Jet Ski Dude Water and Boating Safety Liability Release


Please read the following safety guidelines regarding Water Safety Basics recommended by the American Red Cross.

Always swim with a buddy — whether you're at home, at the beach, at a lake, a public pool, a hotel or another favorite swimming spot. Swim in designated areas only. Also:

  •  Wear a life jacket while boating — even on calm waters.
  •  Actively supervise children near water, and never leave them unattended — even for a moment.
  •  Keep additional life preservers on your boat.
  •  Make sure that everyone in your family knows how to swim well.
  •  Be aware of your surroundings.
  •  Avoid alcohol use when swimming, boating and participating in water sports or activities.
  •  In Case of Emergency or if anyone is in danger, call 911 immediately.

I fully understand and acknowledge that: (a) outdoor recreational activities have inherent risks, dangers, and hazards and such exist in my use of paddle sport equipment and my participation in paddle sport activities. (B) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/ or total paralysis, death or other ailments that could cause serious disability: (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of the negligence of participants, the negligence of theirs, accidents, beaches or contract, the forces of nature or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, weather, trail or water conditions, and water level, risk of falling out of or drowning while paddle sporting and such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, ocean, outdoor, or recreational environment

By my participation in these activities and/ or use of equipment, I hereby assume all risks and dangers and all responsibility for any loses and/ or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, or employees of Jet Ski Dude, or by any other person including myself. I also verify that I am in good health, not under the influence of any drugs or alcohol of any kind, nor do I have them in my possession, and am capable of pursuing paddle sports, and that my participation in this activity is voluntary, l/we also agree to a properly secured USCG approved personal floatation device, of type 3 or better, at all times.


l, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, discharge, hold harmless, defend and indemnify Jet Ski Dude and its owners, officers, and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of paddle sport equipment or premises or my participation in paddle sport activities. specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have at present time or in the future for the negligent acts or other conduct by the owners. agents, officers or employees of Jet Ski Dude.


INDEMNITY WAIVER AND RELEASE OF LIABILITY AGREEMENT. TEXAS WAIVER/RELEASE OF LIABILITY

By the execution of this Release, the undersigned agrees that Jet Ski Dude, Comal County, and the Water Oriented Recreation District of Comal Coun!y (W.O.R.D.) shall not be liable for any damages arising from personal injuries sustained by the undersigned or any minor children under the undersigned's custody, care and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Jet Ski Dude The undersigned assumes full responsibility for any such injuries or damages which may occur, and further agree that Jet Ski Dude, Comal County, and W.O.R.D. shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that EL948 shall not be responsible for such injuries, damages, loss or theft; EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY Jet Ski Dude. COMAL. COUNTY, AND W.O.R.D. whether such negligence is present at the signing of this Release or takes place in the future.

LIABILITY TO THIRD PARTIES

The undersigned herby agrees that he/she will indemnify and hold harmless Jet Ski Dude , Comal County, and W.O.R.D. for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and passengers of other watercraft and minor children under the undersigned's custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Jet Ski Dude even if such damages arise out of the negligence or fault of Jet Ski Dude, Comal County or W.O.R.D.


ACKNOWLEDGMENT OF WAIVER AND RELEASE

The undersigned states that he/she has had sufficient time to review the Waiver and Release and to ask any questions association with said Release. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, Knows the contents thereof, and has signed this Release as his/her own free act. The undersigned warrants that he/she is aware that he/she may rent, operate, or use equipment from another rental facility, but has chosen to rent, operate, or use equipment from Jet Ski Dude with the knowledge that signed this Release is a requirement for rental, operation, and use of said equipment. The undersigned further warrants that he/she is fully aware that he/she is waiving any right he/she may have to bring a legal action to assert a claim against Jet Ski Dude , Comal County, or W.O.R.D.

ACKNOWLEDGMENT OF WATER LAWS

The undersigned states that he/she has had sufficient time to review the following water laws applicable to Canyon Lake and the Guadalupe within the Water Oriented Recreation District.

Aqreement to Return and Care for Company Equipment

I acknowledge that while I am renting from Jet Ski Dude, will take proper care of all company equipment that I am entrusted with. I further understand that upon the end of my rental term, I will return all Jet Ski Dude property and that the property will be returned in proper working order. I understand I will be held financially responsible for lost or damaged property. Paddle boards not returned will be charged replacement cost of $350.00 and life jackets $45.00. This agreement includes, but is not limited to paddle boards, oars, pumps, life jackets and other equipment. I understand that failure to return equipment will be considered theft and may lead to criminal prosecution by Jet Ski Dude.


I HAVE READ THE WAIVER AND RELEASE AND BY SIGNING IT, AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE Jet Ski Dude FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. I understand that I will be asked to provide identification prior to receiving equipment and/or service.

I have read and been informed about the safety guidelines for participants at Jet Ski Dude . I agree to abide by these guidelines as a condition of participating at Jet Ski Dude.

I understand that if I have questions, at any time, regarding these guidelines, I will ask a staff member for clarification and guidance.
