RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

Please carefully read and fill out the form below. All new shooters MUST have a signed release form.

In consideration of The Farm SC, LLC d/b/a The Sporting Club at the Farm furnishing services, equipment and/or the facilities and in consideration of my participation in shooting or other related activities (the "Sport"), I hereby agree to release and discharge from liability arising from negligence The Farm SC, LLC and its owners, directors, officers employees, agents, volunteers, participants, and all other parents, persons or entities acting for them (hereinafter collectively referred to as "Releasees"), on behalf of myself and my children, heirs, assigns, personal representative and estate, and agree as follows:

  1. I acknowledge that the sport activities involve known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but we are not limited to, death or serious injury because of being shot or as a result of equipment malfunction; hearing loss; loss of vision; broken bones, bruises and other bodily injuries caused by falls; medical conditions resulting from physical activity, and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.
  2. I expressly accept and assume all the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.
  3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct. Should Releases or anyone acting on behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
  4. I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume - and bear the costs of- all risks that may be created, directly or indirectly, by any such condition.
  5. In the event that I file a lawsuit, I agree to do solely in the state where Releasees' facility is located, and I further agree that the substantive law of that state shall apply.
  6. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

By signing this document, I agree that if I am hurt or my property is damaged during my participation in this activity, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released based on any claim for negligence.

I understand that this activity might not be made available to me or that the cost to engage in this activity would be significantly greater if I were to choose not to sign this release and agree that the opportunity to participate at the stated cost in return for the execution of this release is a reasonable bargain. I have read and understood this document and I agree to be bound by its terms.

THE SPORTING CLUB AT THE FARM SAFETY RULES

  1. Safety is priority #1 at The Sporting Club at The Farm (“The Farm”)
  2. First time shooters at The Farm are required to read the safety rules and liability release and watch the safety video before shooting.
  3. Ear and eye protection are REQUIRED for all shooters, spectators, and personnel while at The Farm.
  4. Participants must sign-in at the club house/farmhouse and receive field assignments BEFORE shooting.
  5. Participants must RETURN to the club house/farmhouse when finished shooting.
  6. Only use the correct gauge (12ga, 20ga, .410) ammunition for your gun.
  7. Only 7 1/2, 8, and 9 shot size shells are allowed for all games at the club.
  8. All guns must be kept UNLOADED with ACTION OPEN at all times when you are not at a shooting station.
  9. No more than TWO shells may be loaded when shooting sporting clays or 5-stand.
  10. Shoot only from designated shooting stations and load guns ONLY when on the shooting station.
  11. All shots must be taken from inside a station. Shooting from anywhere else including next to or in front of a station is strictly prohibited. ONLY wheelchair shooters are permitted to shoot directly next to a station when it is deemed safe.
  12. Only 1 shooter is permitted to shoot at each target through and only 1 gun can be loaded at a time. There is NEVER a backup shooter.
  13. Guns must be unloaded and action open BEFORE leaving shooting station.
  14. In the event of a misfire or malfunction, keep the gun pointed down range, carefully open the action, unload the gun, and check barrels for obstructions.
  15. NEVER leave your gun unattended.
  16. NEVER go into the trap house or in the sporting clays staging area at any time. Only The Farm staff members and approved personnel are allowed to load or repair any machines at The Farm.
  17. Report all safety violations to The Farm personnel.
  18. No alcoholic beverages are allowed prior to or during shooting or at any designated shooting areas.
  19. No one will be allowed to participate in any activity if deemed to be under the influence of alcohol or drugs.
  20. The Farm reserves the right to refuse service to anyone and to inspect all guns/ammunition brought to this facility.
  21. The Farm is not responsible for any damages to your person or any equipment that falls off a golf cart/ATV for any reason whether it’s yours or The Farm’s. Drivers of a golf cart/ATV, whether it’s yours or The Farm’s must possess a valid automobile driver’s license.
  22. No golf cart/ATV speeding. Speeding is considered driving faster than a person jogging or staff’s judgement. Speeders will be asked to leave for the day with no refund, no warning.
  23. All golf cart/ATV riders must be seated. No hanging or standing on the back of a golf cart/ATV.
  24. Always part off to the side of the path, but on the path. Always leave room for others to pass safely.
  25. Never at any time is shooting live game permitted will shooting sporting clays.

I understand and agree that if I fail to follow these rules I may be suspended and/or lost privileges (including loss of membership). Any money spent will not be refunded if this should occur. I understand that if I or any minor I am responsible for damages to any property of The Farm, I am responsible for payment in full.

In consideration of Minor listed above being permitted to participate in this activity, I further agree to indemnify and hold harmless Releasees from any claims alleging negligence which are brought by or behalf of minor or are in any way connected with such participation by minor.
