Bohamia - Liability Waiver and Assumption of Risk

The Land of Bohamia is privately owned, and operated by Bohamia, LLC (“Campground”). Camping has inherent risks associated with outside activities. Guests and all members of their party, pets, and visitors (“You”) accept camping privileges with the understanding that they hereby release Campground, its officers, employees, affiliates and associates (“Personnel”) of all liability for loss or damage to property, as well as personal injury, arising out of their use of Campground facilities, and agree to indemnify Campground and Personnel against any and all claims of loss or damage to property or personal injury while on Campground or neighboring property.By entering onto the Campground property You expressly allow Campground Personnel to photograph You while on Campground and neighboring property, and to use any resulting pictures for any lawful purpose without compensation.

You acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that You may be exposed to or infected by COVID-19 while on Campground or neighboring property, and that such exposure or infection may result in personal injury, illness, permanent disability and death. You understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of Yourself and others, including, but not limited to, Campground Personnel, volunteers and other campers. You voluntarily agree to assume all the foregoing risks and accept sole responsibility for any injury, illness or death to Yourself or anyone in Your party. On behalf of Yourself and Your party, You hereby release, covenant not to sue, discharge, and hold harmless Campground and Personnel of and from any claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.

You agree to pay for any damages to Campground property, sites, buildings, facilities, equipment, or loss of equipment, which may occur as a result of your use or that of any member of your party. You also agree to immediately report any accident, injury or property damage to Campground staff. If a hazard or dangerous situation exists on Campground or neighboring property, you will notify Campground staff immediately. You also agree to take full responsibility for yourself and all the people in your party, including minors and visitors, and will require them to read and comply with all Campground rules and regulations as posted in the office or on the grounds, as well as the terms and conditions as set forth in this notice.

Campground is bordered by public land in the Talladega National Forest and the boundary may not always be obvious. Campground is not responsible for safety hazards that may exist on neighboring land. You accept full responsibility for your actions and personal safety, whether on Campground property or neighboring land. Please exercise extreme caution regardless of your location, particularly around large rocks and rushing water.

FOR THE AVOIDANCE OF DOUBT, YOU HEREBY FREELY, VOLUNTARILY AND WITHOUT DURESS RELEASES CAMPGROUND FROM LIABILITY UNDER THE FOLLOWING TERMS (THE “RELEASE”):

Acknowledgement and Assumption of Risk. You acknowledge that your presence on Campground property or neighboring land (the “Activity”) might result in injuries, death, property damage or other harm to Yourself or third parties. You accept and voluntarily incur all risks of any such injuries, damages or harm which arise during or result from the Activity except only to the extent caused by the sole negligence or intentional misconduct of Campground.

Waiver and Release. You waive, release and forever discharge all claims against Campground for any injuries, damages, losses or claims, whether known and unknown, which arise during or result from the Activity, except only to the extent caused by the sole negligence or intentional misconduct of Campground.

Indemnification and Hold Harmless. You agree to indemnify and hold Campground harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys’ fees and other litigation costs and expenses) incurred by Campground as a result of any claims or suits brought to recover any losses, liabilities, costs, damages or expenses which arise during or result from the Activity, except only to the extent caused by the sole negligence or intentional misconduct of Campground.

Other. You expressly agree that this Release is intended to be as broad and inclusive as permitted by law, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Alabama. You also agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

I HAVE READ & AGREE TO COMPLY WITH ALL CAMPGROUND RULES & REGULATIONS. I FURTHER AGREE TO COMMUNICATE THESE RULES TO ALL MEMBERS OF MY PARTY AND VISITORS, AND ACC PT RESPONSIBILITY FOR THEIR ACTIONS AND SAFETY WHILE ON CAMPGROUND PROPERTY OR NEIGHBORING LAND.
