I voluntarily elect to participate in the physical activity and sport of Ice Skating at the Downtown Fresno Ice Rink (the “Event”). I understand that the Event takes place on ice – an inherently hard, uneven, and slippery surface. I understand Ice Skating involves sharp blades capable of causing traumatic injury.

Elijo voluntariamente participar en la actividad física y deporte de patinaje sobre hielo en la Pista de Hielo de Downtown Fresno (el “Evento”). Entiendo que el Evento se lleva a cabo sobre hielo, una superficie inherentemente dura, irregular y resbaladiza. Entiendo que el patinaje sobre hielo implica cuchillas afiladas que pueden causar lesiones traumáticas.

Assumption of Risk: I acknowledge and assume all risks associated with participating in the Event, including but not limited to falls, collisions, uneven surfaces, trip hazards, and contact with participants or objects. I understand that the Event involves physical activity and interaction with others, which may increase the risk of injury or transmission of infectious diseases. I am aware of potential natural and man-made hazards and environmental conditions that may result in injury or damage to property. I agree to identify and accept these risks and understand that the Released Parties are not liable for any injuries or damages.

Asunción de Riesgo: Reconozco y asumo todos los riesgos asociados con la participación en el Evento, incluyendo, pero no limitado a, caídas, colisiones, superficies irregulares, obstáculos, y contacto con otros participantes u objetos. Entiendo que el Evento implica actividad física y contacto con otras personas, lo cual puede aumentar el riesgo de lesiones o transmisión de enfermedades infecciosas. Soy consciente de posibles riesgos naturales y artificiales, y de las condiciones ambientales que pueden causar lesiones o daños a la propiedad. Health and Safety Acknowledgment: I understand that participating in the Event at the Downtown Fresno Ice Rink may expose me to infectious diseases, including COVID-19, and that these risks cannot be fully eliminated. By participating, I voluntarily assume all such risks, including potential illness or injury. I agree not to attend if I am experiencing symptoms or have been advised to isolate or quarantine. I acknowledge that my participation is voluntary, and I may choose to withdraw at any time.

Reconocimiento de Salud y Seguridad: Entiendo que participar en el Evento en la Pista de Hielo de Downtown Fresno puede exponerme a enfermedades infecciosas, incluyendo COVID-19, y que estos riesgos no pueden ser completamente eliminados. Al participar, asumo voluntariamente todos esos riesgos, incluyendo enfermedad o lesión potencial. Acepto no asistir si tengo síntomas o si se me ha aconsejado aislarme o ponerme en cuarentena. Reconozco que mi participación es voluntaria y que puedo decidir retirarme en cualquier momento.

Released Parties: I agree to indemnify and hold harmless the Downtown Association of Fresno (dba Downtown Fresno Partnership (DFP)), 1101 Fulton Mall LLC, Seaside Ice, LLC (dba Ice-America), the City of Fresno, and their respective owners, affiliates, officers, employees, agents, event personnel, and sponsors (collectively, the “Released Parties”) from any liability, loss, or cost arising from my participation in the Event, including due to the negligence of the Released Parties. I and my heirs, assigns, and representatives will not make any claims or proceedings against the Released Parties or any entities seeking contribution or indemnity from them.

Partes Liberadas: Acepto indemnizar y exonerar de responsabilidad a la Asociación de Downtown Fresno (bajo el nombre comercial Downtown Fresno Partnership (DFP)), 1101 Fulton Mall LLC, Seaside Ice, LLC (bajo el nombre comercial Ice-America), la Ciudad de Fresno y sus respectivos propietarios, afiliados, funcionarios, empleados, agentes, personal del evento y patrocinadores (colectivamente, las “Partes Liberadas”) de cualquier responsabilidad, pérdida o costo que surja de mi participación en el Evento, incluyendo por negligencia de las Partes Liberadas. Yo y mis herederos, cesionarios y representantes no presentaremos ningún reclamo o proceso contra las Partes Liberadas ni contra entidades que busquen contribución o indemnización de ellas.

Participant Conduct and Ice Regulations: I agree to follow all Event rules, including not bringing or consuming alcohol before or during ice time. I will not enter the ice if impaired by alcohol or substances. No food, drinks, large items (e.g., children, big bags), can be carried on the ice. I understand that the Downtown Fresno Ice rink staff and/or employees may remove me or end the Event at any time at its sole discretion.

Conducta del Participante y Normas de la Pista: Acepto seguir todas las reglas del Evento, incluyendo no llevar ni consumir alcohol antes o durante el tiempo en el hielo. No ingresaré al hielo si estoy afectado por alcohol o sustancias. No se puede llevar comida, bebida, ni objetos grandes (como niños o bolsas grandes) sobre el hielo. Entiendo que el personal de la pista de hielo de Downtown Fresno puede retirarme o finalizar el Evento en cualquier momento a su entera discreción.

Locker Use and Personal Property: I understand that the Downtown Fresno Ice Rink and the Released Parties are not responsible for any loss, theft, or damage to personal belongings placed in lockers or left unattended. By using the locker rental service, I accept all responsibility for my personal items and agree that the Released Parties are not liable for any missing or damaged property.

Uso de Casilleros y Propiedad Personal: Entiendo que la Pista de Hielo de Downtown Fresno y las Partes Liberadas no son responsables por la pérdida, robo o daño a pertenencias personales colocadas en los casilleros o dejadas sin supervisión. Al utilizar el servicio de alquiler de casilleros, acepto toda la responsabilidad por mis objetos personales y estoy de acuerdo en que las Partes Liberadas no son responsables por ninguna propiedad perdida o dañada.

Media Release and Consent: I grant the Released Parties and their representatives the right to capture and use my image, likeness, voice, and any photos, videos, or audio recordings taken of me during the Event (“Images”). These Images may be used for any lawful purpose, including promotion and advertising, in any media worldwide, forever, without further permission or compensation. I waive the right to inspect or approve the final use and release the Released Parties from any related claims, including invasion of privacy, defamation, or rights of publicity.

Autorización de Uso de Imagen y Consentimiento: Otorgo a las Partes Liberadas y sus representantes el derecho de capturar y usar mi imagen, apariencia, voz, y cualquier foto, video o grabación de audio tomada de mí durante el Evento ("Imágenes"). Estas Imágenes pueden ser utilizadas para cualquier propósito legal, incluyendo promoción y publicidad, en cualquier medio a nivel mundial y para siempre, sin necesidad de más permisos o compensación. Renuncio al derecho de inspeccionar o aprobar el uso final y libero a las Partes Liberadas de cualquier reclamo relacionado, incluyendo invasión de la privacidad, difamación o derechos de publicidad.

Indemnification and Hold Harmless Agreement: I hereby agree to indemnify and save and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in the Event whether caused by the negligence of the Released Parties or otherwise.

Acuerdo de Indemnización y Exoneración de Responsabilidad: Acepto indemnizar y exonerar de responsabilidad a las Partes Liberadas por cualquier pérdida, responsabilidad, daño o costo que puedan incurrir debido a mi participación en el Evento, ya sea causado por la negligencia de las Partes Liberadas o de otra manera.

If the participant is under 18, the child must sign along with their custodial parent/guardian. As the custodial parent/guardian, I agree to this release on behalf of the child and acknowledge it binds the child and their heirs. I confirm my legal responsibility for the child, consent to their participation, and agree to release and hold harmless the Released Parties from any liabilities related to the child’s participation, even if due to the negligence of the Released Parties.

Si el participante es menor de 18 años, el niño debe firmar junto con su padre/madre o tutor legal. Como padre/madre o tutor legal, acepto esta exoneración en nombre del niño y reconozco que obliga al niño y a sus herederos. I have read this Release, understand it, and understand I am giving up substantial rights, including my right to sue. I agree to be legally bound by it and intend my digital signature to be a complete and unconditional release of all liability to the maximum extent permitted by law.
