(Release & Waiver / COVID 19 Policies & Procedures)

A signed Hui No‘eau release and waiver is required before you may register for a class or participate in any activity at Hui No‘eau. The release and waiver applies to all Hui Noʻeau activities in which you participate in the same calendar year, regardless of the nature of the activities.

PLEASE READ THE FOLLOWING PROCEDURES THOROUGHLY & SIGN THE RELEASE/WAIVER BEFORE PARTICIPATION.

Hui No‘eau policies, procedures, and the Hui’s ability to provide programs may change at any time. Please make sure your contact records at the Hui are up to date, so that we may keep you updated on any changes.​ Information will be communicated via ​email​ to registered students and posted to huinoeau.com. Please note that Hui No'eau can operate at a stricter, more conservative level than what is required or recommended by federal, State or County orders or guidance, so please ensure that you check our policies prior to registration. It is your responsibility to comply with the policy in effect at the time of participation in the Hui’s programs, even if the policy in effect is different from the policy set forth below. Release/Waiver & Intake Form:​ All participants must sign a release and waiver acknowledging the risks of participation and waiving liability for participation in Hui programs. Please complete a new release and waiver form for the first Hui program in which you participate in a calendar year; that release and waiver form will apply to all Hui Noʻeau activities in which you participate in the same calendar year, regardless of the nature of the activities.

Masks/Face Coverings:​ Face masks are not required, however, some teachers may still prefer that students wear face masks and will share their preference at the start of class.

Illness & Symptoms:​ If you are sick (with any illness), please stay home. If you are displaying symptoms of COVID-19 (even mild symptoms), you will not be allowed to participate in Hui activities and you will be sent home. Please do a “wellness check” for symptoms at home before coming to the Hui campus. These symptoms include, but are not limited to, cough, shortness of breath or difficulty breathing, fever, chills, muscle or body aches, sore throat, fatigue (tired or weakness), headache, congestion or runny nose, nausea or vomiting, diarrhea, and/or new loss of taste or smell. Credits or refunds generally are not provided for missed days, but a credit or refund will be considered upon request and with proof of illness. If you suspect you may have COVID-19, please get tested or wait 10 days before participating in activities at the Hui campus.

If a Hui participant contracts COVID-19 (regardless of vaccination status): A person who tests positive for COVID-19 may not participate in activities at the Hui until ALL of the following conditions are met:

-10 days have passed since symptoms first appeared (or 10 days after test collection if no symptoms) AND;

-24 hours have passed with no fever and without the use of fever-reducing medications AND;

-Symptoms have improved or resolved.

If a Hui participant is a Close Contact to a COVID-19 case (regardless of vaccination status): If you are a close contact it is highly recommended that you wear a mask for 10 days after exposure but it is not required.  Close contacts should monitor any symptoms, and review the information above in this waiver if testing positive. Testing after day 5 is also recommended per DOH. 

Travel: Students, staff, teachers, and other participants arriving from outside the State of Hawaii may participate in Hui activities without delay, unless they are displaying symptoms of COVID-19, are a close contact of a COVID-19 positive case, or test positive for COVID-19. See the guidance above for more information and, if you are sick (with any illness), please stay home.

Higher-Risk Individuals: We recommend that participants at higher-risk for illness consult their medical provider to assess their risk and determine if participation in Hui activities is acceptable and safe.

Classroom Entry: Only students who are officially enrolled and have submitted a signed release and waiver, Hui staff, and Hui teachers may enter the classroom space. Parents/guardians, visitors, and guests may not enter the classroom space or congregate outside the classroom.

Action Plan for COVID-19: If a participant develops symptoms of COVID-19 or other illness during a Hui class, camp, or activity, that participant’s participation in activities at the Hui must conclude immediately and the “Illness and Symptoms” guidance above will apply.

Potential for Closure: If at any time, the Hui determines that it is necessary to close due to COVID-19, programs may be canceled, even on short notice. All efforts will be made to give as much notice as possible. In case of closure, credits or refunds will be considered, in the Hui’s sole discretion.

Right to Refuse Service: For the safety of all, Hui No‘eau reserves the right to refuse service to anyone who does not abide by Hui policies. No refunds or credits will be provided to those who do not follow Hui policies or rules.

Registration, Accommodation, Modification & Cancellation Policies: Pre-registration is required. Hui No‘eau reserves the right to change class instructors when necessary and/or refuse enrollment to participants with a history of disruptive behavior, failure to follow Hui policies or rules or similar considerations. While every effort will be made to offer classes as scheduled, the Hui reserves the right to cancel and reschedule classes as needed for any reason. Membership fees are not refundable. Tuition refunds, less a $25 processing fee, will be given to registered students withdrawing at least 7 days before the start of the registered program. No refunds or credits will be given to students withdrawing less than 7 days prior to the start date of the registered program. Credits or refunds generally are not provided for missed days, but a credit or refund will be considered upon request and with proof that the reason for the missed day was the student’s illness. Switching the dates enrolled in class or the name of the participant is considered a cancellation. Pro-rating is not available. If the participating student has a disability and needs accommodation to be able to fully participate in a class, the Hui should be alerted at the time of registration (at least one week in advance of class start date) to discuss any accommodations needed.

Thank you for registering for a class or open studio at Hui No‘eau Visual Arts Center! Please carefully read and sign this release and waiver form. By doing so, you will acknowledge that you have read, understand, and accept the terms outlined below. Please note that we must receive a completed copy of this form before you participate in any Hui program during the current calendar year.

PARTICIPANTS MUST SIGN THIS PAGE ​BEFORE PARTICIPATING IN ANY HUI NOʻEAU ACTIVITIES DURING THIS CALENDAR YEAR. THE HUI REQUIRES A NEW RELEASE AND WAIVER FORM EACH CALENDAR YEAR AND THE RELEASE AND WAIVER FORM WILL APPLY TO ALL HUI ACTIVITIES DURING THE CALENDAR YEAR, REGARDLESS OF THE NATURE OF THE ACTIVITIES.

RELEASE AND WAIVER

I have either enrolled in a class, open studio, or have volunteered to help at Hui No‘eau Visual Arts Center, Makawao, HI. I have read Hui Noʻeau’s class schedule for the trimester(s) in which I am participating and understand fully that all phases of these art programs and the participation in such programs are hazardous and involve risk of injury (including but not limited to the risk of contracting COVID-19), which could be serious and which could include permanent disability or death, and risk of severe personal and/or economic losses which may result not only from my own actions, inactions or negligence, but also from the action, inaction or negligence of others, or the condition of the premises, facilities, or any equipment used. Further, there may be unanticipated or unexpected risks which arise during my participation in Hui activities. With that knowledge, I assume all of the risks of injury to my person and property that may be sustained in connection with my participation in Hui activities and I accept personal responsibility for the damages following such injury or loss (including permanent disability or death). In the event my participation in a Hui activity results in my contraction of COVID-19 or another infectious disease, I further assume all of the risks that my contraction of such disease may result in injury, illness, permanent disability, and/or death of my family members or others I come into contact with and I accept personal responsibility for the damages resulting therefrom.

I am in good physical and mental condition and fully capable of engaging in the activities I am intending to do. I have no health conditions and I am taking no medications that might impair my abilities to participate in my intended activities. If I have any health condition or am taking any medication and am unsure whether it might impair my abilities to participate in my intended activities, I understand that it is my responsibility to obtain clearance from my health care provider to participate in my intended activities and, to the extent applicable, I confirm that I have done so. 

I have been advised that Hui No‘eau has a firm policy of no smoking, alcohol, or drug use on its premises and I agree to abide by it. Prior to my using any tools or equipment in Hui No‘eau studios, I will learn proper safety instruction. It is my responsibility to fully understand and abide by that instruction. I agree to observe all safety rules as part of Hui Noeau’s consideration to accept me as a student/studio user/volunteer. In addition to studio safety training, I will receive instruction on the proper use of all tools that I want or need to use in my class, volunteer work, or studio work. Once I demonstrate understanding of the “proper use” rules, one of Hui Noʻeau’s faculty will approve my continuing use of those particular tools. I will only use those tools for which I am approved. I agree that in the event I am unfamiliar with the tools or equipment I am using, or have any questions regarding the use and operation of said equipment or tools, I will immediately cease use of such equipment or tools and contact Hui Noʻeau’s faculty or staff for further instructions and necessary information regarding the operation of said equipment or tools. I understand Hui Noʻeau’s faculty or senior staff may revoke this permission at any time and I agree to abide by any such revocation.​

I consent and agree that still photographs and motion pictures in the form of either live or video tape may occur while attending a Hui Noʻeau camp, class, special event, open studio or workshop. I give permission for images to be provided for informational, marketing, advertising, educational and training purposes related to Hui Noʻeau and its programs and to be used in newsletters, advertisements, brochures, magazines, video publicity, possible public television broadcast, on-line or social media and any other media for such purposes. I hereby release Hui Noʻeau and forever discharge any claim of any nature against it so long as the material is provided or used as stated above.

I agree to pay for my Hui class(es) & open studio session(s) before participating in these programs. I understand that if I do not pay, I will not be permitted to participate in any Hui programs while retaining a balance due. Further, I understand that repeated late payments may result in expulsion from the program.

I have read and agree to be bound by Hui Noeau’s policies, procedures and rules in effect at the time. Hui faculty and staff will make decisions about the application and enforcement of all rules and policies. The start of my participation in a Hui Noʻeau activity shall be conclusive proof of my understanding of and agreement to abide by Hui Noʻeau’s policies, procedures and rules in effect at the time. I understand that violations of these policies, procedures and rules can result in warnings, suspensions or expulsion from participation in a Hui program, depending on the severity and/or repeat nature of violations. I understand and agree that there will be no tuition credits or refunds or other compensation of any kind for lost time due to penalties for violating Hui Noʻeau policies, procedures or rules.

To the maximum extent permitted by law, I hereby release Hui No‘eau, its board of directors, officers, employees, volunteers, agents, representatives, and management staff (“Releasees”) from any and all claims (whether known or unknown), demands, damages (including physical and economic), rights of action or causes of action (collectively, “Claims”) arising out of, related to or connected with, directly or indirectly, any loss, damage, or injury (including disability or death) that I might incur or sustain due to participating in any Hui Noʻeau activities or that my family or others might incur or sustain due to my participation in Hui Noʻeau activities, whether caused in whole or in part by the actions, omissions or negligence of the Releasees or otherwise; and I hereby agree to indemnify Releasees and hold them harmless of and from any such Claims whether asserted by me, on my behalf, or by others (to the extent the claims of others are based in any part on my conduct or participation).

I expressly agree that this release and waiver is intended to be as broad and inclusive as is permitted by the law of the State of Hawaii and that if any portion is held invalid or unenforceable, the balance shall, notwithstanding, continue in full legal force and effect. The terms of this release and waiver shall be construed according to the laws of the State of Hawaii. I agree that the terms of this release and waiver bind me, my heirs, assigns, executors and administrators.

I have been provided with and have read Hui Noʻeau’s COVID-19 policies and procedures and I agree to abide by them. 

 

To the best of my knowledge, ​within the past 10 days, I have been free of symptoms of COVID-19 such as cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, and/or new loss of taste or smell. 

 

To the best of my knowledge, ​within the past 10 days, I have not been a close contact (less than 6 feet away for a cumulative total of 15 minutes or more over a 24-hour period) of anyone with COVID-19 or anyone displaying symptoms such as cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, and/or new loss of taste or smell.
