COMBINED RELEASE OF LIABILITY AND PHOTO/VIDEO CONSENT FORM

SECTION 1: RELEASE OF LIABILITY

THIS RELEASE OF LIABILITY WAIVER FORM (this "Waiver") is entered into in consideration of being allowed to participate in the Private Boat Charter activity (hereafter referred to as the "Activity" OR “Charter”) provided by Cayman Kind Watersports Ltd. (hereafter referred to as the "Activity Provider"), I, (hereafter referred to as the "Participant"), agree to the following terms:

1. DETAILS OF ACTIVITY

1. The Participant will be participating in the following activity: Private Boat Charter (the "Activity" or the “Charter”) provided by Cayman Kind Watersports Ltd.

2. Travelling by water (hereafter called “Charter”) is a hazardous activity with inherent risks and dangers including, but not limited to, risks due to equipment failure, perils of the sea and/or acts of passengers which could result in my serious injury or death. The Participant EXPRESSLY ASSUMES THESE RISKS.

2. CONSIDERATION

1. Being of lawful age and in consideration of being permitted to participate in the Charter, the Participant releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives, and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity, and notwithstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of the Activity Provider.

2. The Participant understands that the Participant would not be permitted to participate in the Activity unless the Participant signed this Waiver.

3. The participant understands that they have a duty to exercise reasonable care for their own safety and agrees to do so. The Participant assumes financial responsibility if the Participant damages the vessel and/or equipment associated with.

3. FITNESS TO PARTICIPATE

1. I assert I am physically fit to participate in a CHARTER, and I agree I will not hold CAYMAN KIND WATERSPORTS LTD. and/or the VESSEL responsible if I am injured as a result of any medical condition whilst traveling by water. I do not have in my possession any illegal drugs, nor am I taking, nor have I recently taken any drugs or medications which could cause an adverse reaction as a result of combining such drugs and/or medication with a CHARTER.

2. I will be present and attentive to the safety briefings given by the captain and/or crew.

3. I will immediately cease and exit the VESSEL prior to departure, if:

1. I feel uncomfortable with my abilities and/or

2. Traveling conditions are worse than those for which I am comfortable.

4. I warrant if I require assistance from the captain and/or crew, I will immediately advise the captain and/or crew. I understand the CHARTER includes traversing a large body of water and medical assistance may be delayed due to time and distance from a medical facility. Nevertheless, I expressly wish to proceed with the CHARTER.

5. Cayman Kind Watersports Ltd. has made no representation to me, implied or otherwise, that they will, or crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold “Cayman Kind Watersports Ltd.” or crew/ passengers responsible for attempting the performance or rescue of first aid.

4. CONCURRENT RELEASE

1. I exempt and release Cayman Kind Watersports Ltd. (hereafter called Cayman Kind Watersports.) And Cayman Kind Watersports’ 2006 Sea Ray Bowrider Sundeck 220 “Get it Kraken” (hereafter called vessel) its employees, agents and boats whether owned, operated, leased or chartered.

2. I further agree to hold harmless these entities from liability arising from any act or omission on their part including, but not limited to, active or passive negligence.

3. The Participant acknowledges that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant by the Activity Provider, and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives, and assigns.

5. FULL AND FINAL SETTLEMENT

1. The Participant acknowledges and agrees with the Activity Provider that:

  1. The Activity Provider has given the Participant sufficient time to carefully read this Waiver,
  2. The Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver,
  3. The Participant fully understands the risks and claims that the Participant is waiving to participate in the Activity,
  4. The Participant is freely and voluntarily executing this Waiver, and
  5. The Participant is forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the Activity.

2. I agree to forever discharge and release “Cayman Kind Watersports Ltd.”, its crew and affiliates, from any and all responsibility or liability for any and all injuries or damages. I agree not to make claim against or sue any of the above parties for injuries or damages whether they arise from negligence or other liability, Even in cases of gross negligence.

3. By way of my signature below it is my express intention by way of this instrument to give up my right to sue all individuals, or entities or vessels referred to herein, whether specifically named or not and it is also my intention to exempt and relieve cayman kind watersports ltd., the vessel, its employees, agents and boats whether owned, operated, leased or chartered from all liability arising as a consequence of any act or omission including, but not limited to, active or passive negligence.

4. By way of my signature on this document I fully agree to indemnify and hold harmless Cayman Kind Watersports Ltd. And the vessel from any and all liability for personal injury of any sort, property damage or wrongful death by myself, heirs and assigns, and i assume expressly all risks in connection with the charter.

5. By way of my signature given voluntarily I evidence i have read fully and understand this document in its entirety. If I have questions regarding this vessel liability release and waiver, I certify I have fully informed myself before signing my name below. I fully agree to the terms and conditions herein and realize they are given in exchange for cayman kind watersports ltd. And the vessel allowing me to participate in this activity.

6. GOVERNING LAW This Waiver will be governed by and construed in accordance with the laws of the Cayman Islands.

SECTION 2: PHOTO AND VIDEO CONSENT AND RELEASE

Photo and Video Consent and Release Form

I hereby grant permission to Cayman Kind Watersports Ltd. to use my image, likeness, and voice captured in photographs and/or video recordings for marketing and promotional purposes. This includes but is not limited to use on the company website, social media platforms, print materials, and other digital media, without any compensation or further approval from me.
