Terms and Conditions: 1. Rental Period: - The rental period begins on the date and time the equipment and decorations are picked up or delivered and ends when they are returned to Stardust Carnivals at 2615 Trinity Street Vancouver BC V5K1E5.
2. Condition of Equipment and Decorations: - All equipment and decorations are rented in good working condition and have been sanitized. The client is responsible for inspecting the items upon receipt and notifying Stardust Carnivals of any defects or issues upon receipt.
3. Use of Equipment and Decorations: - The client agrees to use the rented items solely for their intended purpose and in a safe and responsible manner. Any misuse, alteration, or damage to the equipment and decorations will be the client’s responsibility.
- Please transport slushie machines upright or ensure the machine sits upright at destination for 12 hours before use to allow the oil to settled into the proper spaces.
4. Return of Equipment and Decorations: - All rented items must be returned in the same condition as they were received, excluding normal wear and tear. Any damages or missing items will incur additional charges.
5. Operation of Food Machines: - The client must provide the name and birth month and year of the person who will operate any food machines. This person must be over 19 years of age.
- The machine must be plugged into a safe GFCI grounded outlet on a dedicated breaker.
- The designated operator must ensure that no children are allowed to touch or operate the food machines.
- When alcohol is used in the slushie machines the operator is responsible to ensure no slushie is provided to persons under 19 years of age. The slushie machines have do not have a lock out function.
- The client acknowledges that operating food machines involves inherent risks, including but not limited to injury, burns, and equipment malfunction. The designated operator accepts all risks associated with the operation of the food machines.
- To prevent overheating, it’s important to place slushie machines in a shaded or cool area, away from direct sunlight and other heat sources like BBQ's or firepits.
- The Client acknowledges that the machines are heavy and may weigh up to 180 pounds. The Client is advised to exercise caution and use multiple persons when lifting or carrying the machines. Stardust shall not be liable for any personal injury resulting from the lifting, carrying, or dropping of the machines
6. Assumption of Risk: - The client acknowledges that the use of rented equipment and decorations involves inherent risks, including but not limited to injury, damage, or loss. The client voluntarily assumes all risks associated with the use of the rented items.
- Stardust Carnivals is not responsible for communicable diseases or foodborne illness as a result of the use of the rented equipment.
- Stardust Carnivals is not responsible for water leakage of the equipment or any bodily harm caused by the operation of the equipment.
- Notice: For safety reasons, slushie machines must not be placed near open flames or any fire sources. Smoking and vaping are strictly prohibited in the vicinity of these machines, as the cooling mechanism contains flammable substances. Failure to comply with these regulations may result in serious injury, damage or death."
7. Indemnification: - The client agrees to indemnify, defend, and hold harmless Stardust Carnivals, its owners, employees, and agents from any and all claims, liabilities, damages, and expenses, including attorney fees, arising from the client's use, possession, or operation of the rented equipment and decorations.
8. GPS Tracking and Privacy: - The undersigned client acknowledges and agrees that the food service machines provided are equipped with GPS tracking technology designed to notify smart devices of the machines' proximity. The client further understands that the removal or tampering with the GPS tracking equipment will render the machines inoperable. By accepting these terms, the client expressly waives any right to privacy concerning the location data generated by the GPS tracking mechanisms installed in the machines.
9. Release of Liability: - The client releases Stardust Carnivals from any and all liability for any injury, loss, or damage that may occur during the rental period. This includes, but is not limited to, personal injury, property damage, and any consequential damages.
10. Governing Law: - This agreement shall be governed by and construed in accordance with the laws of the state in which Stardust Carnivals operates.
Acknowledgment and Signature: I, the undersigned client, have read and understood the terms and conditions of this rental agreement and liability waiver. I agree to abide by these terms and conditions and acknowledge that I am voluntarily waiving certain legal rights by signing this document.
