Batting Cage Liability Waiver

I, hereby acknowledge and agree to the following terms and conditions in consideration of being permitted to use the batting cage facilities provided by Boston Bowl:

  1. Assumption of Risk: I understand and acknowledge that the use of batting cage facilities involves inherent risks, including but not limited to the risk of bodily injury, property damage, or death, and I voluntarily assume all such risks.
  2. Release and Waiver: I hereby release, waive, discharge, and covenant not to sue Boston Bowl, its owners, employees, agents, and affiliates (collectively referred to as "Released Parties"), from any and all claims, demands, damages, actions, or causes of action arising out of or relating to any loss, damage, or injury, including but not limited to bodily injury, disability, death, property damage, or any other harm, whether caused by the negligence of the Released Parties or otherwise, while participating in or using the batting cage facilities.
  3. Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all liabilities, claims, damages, costs, or expenses (including reasonable attorneys' fees) incurred by the Released Parties in connection with any claim arising out of my use of the batting cage facilities or my breach of this waiver.
  4. Medical Treatment: In the event of an injury or medical emergency, I authorize the staff of Boston Bowl to administer or arrange for any necessary medical treatment for me.
  5. Severability: If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  6. Governing Law: This waiver shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.

I have read this waiver and fully understand its terms. I voluntarily agree to be bound by its terms and conditions.
