LIL SLICE A HEAVEN – LIABILITY WAIVER AND RELEASE FORM

Venue Location: 135 Tanning Rock Trail, Green Mountain, NC 28740

Property Description: Riverfront venue, cabin rentals, glamping sites, stage, and event spaces along the Toe River.

Please read this document carefully. By signing this document, you are waiving certain legal rights, including the right to sue Lil Slice a Heaven, its owners, operators, and affiliates, for injuries or damages sustained on the property.

1. Acknowledgement of Risks

I understand and acknowledge that visiting Lil Slice a Heaven involves inherently risky outdoor environments and activities. These risks include, but are not limited to:

  • Water Hazards: Drowning, strong currents, slippery rocks, and changing water levels of the Toe River during swimming, wading, fishing, or tubing.
  • Natural Terrain: Uneven ground, steep banks, falling branches, exposed roots, and unpredictable weather conditions typical of Green Mountain, NC.
  • Amenities: Risks associated with utilizing the hot tub, outdoor kitchen, open fire pits, stage area, and pub-style games.
  • Wildlife: Potential encounters with insects, snakes, and other local wildlife.

2. Assumption of Risk

I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury (including death) that may be sustained by me, or any loss or damage to property owned by me, as a result of being on the property or participating in activities, whether caused by the negligence of the Releasees (defined below) or otherwise.

3. Release and Waiver of Liability

In consideration for being permitted to access the venue, stay in the accommodations (including cabins and glamping tents), and use the facilities, I hereby release, waive, discharge, and covenant not to sue the property owners (Marshall Clark Johnson and Mary Kathryn Johnson), operators, employees, and agents (collectively referred to as "Releasees") from any and all liability, claims, demands, or actions arising out of any loss, damage, or injury, up to and including death, that may be sustained by me or my property.

4. Indemnification

I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs (including court costs and attorney fees) that they may incur due to my presence on the property, whether caused by my negligence, the negligence of the Releasees, or otherwise.

5. Safety Rules & Property Policies

  • ** Supervision:** I agree that I am solely responsible for the safety and supervision of any minors in my care, particularly near the river and fire pits.
  • Alcohol & Conduct: I accept full responsibility for the consumption of alcohol by myself or my guests and agree to maintain responsible conduct.
  • Fire Saftey: Fires are restricted to designated fire pits, and I agree to completely extinguish all fires before leaving them unattended.

6. Governing Law

This agreement shall be governed by, and construed in accordance with, the laws of the State of North Carolina. If any portion of this waiver is deemed void or unenforceable, the remaining sections will continue in full legal force.
