Waiver and Release of Liability 

Attention: by signing this Waiver and Release of Liability Agreement, you acknowledge the inherent risk that comes with boating, and you agree to assume this risk and voluntarily release and forever discharge Royal Boat Charter and Tours Arizona, LLC, Maricopa County, Desert Troon, LLC, Maricopa Water District (hereinafter the Parties) and you agree to indemnify and hold it harmless from any and all liability of any nature for any and all injury or damage arising from your use and operation of its boats and/or equipment. 

This Waiver and Release of Liability Agreement (“Release”) is applicable to all renters, operators, passengers, and users of equipment and boats provided by Royal Boat Charter and Tours Arizona, LLC, an Arizona limited liability company (hereinafter “Royal Boat Rentals”). For purposes of this Release, all Parties includes all principles, directors, officers, employees, agents, representatives, servants, assigns, successors, insurers, and subsidiaries of the Parties. If any other rental agreement is supplemented with this release, the provisions of this Release will prevail over any clauses in the rental agreement that are inconsistent with this Release.The undersigned agrees that he/she is also signing this Release on behalf of undersigned’s minor children. Renter agrees that he/she will disclose to Royal Boat Rentals all potential operators, passengers, and users of said rental equipment. Renter further agrees that in the event that he/she fails to notify Royal Boat Rentals of all potential operators, passengers, or users of said equipment, he/she will be personally liable for any damages to the undisclosed individuals, even if such damages arise out of the negligence or fault of Royal Boat Rentals. 


I. ACKNOWLEDGEMENT OF RISKS – The undersigned hereby acknowledges that some, but not all of the risks of participating in watersport activities include: 1) Changing water flow, tides, currents, wave action and ships’ wakes; 2) Collisions with any of the following: other participants, the watercraft, other watercraft, and manmade or natural objects; 3) Collision, capsizing, sinking or other hazard which results in wetness, injury, exposure to the elements, hypothermia, drowning and/or death; 4) Loss of control of the craft, collision, capsizing, and sinking of the craft which can result in wetness, injury, exposure to the elements, hypothermia and drowning; 5) Equipment failure or operator error; 6) My sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions; 7) Wind, inclement weather, lightning, variances and extremes of wind, weather, and temperature, 8) Heat or sun related injuries or illnesses, including sunburn, sunstroke or dehydrations this list is not complete and that unknown or unanticipated risks may result in injury, illness or death; and 9) the potential of being finned, bit, slashed, stabbed, burnt, broken, dismembered, disfigured, drowned or killed. 


II. EXPRESS ASSUMPTION OF RISK – The undersign herby agrees that he/she is renting, operating, or using the equipment provided by Royal Boat Rentals at his/her own risk. The undersigned agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment, The undersigned assumes full responsibility for the risks of personal injury, accidents or illness, including but not limited to sprains, torn muscles and/or ligaments; fracture or broken bones; eye damage; cuts, wounds, scrapes, abrasions, and/or contusions; head, neck, and/or spinal injuries; animal or insect bite or attack; shock, paralysis, drowning, and/or death; and any resultant expenses from any of the foregoing risks and assumes all risk injury, illness, damage or loss that might result, regardless of the cause, even if the risks arise out of the negligence or fault of the Parties. 


III. LIFEJACKET DISCLOSURE – In accordance with Arizona law, children aged 12 and under are required to wear lifejackets at all times while on the boat. Royal Boat Rentals recommends that ALL individuals on the boat wear lifejackets as it is a simple step that can save a life. The undersigned agrees that he/she has been advised of the laws surrounding lifejackets and will comply with the same. The undersigned agrees that if they are over 12 years of age and choose not to wear a lifejacket, they understand the consequences and assume the risk of the same. 


IV. BOAT SLIDE DISCLOSURE – The undersigned understands and agrees that Royal Boat Rentals rent equipment that contain boat slides that are intended for recreational purposes only. The intended use of the boat slide requires that one party use the slide at a time in a seated position while firmly on their behind. The riding party should not use the boat slied until all Parties have cleared the drop zone of the boat slide. The drop zone is the area below the slide where the rider enters the water after disembarking from the boat slide. The undersigned understands and agrees that any other use of the boat slide outside of its intended use is dangerous and could lead to serious injury. The undersigned understands and agrees that it assumes the risk of injury when using the boat slide outside its intended purpose. 


V. WAIVER/RELEASE OF LIABILITY – By the execution of this Release, the undersigned voluntarily releases, forever dischargesandagreestoindemnifyandholdharmlessthePartiesfromanyandallliabilityofanynatureforanyandall injuryor damage arising from personal injuries sustained by the undersigned or any minor children under the undersigned’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Royal Boat Rentals regardless of the cause. The undersigned assumes full responsibility for any such injuries or damages, which may occur, and further agrees that the Parties, shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that the Parties shall not be responsible for such injuries, damages, loss, or theft. EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY THE PARTIES, whether such negligence is present at the signing of this Release or takes place in the future. This Release does not apply to gross negligence or intentional torts by the Parties. 


VI. INDEMNIFICATION – The undersigned hereby agrees that he/she will indemnify and hold harmless the Parties, for all personal injuries, property damages, or any other damages to any and all third parties, including but not limited to, operators and passengers of other watercraft and minor children under the undersigned’s custody, care, and control as a result of any and all activities related to the rental, operation, or use of equipment and boats provided by Royal Boat Rentals, even if such damages arise out of the negligence or fault of all Parties. 


VII. ACKNOWLEDGEMENT OF WAIVER AND RELEASE – The undersigned states that he/she has had sufficient time to review the Release and to ask any questions associated with said Release. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has signed this Release as his/her own free act. The undersigned warrants that he/she is aware that he/she may rent, operate, or use equipment from another rental facility, but has chosen to rent, operate, or use equipment from Royal Boat Rentals with the knowledge that signing this Release is a requirement for rental, operation, and use of said equipment. The undersigned further warrants that he/she is fully aware that he/she is waiving any right he/she may have to bring a legal action to assert a claim against the Parties for Parties’ negligence. 


In Witness Whereof, the undersigned affirms that he/she has read, understands and agrees to be legally bound to this Waiver and Release effectively waiving their rights and releasing the Parties from liability as discussed above and further realizes this Waiver and Release relates to surrendering valuable legal rights and assuming important legal responsibilities and he/she does so freely and voluntarily, and does so for himself or herself and his or her heirs, not to exclude the guests I personally allow aboard said vessel, assigns and legal representatives. 

IN WITNESS WHEREOF, I AFFIRM THAT I HAVE READ THIS WAIVER AND RELEASE, I UNDERSTAND THIS WAIVER AND RELEASE, AND I AGREE TO BE LEGALLY BOUND BY THIS WAIVER AND RELEASE EFFECTIVELY WAIVING MY RIGHTS AND RELEASING THE PARTIES FROM ALL LIABILITY DISCUSSED ABOVE AND I MAKE THIS WAIVER AND RELEASE FOR MY SELF AND ALL GUESTS I PERSONALLY ALLOW ON THE ROYAL BOAT RENTAL EQUIPMENT. 


PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of Royal Boat Charter and Tours Arizona LLC, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "RBCT"), I hereby agree to release, indemnify, and discharge RBCT, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate as follows:

1. I acknowledge that my participation in Guided Pontoon Boat Charters activities entail known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: slips and falls; accidental drowning; damage to equipment or personal injury; exposure to sun, strong wind, cold; exposure to temperature and weather extremes which could cause cold shock, hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; aggressive and/or poisonous marine life; major injuries are a risk as are sprains, strains, scratches, bruises, abrasions, cuts, lacerations, broken bones, fractures, musculoskeletal injuries including head, neck, and back injuries; my own physical condition, and the physical exertion associated with this activity; transmissible pathogen or disease; traveling to and from activity locations raises the possibility of any manner of transportation accidents.

Furthermore, RBCT personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear a U.S. Coast Guard approved personal flotation device (life jacket) when required by applicable state law or when recommended or required by the manufacturer.

3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless RBCT from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of RBCT's equipment or facilities, including any such claims which allege negligent acts or omissions of RBCT.

4. Should RBCT or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

6. In the event that I file a lawsuit against RBCT, I agree to do so solely in the state of Arizona, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against RBCT on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at RBCT. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

ROYAL BOAT RENTALS AND TOURS LLC/Dusty Karr: NOTE: Our policy is that Deposits are non refundable. We are a seasonal operation and book months and years in advance so if someone cancels it prevents us from filling a spot we would have definitely booked.

COMPLETE LIABILITY RELEASE

I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH Renting a charter tour boat and swimming: including but not limited to equipment failure, perils of the lake, acts of other participants, and adverse lake and weather conditions, and I HEREBY ASSUME SUCH RISKS. In Addition, ROYAL BOAT RENTALS AND TOURS LLC WILL NOT GIVE REFUNDS/OR DISCOUNTS FOR TRIPS THAT ARE CUT SHORT DUE TO HIGH WINDS, RAIN, HEAT OR MONSOON STORMS. IF THE CAPTAIN CANCELS RESERVATION DUE TO FOR SEEN WEATHER THEN A REFUND/OR CREDIT WILL BE ISSUED TO CLIENT BASED ON A CASE BY CASE BASIS. RESERVATIONS MADE THROUGH THIRD PARTY’S CLIENTS SUCH AS GET MY BOATS AND BOAT SETTER WILL HE ISSUED THROUGH THE ENTITY THAT CLIENT BOOKED THROUGH. WE DO THE BEST WE CAN TO PROVIDE A SAFE AND FUN BOAT TOUR AND OUR CAPTAINS MONITOR WEATHER CONDITIONS TO KEEP OUR CLIENTS SAFE. WE MAKE EVERY EFFORT NOT TO CANCEL TRIPS UNLESS IT IS FOR THE SAFETY OF OUR CLIENTS. 

DISCLAIMER:

If your Charter is cancelled due to weather or for an unforeseen reason, we are not responsible for any fees incurred for your accommodations or other travel related expenses. You should purchase separate trip insurance to cover these expenses if that is a concern.

ROYAL BOAT RENTALS AND TOURS HAS THE RIGHT TO REFUSE SERVICE TO ANYONE ACTING IN AN INAPPROPRIATE MANNER SUCH AS INTOXICATION BUT NOT LIMITED TO. IF CLIENTS ACT OUT IN AN UNSAFE MANNER OR ARE VISIBLE INTOXICATED CAPTAINS WILL END TOUR AND RETURN CLIENT TO LAND FOR THEIR SAFETY.


NOTE:

Please prepare for high volumes of traffic and difficulty finding parking on busy weekends. 

We do not allow refunds for guests who miss their scheduled tours. Should you need to make any changes to your reservation please contact us. 

NOTE:

ROYAL BOATS can switch boats with out notice if the boat the client initially booked is unavailable due to mechanical/or captain availability a boat of equal size will be Substituted. No refund or discount will be given for boats that are substituted due to mechanical or Captain availability.

I UNDERSTAND THAT I HAVE DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO.

I assert that I am physically fit to swim and ride on a boat and I will not hold the vessel ROYAL BOAT RENTAL AND TOURS LLC or their employees, agents or other associated personnel responsible if I am injured as a result of ANY problems (medical, accidental or otherwise) which occur while chartering the boat or otherwise participating in the trip. 

I fully understand that the vessel Named The Pink Party Barge, The Patriot Boat, Liquid Limo or any other Boat used by ROYAL BOAT RENTALS AND TOURS LLC has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.

ROYAL BOAT RENTALS AND TOURS LLC have made no representations to me, implied or otherwise, that they or their crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold ROYAL BOAT RENTALS AND TOURS LLC or their crew or passengers responsible for their actions in attempting the performance or rescue of first aid.

I agree to forever discharge and release ROYAL BOAT RENTALS AND TOURS LLC and its employees and agents, as well as the owner(s) Dusty Karr and Laura Schilling of ROYAL BOAT RENTALS AND TOURS LLC or any vessel and/or affiliates, from any and all responsibility or liability for any and all injuries or damages. I agree NOT to make a claim against or sue any of the above parties for injuries or damages whether they arise or result from any NEGLIGENCE or other liability, EVEN IN CASES OF GROSS NEGLIGENCE. I further specifically agree, on behalf of myself, my heirs and assigns, to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in riding on the boat/swimming and/or fishing activities with or involving the released parties.

I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT, FROM THE DATE OF MY SIGNATURE, FOREVER INTO THE FUTURE.
