Release from Liability and Indemnification (Please read before signing.)

I agree to waive and release the Agua Hedionda Lagoon Foundation, California Watersports and the City of Carlsbad (which includes its officers, employees, agents and elected and appointed officials) from any claims, causes of action, damages, losses, liabilities, or expenses (which includes attorney fees and court costs) for any personal injury, property, damage or death arising out of my participation in the above activities and events, regardless whether the personal injury, property damage, or death was caused by the negligence of the City of Carlsbad, or other entity. I UNDERSTAND THAT BY SIGNING THE WAIVER I AM FREEING THE CITY OF CARLSBAD, FROM ANY LIABILITY RESULTING FROM MY PARTICIPATION IN THE ABOVE ACTIVITIES AND EVENTS. I RECOGNIZE THAT THESE ACTIVITIES AND EVENTDS CAN BE DANGEROUS TO ME AND ACCEPT THOSE DANGERS. I UNDERSTAND THAT IF I AM INJURED, THIS WAIVER WILL BE USED AGAINST ME AND ANYONE ELSE CLEAIMING DAMAGE BECAUSE OF MY INJURY IN ANY LEGAL ACTION. I ALSO UNDERSTAND THAT NO CITY EMPLOYEE AGENT IS AUTHORIZED TO MODIFY THIS WAIVER. I understand that at this event or related activities, I may be photographed. I agree to allow my photo, video or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers and/or assigns. This WRL shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.  the body of your waiver here.
