ASSUMPTION OF RISK AGREEMENT

Release and Waiver of Liability and Assumption of Risk Agreement

I hereby certify that I am the adult parent, guardian, legal custodian, or individual responsible for the minor child named below, who is under the age of eighteen (18). I consent to their participation in the activities offered by Kids Fun Zone LLC (“the Facility”).

In consideration for the minor child being permitted to participate in activities at Kids Fun Zone LLC, I, the undersigned, acknowledge and agree to the following:

1. Assumption of Risk

I fully understand that participation in activities at the Facility involves inherent risks, which include, but are not limited to, minor injuries (such as cuts, bruises, and muscle strains), serious injuries (such as fractures, concussions, or other physical trauma), and, in rare cases, death. I acknowledge that these risks may result from the participant child’s actions, inactions, or negligence, as well as the actions, inactions, or negligence of others, or the condition of the premises or equipment. I voluntarily assume all such risks on behalf of the participant child.

2. Responsibility to Supervise

I understand that it is my responsibility to supervise the participant child at all times during their participation in activities at the Facility. This includes ensuring that the participant child adheres to all posted rules and uses the equipment as intended. I further acknowledge that I must remain on the Facility’s premises at all times during the participant child’s activities. I accept full responsibility for any damage to property or equipment caused by the participant child or myself, excluding normal wear and tear.

3. Party Zone Use

If I rent or use the designated “Party Zone” area of the Facility, I understand that I am fully responsible for any property or equipment damage that occurs during my rental, excluding normal wear and tear. Activities such as breaking piñatas may pose similar risks to other activities in the Facility. I agree to supervise all participants during such activities and assume all associated risks.

4. Covenant Not to Sue

On behalf of myself and the participant child, I agree not to file or pursue any legal claim against Kids Fun Zone LLC, its owners, employees, agents, or representatives for any injury, damage, or loss arising from participation in activities at the Facility.

5. Release and Indemnification

I release and discharge Kids Fun Zone LLC, along with its owners, employees, and representatives, from any and all claims, liabilities, or expenses, including those arising from negligence, related to the participant child’s participation in activities at the Facility. This release includes claims for bodily injury, illness, property damage, or death.

6. Photo Release

Participant grants Kids Fun Zone LLC, its representatives, and employees the right to take photographs of Participant and Participant’s property in connection with Kids Fun Zone LLC's operations. Participant authorizes Kids Fun Zone LLC to use and publish these photographs in print and/or electronically, including on social media platforms. Participant agrees that Kids Fun Zone LLC may use such photographs of Participant without Participant’s name for any lawful purpose, including for example, such purposes as publicity, illustration, advertising, and web content.

7. Health Certification

I certify that the participant child is in good health and has no medical condition or limitation that would prevent or heighten the risks of participating in activities at the Facility.

8. Coronavirus/COVID-19 Acknowledgment

I acknowledge the contagious nature of COVID-19 and understand that Kids Fun Zone LLC has implemented guidelines to minimize the risk of exposure. However, I understand that participation in activities may still result in exposure to COVID-19, which could occur through actions or negligence of myself, the participant child, other guests, or staff.

I agree to comply with all health and safety procedures set forth by the Facility, including those related to social distancing, mask-wearing (if required), and sanitation. I also certify that neither I nor the participant child:

  • Have experienced symptoms of illness (e.g., fever, cough, shortness of breath) in the past 14 days.
  • Have been exposed to or diagnosed with COVID-19 within the past 14 days.
  • Have traveled to high-risk areas as identified by public health authorities within the past 14 days.

By signing, I assume all risks related to COVID-19 exposure on behalf of myself and the participant child.

9. Acknowledgment of Understanding

I confirm that I have carefully read and fully understand the terms of this Agreement. I understand that by signing, I am waiving substantial legal rights on behalf of myself and the participant child. I sign this Agreement voluntarily and acknowledge that my decision to allow the participant child to participate in activities at Kids Fun Zone LLC is entirely voluntary.
