RELEASE, PERMISSION, AND INDEMNITY AGREEMENT

NOTICE TO THE MINOR CHILD’S

NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF TAMPA BAY PICKLEBALL USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM TAMPA BAY PICKLEBALL IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND TAMPA BAY PICKLEBALL HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

In consideration of being permitted to participate in any Pickleball event, game, league, tournament, or clinic taking place at Tampa Bay Pickleball LLC] located at the Oldsmar Flea Market 180 Racetrack Road, Building H, Oldsmar, Fl 34677 -- the Tampa Bay Pickleball facility.  

I, for myself, my heirs or assigns, hereby release, waive, discharge and covenant not to sue Tampa Bay Pickleball LLC as well as their officers, employees, and agents from liability from any and all claims resulting in personal injuries, death, accidents, illnesses (such as communicable diseases including COVID-19), and property loss arising from, but not limited to, participation in any Pickleball game, event, league, tournament or clinic.

Assumption of Risk. Participation in any Event, Pickleball game, Open Play, League, Tournament or Clinic carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary but include 1) minor injuries such as bruises, sprains and dehydration, 2) major injuries such as eye injuries, joint or back injuries, heat stroke, heart attacks, and concussions, and 3) catastrophic injuries such as paralysis and death.  I have read the previous paragraphs and I know, understand and appreciate these and other risks that are inherent in playing pickleball. I assert that my participation is voluntary and that I knowingly assume all such risks.

In addition to voluntarily assuming all risks inherent in the game of Pickleball listed above, I have taken the additional step of fully examining the facilities, familiarizing myself with the layout and all obstacles and obstructions. Tampa Bay Pickleball LLC is an indoor facility with inherent risks that come with playing indoors. These include walls, beams, air conditioning/HVAC units, fencing, barriers, bleachers, chairs, steps, players swinging paddles and hitting balls. I have personally walked the facility, made personal observations and have taken note of obstructions and impediments to play. I agree to remain ON the court during all games. I understand there are walls and obstacles such as beams, Air Conditioning Units and Barriers OFF to the sides of each court and behind each court. I agree to play in a self-controlled, prudent manner at all times. I agree to not play recklessly and out of control. I agree to be aware of my surroundings at all times. I agree not to recklessly chase balls off the edges of courts either behind me or to the sides of me. I am FULLY AWARE that doing so may result in a collision that can result in minor, major, or catastrophic injuries. 

I have read the previous paragraphs and I know, understand and appreciate these and other risks that are inherent in playing pickleball. I agree to play under control and not in a reckless manner and I further assert that my participation is voluntary and that I knowingly assume all such risks and have personally made note of all obstacles and impediments.

Indemnification and Hold Harmless. I also agree to indemnify and hold Tampa Bay Pickleball LLC and all named above harmless from any and all claims, actions, suits, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my participation in Pickleball games, leagues, tournaments, or clinics taking place within Tampa Bay Pickleball.

In consideration for allowing the Participant to participate in any Activity, I AGREE, to the greatest extent permitted by law, TO WAIVE ANY AND ALL CLAIMS AGAINST AND TO HOLD HARMLESS, RELEASE, INDEMNIFY, AND AGREE NOT TO SUE Tampa Bay Pickleball LLC, insurance companies, commercial & corporate sponsors, affiliates, agents, employees, or representatives.

By signing below, I affirm that I am at least 18 years old, or I am the parent/legal guardian of the minor who will be participating at Tampa Bay Pickleball.

Photography/Videography Release:

I hereby grant permission to Tampa Bay Pickleball LLC and its representatives, employees, or agents to photograph and/or videotape me while I am present within the premises of Tampa Bay Pickleball LLC.

I understand and agree that the photographs and/or videos taken may be used for any and all purposes, including but not limited to:

  1. Social media platforms, such as Facebook, Instagram, Twitter, etc.
  2. Advertising materials, both online and offline.
  3. Public relations activities, including press releases, newsletters, and promotional materials.

I acknowledge that I will not receive any compensation for the use of my image in the aforementioned media. I understand that my participation is voluntary and that I have no right to review or approve the use of the photographs or videos before they are published or distributed.

I hereby release Tampa Bay PIckleball LLC, its agents, employees, and representatives from any and all claims, actions, demands, or liabilities arising out of or in connection with the use of the photographs and/or videos, including but not limited to any claims for defamation, invasion of privacy, or infringement of intellectual property rights.

I understand that Tampa Bay Pickleball will make reasonable efforts to protect the privacy and confidentiality of individuals captured in the photographs and/or videos, but I acknowledge that once the images are posted on the internet or used in other media, they may be viewed and accessed by the general public.

By signing below, I affirm that I am at least 18 years old, or I am the parent/legal guardian of the minor whose image is being captured, and I have read and understood the terms of this Photography Release Form. I am aware that this release is binding upon me and my heirs, legal representatives, and assigns.
