and Social Media Policy 


Ranch School maintains the irrevocable and unrestricted right to utilize photographs and video taken during trainings for marketing and development purposes. These photos and videos may be used for further promoting the training program which may include, but is not limited to, electronic publication (e.g. website, web-based marketing, email marketing campaigns), promotional use or advertising (e.g. brochures, fliers, promotional video or slideshow), webinars and presentations at professional meetings, trainings, and workshops, both in person or online, as well as other forms of marketing and program development.

The student acknowledges that they have no interest, ownership or copyright rights in any pictures, video or media thereof produced by Ranch School and waives their right to any and all compensation stemming from the use of these materials. 

We do not tag anyone in photos or videos on social media without prior consent, and the tagging we do usually only pertains to team members. We do not tag students in images or videos, and leave that to the individual student to decide. 


Liability Release 

This Release, Assumption of Risk and Indemnification Agreement ("Release") is entered into by the undersigned (the “Student”) as a condition of participation in training and educational/professional development by MARIN RANCH SCHOOL, JESSICA PINTO, LMFT, CEIP, and STEPHANIE HOLDENRIED, CEIP that such activities may be provided on property controlled by OCEAN RIDERS OF MARIN, DBA THE GOLDEN GATE DAIRY STABLES, all hereinafter the RELEASED PARTIES. The Student acknowledges that they have requested to participate in the offered activities and that the conditions of treatment have been explained to satisfaction.


I agree as follows:

1. ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS. I understand that outdoor activities such as being in nature, and equestrian activities such as riding and being around horses are inherently dangerous activities and I am voluntarily participating in such activities, and being around such activities, with full knowledge of the dangers involved, including but not limited to fractures, bruises, strains, other injuries such as exposure to poison plants, insect bites or stings and I further acknowledge that I am specifically aware that horses are powerful, easily frightened, unpredictable animals. All horses, even those that are well-trained and appear gentle, may buck, rear, stop short, change direction or speed at will, shy, spook, kick, strike, bite, and bolt-all without warning and without apparent cause or in response to wind, sounds, movement of people, cars, bikes, or other animals, or inanimate objects. The inherent risks include: loss of control; falling or being thrown off; being stepped on; collisions with fences, gates, trees, horses or other obstacles; or being hung up or entangled in stirrups, reins or other gear; and unknown or unanticipated risks not specifically identified here. I may encounter dangers due to terrain, creeks, rivers, water, waves, weather, thunder, lightning, rocks, cliffs, obstacles man-made and natural, traffic, bees and insects, wild and domestic animals, as well as allergic reactions to dust, insects, animals or vegetation. I understand that serious, permanent bodily injury, disability or death of myself or others may result from handling, riding or being in the vicinity of horses, and that property belonging to me or others may be damaged as well.

I hereby agree to accept and assume any and all risks of injury, disability, illness, disease or death to myself, including financial losses (including loss of earning capacity) and damage or destruction of property owned by me or in my care, resulting from any outdoor activities or the handling, riding or being in the vicinity of horses in connection with any activities conducted by MARIN RANCH SCHOOL, including risks caused by the misconduct of MARIN RANCH SCHOOL or OCEAN RIDERS OF MARIN or its associates.


2. RELEASE OF LIABILITY. INCLUDING LIABILITY FOR NEGLIGENCE. On behalf of myself, my family, heirs, estate, distributees, guardians, legal representatives and assigns, I hereby release the released parties and each of them from all claims, demands, causes of action and liabilities based on any injury, disability, illness, disease, death, financial loss, property loss or damage, or other harm suffered by me, or by any third person for which I may be held responsible, that may result from my participation in any outdoor activities or being in the vicinity of or participation in horse-related activities conducted by MARIN RANCH SCHOOL and the RELEASED PARTIES 

whether caused by the negligence or misconduct of the released parties or otherwise; provided that nothing in this Section 2 shall be deemed to release any Released Party from liability arising from their willful injury to me or any other person or any property, or their gross negligence.


3. INDEMNIFICATION. I AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS EACH OF THE RELEASED PARTIES from and against any and all claims for injury or death resulting from participation in horse or outdoor related activities conducted by MARIN RANCH SCHOOL 


prosecuted for the benefit of myself or my family, estate, heirs, representatives or assigns. The indemnification provided by this Section 3 shall include all costs and expenses incurred by any and all Released Parties in defending against said claims, including all actual attorney fees.

I further agree to indemnify, defend and hold harmless each of the released parties from and against any claim for injury or death of any person whom I bring or invite to the Golden Gate Dairy Stables and MARIN RANCH SCHOOL activities or otherwise permit to being in the vicinity of horses or other outdoor related activities in which I am participating, WHETHER SUCH INJURY OR DEATH WAS CAUSED BY THE NEGLIGENCE OR MISCONDUCT OF THE RELEASED PARTIES.


4. CALIFORNIA LAW GOVERNS. ANY CLAIM MUST BE BROUGHT IN MARIN COUNTY. This contract is governed by California law. Any claim against the Released Parties for injury, disability, illness, disease or death arising out of horse-related activities covered by this Release is governed by California law and must be brought in Marin County, California, even if the injury occurred outside Marin County.


5. AGREEMENT TO PAY FOR EMERGENCY MEDICAL TREATMENT. I AGREE that should an emergency medical treatment be required, I and/or my own accident/medical insurance company SHALL PAY FOR ALL SUCH INCURRED EXPENSES.


6. SEVERABILITY. If any provision of this Release is held to be unenforceable, such provision shall be excluded and the balance of the Release shall be enforced in accordance with the remaining terms.


7. LEGALLY BINDING. I have read this Release and understand that I am giving up legal rights. I have executed it knowingly and voluntarily without relying on any statement or representation of any Released Party. I understand that it is a binding legal document.
