TERMS AND CONDITIONS FOR THE LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED

ACKNOWLEDGEMENT AND ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AGREEMENT

In consideration of the services of The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED and as a condition to participate in The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED excursions, I hereby agree as follows:

Acknowledgement and Assumption of Risk:

Whilst white water rafting has an excellent safety record, I acknowledge the inherent risk in river excursions, including floating on river, jumping from the raft, jumping from the waterfall, canyoning, tubing, floating down the river, whitewater entering, entering and exiting the river, and transport to and from the river which could result in personal injury, death or property damage to myself, to property or to third parties. I also understand that such risks, whether known or unknown, cannot be eliminated from such river excursions. I hereby expressly agree and promise to accept and assume all of the risk associated with such river excursions and further agree that my participation in these activities is purely voluntary, and I elect to participate in spite of such risks, excepting liability arising from personal injury or death caused by our negligence.

1. Release and Waiver of Liability and Claims:

I hereby expressly agree to release, waive and discharge The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED and affiliated companies, officers, directors, employees, and agents from any and all liability, claims, demands or causes of action that I may have now or hereafter for any and all injuries to my person or property that may be sustained by me or the children in my care during the river excursion or resulting from or associated with such river excursions.

2. Agreement to Indemnify:

I further agree to indemnify, save and hold harmless and defend The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED from any loss, liability damage or cost that they may incur due to my presence or the presence of the children in my care, and participation in any river excursion, including without limitation, subrogation and/ or derivative claims brought by any third party or insurer in connection with any injury or damage that I may suffer while on The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED river excursions.

3. Right to Refuse:

It is the right of The Guide to refuse clients onboard if they are thought to be intoxicated or under the influence of drugs. There will be no credit refund in this event.

4. Alcohol:

No alcohol may be taken onboard the rafts or consumed at any point prior to or during a session.

5. Damages:

Any wilful damage incurred to the property of The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED caused by your negligence, malicious acts, or carelessness will be charged to you, the Client, and must be paid for at the time at current replacement value.

6. No Shows:

No refunds or credit will be issues if you fail to advise any amendments to the booking or fail to arrive in time for your excursion.

7. We may refuse participation:

a. If a participant is not deemed to be of a suitable standard for a particular session, they may be asked to leave.

b. If a participant acts in such manner as to endanger themselves, or anyone else, they may be asked to leave the session. 

c.For safety reasons, participants must wear safety helmets and buoyancy aids at all times on and around the water. A suitable wetsuit and trainers must be worn on all sessions. These are provided The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED. Participants may wear their own wetsuit providing it is long legged and has been approved by The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED.

8. Health and Safety Considerations:

a. All participants must be able to swim

b. All participants must be physically able to get down within the raft. Anyone with a medical condition or injury which may impede their ability to be on or in the water should consult their medial practitioner to assess ability to participate. The Lake District White Water Rafting Centre should be informed of any medical conditions or injuries.

c. For any participant under the age of 18 years old, a parent or guardian, or adult authorised by the parent or guardian, will be required to agree to their participation with The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED. 

d. The wearing of Spectacles is not recommended whilst participating in any of our sessions. If you choose to wear spectacles you must accept that injury may occur and accept full responsibly for any such injury.

e. Shoes need to have a good treaded sole and be securely fitted. Trainers are perfect. Wet suit boots with smooth soles are not appropriate, neither are flip flops or crocs. 

9. Photography and Videography Policy:

a. Wearing a Go-Pro (or equivalent) is only permitted to be worn on a chest harness only if you have one. The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED cannot allow a camera to be worn on a helmet as this is too much of a safety risk with low branches.

b. You may not take photographs or videos of any minors without the consent of their parent/ carers 

c. The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED reserves the right to use any photographs or videos for marketing and promotional purposes. If you prefer that your images are not included, please let us know, and we will exclude them from future promotions.

d. The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED reserves the right to keep all footage for up to three years.

10. Cancellation Policy

a. The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED offers a full refund until one calendar month before your trip.

b. All cancellations/ reschedules must be done via email: hi@lakesrafting.co.uk.

c. Cancellations/ reschedules with less than one month’s notice will incur a fee of 50% of the cost of the booking cost.

d. No refund will be given for cancellations made within 7 days of a trip, or for no-shows.

e. Water, weather and river conditions are outside of The LAKE DISTRICT WHITE WATER RAFTING COMPANY LIMITED’s control. You will be updated the day before your trip if there is a change to the meeting location. Please make sure that you are contactable via email and SMS in the event of river changes the day before your trip.

This agreement is governed by the law of England and Wales

I HAVE READ AND VOLUNTARILY SIGN THIS ACKNOWLEDGEMENT AND ASSUMPTION OF RISK,

RELEASE AND WAIVER OF LIABILITY AND INDEMNITY, AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME, AND INTEND THAT MY SIGNATURE IS COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. 

ADULT PARTICIPANTS

Lake District White Water Rafting Limited accepts its responsibility to make its trips as safe as is reasonably practicable. However, adventurous activities are inherently hazardous and cannot be completely risk free, however hard we try.

Accidents can happen without any contributory negligence from the company or its staff. Lake District White Water Rafting Limited can accept no responsibility for loss or damage to personal property or for personal injury not arising as a result of its own act or default.

I understand and accept the above statements and accept that I have a responsibility to take careful note of instructions and to act in a way that will minimise the likelihood of injury. I am fit for the course and will inform the centre before the course of any special medical conditions that might affect my safety.

PARENTAL CONSENT

Lake District White Water Rafting Limited accepts its responsibility to make its trips as safe as is reasonably practicable. The staff have, and fully accept, a duty of care to make those activities as safe as is reasonably practical. They are required to adhere to a comprehensive set of safety rules and there is a quality management system to monitor the fact that rules and procedures are adhered to.

However, adventurous activities are inherently hazardous and cannot be completely risk free however hard we try. Accidents can happen without any contributory negligence from the centre or its staff.

Moreover, the environment at Lake District White Water Rafting is such that we cannot “fence off” all hazardous areas. Your son or daughter must therefore help our staff to look after their safety by listening carefully to instructions, by doing what they are asked to do and by not being reckless by trying to do more than they have been briefed to do. Only give your consent if you are confident that they will behave responsibly in this way. Lake District White Water Rafting Limited can accept no responsibility for loss of or damage to personal property or for personal injury unless arising as a result of its own action or default. 

I understand and accept the above statements. My son or daughter is fit for the course and will inform Lake District White Water Rafting before the trip of any special medical conditions that might affect my son’s or daughter’s safety.

I agree to my son or daughter receiving emergency medical treatment, including anaesthetic, as considered necessary by the medical authorities present and I give authority to members of staff of Lake District White Water Rafting to consent to such treatment.
