LA Dance Space, L.L.C. 35055 LA-16, Ste. 2-F Denham Springs, LA, 70706 WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT 1. In consideration for receiving permission to participate in the various activities associated with dancing(including leaps/jumps, turns, kicks, extensions, tricks/tumbling, partner work, conditioning exercises, stretches, strength/stamina/flexibility exercises), I, hereinafter referred to as “Participant”, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE LA Dance Space, L.L.C., their officers, agents, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activity, while in, on or upon the premises where the activities are being conducted, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.2. I am fully aware of the risks and hazards connected with the activities of dancing(including leaps/jumps, turns, kicks, extensions, tricks/tumbling, partner work, conditioning exercises, stretches, strength/stamina/flexibility exercises), and I am aware that such activities include the risk of injury and even death, and I hereby elect to voluntarily participate in said activities, knowing that the activities may be hazardous to my property and me. I understand that LA Dance Space, L.L.C., does not assume responsibility for any loss, property damage, or injury/death resulting from my voluntary participation in these activities. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activities, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise, to the fullest extent allowed by law. 3. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs, including court costs and attorneys' fees that Releasees may incur due to my participation in said activities, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise, to the fullest extent allowed by law. 4. It is my express intent that this Waiver and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Louisiana and that any mediation, suit, or other proceeding must be filed or entered into only in Louisiana and the federal or state courts of Louisiana. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions. IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Wavier of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; I have authority to sign on Participant’s behalf and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.

CONSENT TO USE OF PHOTOGRAPH FOR SPECIFIED PURPOSES I, hereinafter referred to as “Participant”, do hereby acknowledge that LA Dance Space, L.L.C., may take Participant’s photograph from time to time, that LA Dance Space, L.L.C., may wish to use Participant’s photograph for promotional and marketing purposes. I hereby acknowledge that said photographs may be posted on social media, including, but not limited to, the following: Facebook, Instagram, Twitter(“X”), TikTok, or any other social media site utilized by LA Dance Space, L.L.C. Participant’s photos will not be sold to any person or entity.I have read and understand the foregoing paragraph. Having read the foregoing paragraph, I give the following consent to use Participant’s photograph in connection with same: (please select one in the question portion of this waiver) - I consent to Participant’s photograph, including Participant’s face, being taken by LA Dance Space, L.L.C., and I also consent to Participant’s photograph being used as specified in the foregoing paragraph.

I hereby release, waive, discharge, and covenant not to sue LA Dance Space, L.L.C., their officers, agents, or employees from any and all liability arising out of my voluntary decision selected in the foregoing paragraph. I further hold harmless and indemnify LA Dance Space, L.L.C., their officers, agents, or employees from any loss, liability, or damage, arising out of my voluntary decision selected in the foregoing paragraph. LA Dance Space, L.L.C. 35055 LA-16, Ste. 2-F Denham Springs, LA, 70706 STUDIO HANDBOOK AGREEMENT I, agree to the terms, conditions, policies, and payment amounts/ payment schedules outlined in the LA Dance Space studio handbook that has been presented to me.I understand that failure to comply with the LA Dance Space policies and procedures can result in additional fines and/or in my student’s dismissal from the studio. I understand that credit/debit cards, cash, and check will all be accepted forms of payment. Should I choose to use a credit/debit card, a 3% fee will be added to all payments. Should I choose to pay via cash or check, the 3% fee will be waived. I understand that storing a credit/debit card on file is required and I authorize LA Dance Space to charge my card for any balances and/or applicable fees remaining on my account. If I fail to pay my balances timely (regardless of my preferred payment method), my card on file may be charged to collect any and all unpaid balances. I understand that absolutely NO refunds will be given under any circumstances. I understand that the deadline to drop any and all classes is January 1st, 2025. If my family drops beyond the deadline, I am responsible for paying the remaining tuition, fees, balances, and payments for the remainder of the dance year (through May 2025). I understand that I will forfeit that money along with any and all costumes, merchandise, awards, services, tickets, etc. associated with that payment that have not already been provided to me. Absolutely NO refunds will be given for any payments. If I drop prior to this deadline, I will not be responsible for the remaining fees/tuition, however any and all payments previously made will NOT be refunded and I will forfeit that money along with any and all costumes, merchandise, awards, services, tickets, etc. associated with that payment. I understand that LA Dance Space’s primary goal is to teach, support, and encourage my child. I also acknowledge that the studio has these regulations in place with my student’s best interest in mind. |
