Recreational Activity Release of Liability, Waiver of Claims, Express Assumption Of Risk and Indemnity Agreement

Express Assumption of Risk Associated with Recreational Activities.

I do hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associatedwith the recreational activity generally described as "Airsoft" including the rental of equipment and transportation associated therewith of which I am about to engage in. Inherent hazards and risks include but are not limited to:

  1. Risk of injury from the activity and equipment utilized is significant including the potential for permanent disability and death.
  2. Possible equipment failure and/or malfunction of my own or others equipment.
  3. This activity takes place indoors and therefore includes risks associated with man-made structures.
  4. My own negligence and/or the negligence of others, including but not limited to operator error and guide decision making including misjudging distances, walls, hallways and open areas.
  5. Fatigue and/or dizziness, which may diminish my/our reaction time and increase the risk of accident.

*I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.


Release of Liability, Waiver of Claims and Indemnity Agreement

In consideration for being permitted to participate in the activity(ies) described above the related activities, I hereby agree, acknowledge andappreciate that.

  1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named persons or entities, herein referred to as Releasees "Nashville Airsoft and Breeze Kline LLC/Nashville Fun for Familes, during Nashville Nerf Wars"
  2. To release their officers, directors, employees, representatives, agents, and volunteers from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personalinjury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the Releasees or otherwise. By executing this document, I agree to hold the Releasees harmless and indemnify there in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.
  3. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the Releasees, other thanwhat is set forth in this Agreement.

This release shall be binding to the fullest extent permitted by Tennessee law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforced.

I agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Davidson County, Tennessee.

I hereby consent to and authorize Nashville Airsoft to use any and all photos, video recordings or testimonials (written word) taken of me or my child for marketing purposes.

Nashville Airsoft Field Rules

  1. All players are required to wear full seal goggles with mouth protection. A split system of a full seal goggle and a mesh lower mask is allowed.
  2. Removal of your mask, while on the field, for any reason,  will result in you being ejected from the field with no refund given.
  3. Barrel socks are required on all replicas until instructed to remove them by the referee or staff. 
  4. While in the safe zone, you MUST have your magazines out, your safety on and a barrel sock on the barrel. Sidearms should be holstered, mags removed, and with the safety on.
  5. Shooting is not allowed in the safe zone. This includes any test firing, dry firing, or unloading.
  6. Do NOT point your replica at anyone unless you are participating in a game on the field and intend to shoot them.
  7.  If another player removes or is not wearing proper eye protection, you are not allowed to shoot them. Immediately stop shooting, call "Blind man", and notify the nearest field employee or referee.
  8. Intentional shooting of the referees will result in your ejection from the field with no refund given.
  9. Arguing with the referee will result in your removal from the game. If you have issue with a call the referee made, contact the lead referee or field manager after the game has ended.
  10. Drugs and alcohol are not permitted on premises.
  11. Real weapons and/or knives are not permitted at any game.
  12. Replicas are to be stored and carried in bags, boxes, or cases except when in the staging or play area. 
  13. High pressure air (HPA) powered replicas require a tournament lock.
  14. All replicas are required to pass a chronograph test - every game day. You are not allowed to use a previous chronograph reading on a different day. 
  15. Players are subject to spot chronograph readings on and off the field at the referees discretion.
  16. If a player is caught attempting to use a replica that hasn't been chronographed, has been tampered with after chronographing, or had been temporarily modified to "cheat" the chronograph, they will be removed from the field with no refund. 
  17. Airsoft is an honor based game. Calling hits is necessary to the fun of airsoft. If you are caught not calling your hits by a referee, you will be sent back to respawn. Repeated not calling of hits can result in your removal from the game or the field with no refund. 
  18. Do not yell at other players to call their hits. If you think another player is intentionally ignoring hits, find a referee and alert them immediately. 
  19. If you feel that a player is shooting a gun that exceeds chronograph limits, find a referee and tell them. 
  20. Friendly fire does count!
  21. Any grenades must be approved by the Arena Manager.
  22. Tossing grenades (or anything) over walls is not allowed.
  23. Climbing is not allowed.
  24. If you see a frog on the field, you must return it safely to the river.
  25. You must be able to see and be seen to be able to shoot. Blind firing is not allowed.
  26. Fireworks are not allowed. This includes any homemade grenades, pyro, smoke grenades, or other explosives.
  27. Safety kills are not required but are recommended. Players are only given the option to offer (and accept) safety kills. 
  28. No open-toe shoes.

**Type of clothing is at player discretion. Nashville Airsoft recommends long sleeves and pants. Shorts and t-shirts are allowed but not recommended.**

Joule Rating: 1.50 Joules (400 with .20g)

For Participants of Minority Age, this is the clarify that I, as Parent, Guardian, Temporary Guardian with legal responsibility for this participant, do consent and agree not only to his/her release of all Releasees, but also to release and indemnify the Releasees from any and all liabilities incident to his/her involvement in these programs for myself, my heir, assigns, and next of kin.
