TERMS AND CONDITIONS1. Rental Period
The rental period begins when the equipment and decorations are picked up by the client or delivered by Stardust Carnivals and ends when they are returned to Stardust Carnivals at 2615 Trinity Street, Vancouver, BC V5K1E5 in the agreed condition. 2. Condition of Equipment and Decorations
All rented items are provided in good working condition and sanitized prior to rental. The client must inspect the equipment upon receipt and immediately notify Stardust Carnivals in writing of any defects or concerns. Failure to report an issue upon receipt constitutes acceptance of the equipment in its delivered condition. 3. Use of Equipment and Decorations
The client agrees to use the rented items only for their intended purpose and in a safe, responsible manner. Misuse, modification, or improper use is strictly prohibited. Stardust Carnivals is not liable for injury, damage, loss, or harm, including but not limited to: - Fire
- Electrical shock
- Equipment malfunction
- Property damage resulting from the use or misuse of the rented items
The renter assumes all risks and responsibilities for proper installation, operation, and safety compliance. The renter agrees to indemnify and hold Stardust Carnivals harmless from any claims, damages, or expenses arising from such incidents. ⚠ Slushie Machine Handling: - Machines must be transported upright. If transported at an angle, the machine must remain upright at its destination for 12 hours before use.
4. Return of Equipment and Decorations
All rented items must be returned in the same condition as received, excluding normal wear and tear. - Definition of normal wear and tear: Minor surface scratches, scuffs, and cosmetic marks that do not impact functionality.
- Damage beyond normal wear and tear: Any alteration, breakage, or loss that affects the function, safety, or appearance of the rented items.
- The client agrees to pay for repair or replacement of damaged or missing items.
5. Operation of Food & Drink Machines - The operator must be 19+ years old and provide their name and birth month/year before operating food machines.
- Machines must be plugged into a GFCI-grounded outlet on a dedicated breaker.
- No children may touch or operate the machines.
⚠ Alcohol Warning: - If alcohol is used in the slushie machine, the client is fully responsible for preventing service to persons under 19 years of age.
- The machines do not have a lockout function.
⚠ Safety Advisory: - Machines must not be placed near fire sources, BBQs, or direct sunlight to prevent overheating.
- Machines may weigh up to 180 lbs—multiple persons must lift with caution. Stardust Carnivals is not liable for injuries due to lifting, carrying, or dropping equipment.
6. Assumption of Risk
The client understands and voluntarily assumes all risks associated with rented items, including but not limited to: - Fire hazards
- Water damage
- Personal injury
- Electrical malfunction
- Foodborne illness
⚠ Fire & Flammable Substances:
Smoking and vaping are strictly prohibited near slushie machines. The cooling system contains flammable substances, and failure to comply may result in serious injury or death. 7. Indemnification
The client agrees to indemnify, defend, and hold harmless Stardust Carnivals, its owners, employees, and agents against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising from the use, possession, transportation, or operation of rented equipment. 8. GPS Tracking & Privacy
The client acknowledges that certain food service machines are equipped with GPS tracking technology for security and operational purposes. By signing, the client: - Consents to the collection of location data for tracking purposes.
- Acknowledges that tampering with GPS tracking will render machines inoperable.
- Understands that GPS data is used solely for theft prevention and operational efficiency and will not be shared except as required by law.
9. Responsibility for Damage or Loss
The client assumes full responsibility for any damage, loss, or theft of rented equipment, excluding normal wear and tear. In the event of damage or loss, the client agrees to pay for repairs or replacement as determined by Stardust Carnivals. 10. Release of Liability
The client releases and discharges Stardust Carnivals from any liability for injury, property damage, loss, or consequential damages that may arise during the rental period. 11. Governing Law & Severability
This agreement shall be governed by the laws of British Columbia, Canada. If any provision of this contract is found to be invalid or unenforceable, the remainder shall remain in full force and effect.
