Release and Waiver of Liability

Mines and Meadows, LLC (M&M) USER RULES:

All visitors to the Mines and Meadows, LLC must check-in at the Main Office before using the area. Trespassers will be charged at the full extent of the Law.

IN CASE OF AN EMERGENCY OR ACCIDENT CALL 911

1. ALWAYS wear your safety equipment; obey State, Federal and Manufacturer laws and regulations. DOT or SNELL approved HELMETS and PROTECTIVE EYE WEAR MUST BE WORN AT ALL TIMES THE WHEELS ARE MOVING ON YOUR MACHINE!! INCLUDES PARKING LOT, LOADING & UNLOADING!! ABSOLUTELY NO BICYCLE OR SKATEBOARD HELMETS!!
   
2. PARKING LOT AND ACCESS ROAD MAX SPEED IS 5 MPH! NO HORSE PLAY DONUTS OR STUNTS ON ACCESS ROAD OR PARKING LOT!
   
3. Travel is permitted on designated, blazed routes only. Off-trail travel may damage natural resources or pose a safety hazard to other users. Be aware of oncoming riders. Obey all signs, gates, barriers and security personnel. Do not ride off of Mines & Meadows, LLC property. Only enter and exit the trail systems at a designated trailhead. STAY OFF GRASS, any destruction of grass/lawn area is grounds for ejection from the park. 
   
4. SPEEDS IN EXCESS of 25 MPH are PROHIBITED. Pay close attention to bends and pitches in the trail, and maintain speeds reasonable for conditions.
   
5. All children under the age of 16 must have direct adult supervision. Youngsters age 8 – 15 must complete a certified ATV training class before operating an ATV in PA. Children under the age of 8 are not permitted to operate an ATV.
   
6. No one under the age of 5 is permitted to ride the trails. 
   
7. ATV Registration is required under PA Law. Out-Of-State registrations are honored for all states that have reciprocity with Pennsylvania. PA registration applications can be completed on-site at Mines and Meadows or obtained by calling the PA DCNR Snowmobile/ATV Unit at (717) 783-9227. Ownership title must be on-hand.
   
8. Riders must check in at the office. All riders must purchase either a yearly Gold Club Pass or a Single Use Day Pass wrist band and have it displayed on their person at all times.
   
9. At least one person in each riding group must have a charged and working cell phone in their possession. GPS or location smart phone app recommended (ex: MAPRIKA app).
   
10. All guests must sign a waiver before riding.
11. ATV’s must have a properly functioning muffler (no racing mufflers) and USFS approved spark arrestor (99 decibel maximum).
    
12. No alcoholic beverages may be consumed or carried while in the park. No illegal drugs on MINES AND MEADOWS, LLC property.
13. No glass containers are allowed and please clean up all litter and trash.
    
14. No weapons of any kind are permitted in the park.
    
15. Permits for camping must be obtained at the park office. Campfires are allowed for campers only and must remain in designated areas. Fire rings are not to be moved.
16. NO RIDING AFTER SUN DOWN (DUSK)!! Trails are open from 9:00 am till sunset.
    

Violators of any above listed rules will be asked to leave with no refund. We reserve the right to REMOVE any rider for any inappropriate behaviors. Serious rule-breakers will be BLACK FLAGGED and will result in temporary or permanent banning of the M&M facility. STAY OFF GRASS, any destruction of grass/lawn area is grounds for ejection from the park. 

Owner reserves the right to change the rules without notice.

Mines and Meadows complies with all provisions of the Pennsylvania All-Terrain Vehicle Law.

All trail users must have a valid Mines and Meadows, LLC non-expired Day Wrist Band.

Expect oncoming traffic and always be courteous and utilize proper trail etiquette.

Parking is permitted in designated areas only.

Pack it in- Pack it out. Remove all litter.

ATV, SIDE-BY-SIDE UTILITY VEHICLE (UTV) and MOTORCYCLES:

No passengers unless the unit is manufactured for the driver and a passenger.

We recommend riding in groups of 2 (two) or more.

Everyone must wear an DOT or SNELL approved helmet and protective eye wear (goggles, face shield, glasses, etc.). NO BICYCLE HELMETS OR SKATEBOARD HELMETS!

The number of passengers carried on a side-by-side utility type vehicle shall be limited by the number of manufacturer’s installed seat belts or as approved by an MINES AND MEADOWS, LLC official.

SIDE-BY-SIDE UTILITY VEHICLE (UTV) riders must keep their hands, arms, feet, head and legs inside the vehicle at all times during operation. Units should be equipped with Roll-Over Protection System from the manufacturer or a suitable alternate. Machines must be equipped with manufacturer seat belts and must be in good working order.

PROHIBITED ACTIVITIES:

Starting or maintaining a fire except in a designated fire pit, grill or stove.

Damaging or removing, in whole or in part, a living or dead tree, shrub or plant.

Damaging, or removing rock, shale, sand, clay, soil or other mineral product, natural object or material.

Feeding wildlife.

Dumping, litter, trash, refuse, garbage, bottles, or pollutants. Disorderly conduct of any kind.

Failure to comply with MINES AND MEADOWS, LLC rules, regulations and safe operating procedures may result in arrest, fines, temporary or permanent banning from using the facility. All official rules must be followed.

BEFORE SIGNING THIS DOCUMENT - IT IS A BINDING AGREEMENT

WAIVER AND RELEASE OF LIABILITY

In consideration of the Mines and Meadows, LLC (hereinafter referred as M&M) granting access to the lands leased, owned or otherwise used as the Mines and Meadows ATV/RV Resort (M&M), I agree as follows:

I understand and acknowledge that: (a) risks and dangers exist in accessing M&M; (b) my assessing M&M may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the appointed officials, employees, agents, and business associates of M&M, the negligence of the person signing this release, the negligence of others, accidents, breaches of contract, the forces of nature or other causes; (d) these risks and dangers may arise from foreseeable or unforeseeable causes; and (e) by my accessing M&M, I HEREBY ASSUME ALL RISKS AND DANGERS AND ALL RESPONSIBILITY FOR LOSSES AND/OR DAMAGES, whether caused in whole or in part by the negligence of myself or others, or conduct of appointed officials, employees, agents, or business associates of M&M. I, on behalf of myself, my personal representatives and my heirs and assigns, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify M&M, its appointed officials, employees, agents, or business associates from all claims, suits, or causes of action for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my assessing M&M’s lands. Such access may include, but shall not limited to, tours of the lands, the use of off-pavement or other types of vehicles (either my own or those furnished by M&M its agents and business associates), participation in driver education, trail rides, trail clean ups, property beautification, general admission to M&M lands, off-road related group/club activities, motorcycle riding, or ATV/quad riding, camping, hiking, biking, horseback riding, walking, jogging, running, fishing or any other activities, scheduled or unscheduled.

I specifically understand that I am waiving and forever releasing and discharging M&M, its appointed officials, employees, agents or business associates from any and all claims or causes of action that I may have presently, or which may arise in the future. This waiver and release are effective for all acts, neglect or otherwise, and conduct by M&M, its appointed officials, employees, agents or business associates for conditions of or the land, whether natural or artificial, acts of other riders, or acts or omissions of adjacent landowners or tenants of adjacent landowners on their lands.

I agree that, should any claim or action arise from the accessing of lands planned, leased, or considered for use as the Mines and Meadows, LLC including any issue as to the applicability of this release or any provision contained within it, proper jurisdiction and venue will lie only in Lawrence County, Pennsylvania, and I waive jurisdiction and venue anywhere else.

I acknowledge that I have only been granted access to M&M, that maps of M&M are online or have been made available to me and that it is my duty and responsibility, regardless of whether there are or are not signs so designating, to be or become familiar with M&M’s boundaries prior to accessing M&M. I acknowledge that it is my duty and responsibility to not enter lands of adjacent landowners, that by doing so I may be trespassing and that there may be serious, unforeseen dangers on adjacent lands. Further, I agree that I will not access those M&M lands that have been designated off-limits or out-of-bounds as the same may be being used other activities that could pose a danger of death or serious bodily injury from causes seen or unforeseen. I hereby indemnify and hold harmless M&M, its appointed officials, employees, agents, as well as adjacent landowners, tenants of adjacent landowners, co-tenants of M&M lands (whether of the surface or subsurface) or business associates, for any and all injuries or damages to person or property that I may suffer or injury or damages to person or property that my actions may cause.

I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT I AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE MINES AND MEADOWS, LLC. (hereinafter M&M), ITS ELECTED OFFICIALS, APPOINTED OFFICIALS, EMPLOYEES, AGENTS AND BUSINESS ASSOCIATES, FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE INCLUDING CONDITIONS OF OR ON M&M LANDS, WHETHER NATURAL OR ARTIFICIAL. I ALSO EXEMPT AND RELIEVE ADJACENT LANDOWNERS OR TENANTS OF ADJACENT LANDOWNERS FROM ANY AND ALL LIABILITY RELATED TO ACTS OR OMISSIONS OF THOSE ADJACENT LANDOWNERS OR TENANTS OF ADJACENT LANDOWNERS COMMITTED ON THEIR LANDS OR RELATING TO THE CONDITION OF THEIR LANDS.

I FURTHER EXPRESSLY AGREE THAT THE FOREGOING WAIVER AND RELEASE OF LIABILITY IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAWS OF THE COMMONWEALTH OF PENNSYLVANIA, AND THAT IF ANY PORTION THEREOF IS HELD INVALID, IT IS AGREED THAT THE BALANCE SHALL, NOTWITHSTANDING, CONTINUE IN FULL LEGAL FORCE AND EFFECT.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I CERTIFY THAT ANY VEHICLE(S) I BRING ONTO M&M LANDS IS/ARE LAWFULLY REGISTERED, INSPECTED, AND INSURED, AND THAT I HAVE NO KNOWLEDGE OF ANY CONDITION THAT MIGHT RENDER THE VEHICLE(S) UNSAFE IN ANY WAY. ADDITIONALLY, I CERTIFY THAT I AM PHYSICALLY AND MENTALLY HEALTHY AND HAVE NO CONDITION THAT WILL PUT ME AT RISK WHILE PARTICIPATING IN ANY ACTIVITIES, SCHEDULED OR UNSCHEDULED, AS HEREIN DESCRIBED. FURTHERMORE, I AGREE THAT I WILL NOT BRING, CONSUME, OR DISTRIBUTE ALCOHOL OR ANY ILLEGAL DRUGS ON M&M LANDS FOR MY OWN PERSONAL CONSUMPTION AS WELL AS CONSUMPTION OF OTHERS. ADDITIONALLY, I AGREE THAT I WILL NOT FURNISH ALCOHOL OR ANY ILLEGAL DRUGS TO MINORS FOR CONSUMPTION ON PROPERTY OR PROMOTE CONSUMPTION OF ALCOHOL OR ILLEGAL DRUGS BY MINORS ON M&M LANDS.

By signing below, I agree to abide by the rules of the MINES AND MEADOWS, LLC. Failure to follow these rules and act in a responsible manner may lead to my pass being forfeited and access denied to the MINES AND MEADOWS, LLC riding area.

THIS IS A RELEASE OF LIABILITY - READ CAREFULLY BEFORE SIGNING. BEFORE SIGNING THIS DOCUMENT - IT IS A BINDING AGREEMENT ACTING AS A WAIVER AND RELEASE OF LIABILITY

Mine and Meadows, LLC also known as Mines and Meadows ATV/RV Resort (hereinafter referred as, “M&M”) is a limited liability company of the Commonwealth of Pennsylvania and leases or owns certain lands, located in the County of Lawrence with lands located in both Lawrence and Beaver County, where are hereinafter referred to as “M&M”). M&M strives to provide recreational opportunities, including but not limited to off-road vehicle operation, hunting, hiking and conservation activities at M&M. It is illegal to operate ATV’s and dirt bikes on roadways in the Commonwealth of Pennsylvania, however M&M is striving to change local ordinances that may in the future allow for some roadways to be used. M&M strives to provide economic benefits for the surrounding communities, including the Borough of New Beaver, the Borough of Big Beaver, the Borough of Wampum, and Wayne Township (hereinafter, “Municipalities”). Some or all of the Municipalities, at varying times, at varying locations, and via varying streets, may permit patrons of M&M to access certain Municipality streets and real property, including by operation of off-road vehicles on Municipality streets and real property. Finally, certain real properties are leased to M&M for use as the Mines and Meadows ATV/RV Resort by M&M permit patrons. Collectively, the parties who permit M&M permit patrons access to their lands or streets are hereinafter referred to herein as “Indemnitees”. In consideration for granting access to M&M, as well as, on occasion, certain municipal streets and lands to access the same, the undersigned hereby agrees as follows:

I understand and acknowledge that: (a) there are risks and dangers exist in accessing M&M or Municipality streets and/or real property; (b) my assessing M&M and Municipality streets and real property, may result in injury and/or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) my accessing M&M and Municipality streets and real property, may result in damage to my property or the property of others; (d) these risks and dangers may be caused by: the negligence of Indemnitees, their appointed officials, employees, agents, and business associates; the negligence of the undersigned; the negligence of other parties; accidents, breaches of contract, the forces of nature or other causes; and (e) these risks and dangers may arise from foreseeable or unforeseeable causes. BY MY ACCESSING M&M AND/OR MUNICIPALITY STREETS AND REAL PROPERTY I HEREBY ASSUME ALL RISKS AND DANGERS AND ALL RESPONSIBILITY FOR LOSSES AND/OR DAMAGES, WHETHER CAUSED IN WHOLE OR IN PART BY: THE NEGLIGENCE OF MYSELF OR OTHERS OR THE ACTS OR OMISSIONS OF INDEMNITEES, THEIR APPOINTED OFFICIALS, EMPLOYEES, AGENTS, OR BUSINESS ASSOCIATES. THE UNDERSIGNED, ON BEHALF OF MYSELF, MY PERSONAL REPRESENTATIVES AND/OR MY HEIRS AND ASSIGNS, HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, DEFEND AND INDEMNIFY INDEMNITEES, THEIR APPOINTED OFFICIALS, EMPLOYEES, AGENTS, CONTRACTORS, SUBCONTRACTORS, AND/OR BUSINESS ASSOCIATES FROM ALL CLAIMS, SUITS, OR CAUSES OF ACTION FOR BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, LOSS OF SERVICES OR OTHERWISE WHICH MAY ARISE OUT OF MY ASSESSING M&M AND/OR MUNICIPALITIES’ STREETS AND/OR REAL PROPERTY.

Such access may include, but shall not limited to: tours of the lands; the use of, or riding as a passenger in, an off-road or other type of vehicles (either my own, furnished by M&M, furnished by Xplore Rentals or any other rental supplier); participation in driver education courses; trail rides; trail clean ups; property beautification; general admission to M&M lands; off-road related group/club activities; motorcycle riding; ATV/quad / side-by-side / snow mobile riding; camping; hiking; biking; horseback riding; walking; jogging; running; fishing; community service; benefit rides or any other activities, scheduled or unscheduled. I specifically understand that I am waiving and forever releasing and discharging Indemnitees, their appointed officials, employees, agents, contractors, subcontractors and/or business associates from any and all claims or causes of action that I may have presently, or which may arise in the future.

This waiver and release is effective for all acts or omissions, neglect or otherwise, by Indemnitees, their appointed officials, employees, agents, contractors, subcontractors and/or business associates, including but not limited to: conditions of or on the land, whether natural or artificial; acts or omissions of other riders; traffic accident injuries or property damage on any public streets; failure of the undersigned or other riders to abide by M&M rules and regulations or Municipalities’ traffic rules or regulations; and acts or omissions of adjacent landowners or tenants of adjacent landowners on their lands. I agree that, should any claim or action arise pertaining to the undersigned’s accessing M&M or Municipalities’ streets or real property, or matters appurtenant thereto, the undersigned agrees that proper jurisdiction and venue shall lie exclusively in Lawrence County, Pennsylvania, and I waive jurisdiction and venue anywhere else. The undersigned acknowledges that this Agreement shall be considered to have been executed in the County of Lawrence. The undersigned acknowledges having only been granted access to M&M and, on certain designated times and on certain designated streets as set forth by the individual Municipalities, access to the streets or real property of the Municipalities.

The undersigned acknowledges that maps of M&M are online and have been made available to me. However, because M&M lands are added and removed from operation, these maps may not be accurate at all times and that I am responsible for obeying all signage on M&M. I acknowledge that it is my responsibility to determine, prior to exiting M&M lands, if permission has been granted by Municipalities and other Indemnitees to enter their streets or real property and the rules or regulations pertaining to said access. I acknowledged that it is my duty and responsibility, regardless of whether there are or are not signs so designating, to be or become familiar with M&M’s boundaries and the Indemnitees and Municipalities’ streets and real property where access is permitted, prior to accessing the same. I acknowledge that it is my duty and responsibility to not enter lands of adjacent landowners who have not permitted said access and that by doing so I may be trespassing and that there may be serious, foreseeable or unforeseeable dangers on adjacent lands. Further, the undersigned agrees that they will not access those M&M lands or Municipalities streets and real property that have been designated off-limits or out-of-bounds. I hereby indemnify and hold harmless the Indemnitees, their appointed officials, employees, agents, contractors, subcontractors and assigns, as well as adjacent landowners, tenants of adjacent landowners, cotenants of M&M lands (whether of the surface or subsurface) or business associates, for any and all injuries or damages to person or property that I may suffer or injury or damages to person or property that my actions or omissions may cause.

BY MY INITIALS HEREON, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE FOREGOING WAIVER AND RELEASE OF LIABILITY. I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT I AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE THE INDEMNITEES, SPECIFICALLY INCLUDING MINES AND MEADOWS, LLC OTHERWISE KNOWN AS MINES AND MEADOWS ATV/RV RESORT (M&M) , THE BOROUGH OF NEW BEAVER, THE BOROUGH OF BIG BEAVER, THE BOROUGH OF WAMPUM, WAYNE TOWNSHIP, AND LESSORS OF LANDS TO M&M, THEIR ELECTED OFFICIALS, APPOINTED OFFICIALS, EMPLOYEES, AGENTS, CONTRACTORS, SUBCONTRACTORS, ASSIGNS AND BUSINESS ASSOCIATES, FROM ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. I ALSO EXEMPT AND RELIVE ADJACENT LANDOWNERS OR TENANTS OF ADJACENT LANDOWNERS FROM ANY AND ALL LIABILITY RELATED TO ACTS OR OMISSIONS OF THOSE ADJACENT LANDOWNERS OR TENANTS OF ADJACENT LANDOWNERS COMMITTED ON THEIR RESPECTIVE LANDS OR RELATING TO THE CONDITION OF THEIR RESPECTIVE LANDS. ADDITIONALLY, I CERTIFY THAT I AM PHYSICALLY AND MENTALLY HEALTHY AND HAVE NO CONDITION THAT WILL PUT ME AT RISK WHILE PARTICIPATING IN ANY ACTIVITIES, SCHEDULED OR UNSCHEDULED, AS HEREIN DESCRIBED. FURTHERMORE, I AGREE THAT I WILL NOT BRING, CONSUME, OR DISTRIBUTE ALCOHOL, ILLEGAL DRUGS, OR LEGAL DRUGS WHICH WOULD IMPAIR MY ABILITY TO ACT SAFELY OR RESPONSIBLY, ON M&M LANDS OR THE AFOREMENTIONED MUNICIPALITY STREETS OR REAL PROPERTY, WHETHER FOR MY OWN PERSONAL CONSUMPTION OR FOR THE CONSUMPTION OF OTHERS. ADDITIONALLY, I AGREE THAT I WILL NOT FURNISH ALCOHOL, ILLEGAL DRUGS, OR LEGAL DRUGS WHICH WOULD IMPAIR THE ABILITY TO ACT SAFELY OR RESPONSIBLY TO MINORS. BY SIGNING BELOW, I AM NOT UNDER THE INFLUENCE OF ANY SUBSTANCE THAT MAY OR WILL IMPAIR MY ABILITY TO SAFELY ACCESS AND UTILIZE M&M OR MUNICIPALITY STREETS OR REAL PROPERTY.

The undersigned hereby takes total and complete responsibility for all actions or omissions of those persons named on this form, including any minors in my care. By signing below, I agree to abide by all of the rules of M&M as well as any traffic or other rules of any Municipality whose streets or lands I may access and that I shall further enforce these rules and regulations as to any minors in my care. Failure to follow these rules and act in a responsible manner may lead to my pass or the pass of any minor being forfeited, and access denied to M&M.

In consideration of being permitted to compete, officiate, observe, work, access or participate in any way in or on M&M or Municipalities streets or real property, the undersigned agrees that they shall immediately notify M&M of any condition or activities that appears to be unsafe.

NEGLIGENT RESCUE OPERATIONS OR PROCEDURES

The undersigned hereby agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by M&M and Municipalities INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by the laws of the Commonwealth of Pennsylvania and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
