RELEASE, WAIVER AND INDEMNIFICATION OF STACEY LYNN RESER, RYAN MICHAEL RESER AND KANADIAN EQUESTRIAN TRAINING AND SALES

WARNING
Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.

1.    Release and Waiver: I, the undersigned (hereinafter “Guest”) hereby recognizes the inherent risks of equine activities and the inherent danger and risks of entering upon the property located at, 1245 SE 95TH STREET, OCALA, FL 34480 (hereinafter Property”). STACEY LYNN RESER, RYAN MICHAEL RESER, and KANADIAN EQUESTRIAN TRAINING AND SALES, agrees that as a precondition to the entry upon and use of the property for any reason, Guest is required to release and hold STACEY LYNN RESER, RYAN MICHAEL RESER, and KANADIAN EQUESTRIAN TRAINING AND SALES, and their employees, harmless for any injury (including death), or property damage arising out of said entry upon or any equine activities on the Property. Guest hereby expressly, absolutely and forever discharges, waives and releases, to the full extent permitted by the laws and the State of Florida. STACEY LYNN RESER, RYAN MICHAEL RESER, and KANADIAN EQUESTRIAN TRAINING AND SALES, and their employees (hereinafter “the Released Party”) and their directors, officers, representatives, agents, successors and assigns from any and all losses, injuries, damages, claims, costs, liabilities, expenses, actions of every nature and description whatsoever, whether foreseen or unforeseen, including without limitation, personal injury, property damage, property loss, and wrongful death which the Guest may now have or may in the future have against the Released Party, arising out of or related to, or in connection with said activities. Guest agrees not to sue “the released Party” if Guest suffers injury or death while on the Property. 

2.    ALL GUESTS MUST WEAR BOOTS/HEELED SHOES AND WEAR ASTM/SEI CERTIFIED HELMENTS AT ALL TIMES WHEN MOUNTED ON THE PROPERTY. 

3.    Indemnification: Guest hereby agrees to indemnify STACEY LYNN RESER, RYAN MICHAEL RESER, and KANADIAN EQUESTRIAN TRAINING AND SALES from any claims arising out of any injury (including death) or property damage resulting from Guest’s entry upon the Property. Said indemnification shall include any property damage, personal injury or death suffered by third parties.

4.    Binding Effect: The provision of this agreement shall be binding upon the parties, their heirs, guardians, legal representatives and /or assigns.
