By indicating your acceptance to this waiver and release, you understand, agree, warrant as follows: ~~Utah Sports Lodge, LLC (USL) ATHLETIC WAIVER AND MEDICAL RELEASE
In consideration of participant being permitted to use the facilities at the Utah Sports Lodge (USL) in any capacity you certify that if a child is under the age of 18 or is an incapacitated adult, that you are the parent or legal guardian of said participant and that you have full legal authority to enter this agreement on their behalf which the terms of this waiver and agreement shall apply to all registered parties equally. You acknowledge that by singing this electronic agreement that you accept full responsibility for and in behalf of said participant to which you represent and agree to the terms and conditions contained herein. If you are registering a child that is under the age of 13, you consent and agree to the collection of that child's information for the purpose of registration.
1- Participant(s) or legal guardian(s) of a minor participant agrees that prior to participating in any event or use of the facility; that you will inspect the USL facility, field(s) and or equipment to be used. If you believe anything to be unsafe, you will immediately advise a USL Staff member, trainer or the attending field monitor of such condition(s) and refuse to participate. If you or the participant(s) to whom you represent choose to participate with such risk(s) you acknowledge that you accept these risk and will take full responsibility for continued participation. 2-Athletic activity field locations at the Utah Sports Lodge are as follows: Turf field, Grass field, Beach Soccer field, Turf Agility Field, concrete rebound wall and Indoor work-out/training room. It is understood that sporting events and other related activities held at the Utah Sports Lodge are by their nature inherently dangerous and that said participant should not participate unless they are medically able, wear the proper protective equipment/gear and are properly trained to do so. You acknowledge and accept these risks should participant engage in any type of activity. It is also understood that participation in any type of event at the Utah Sports Lodge carries with it certain inherent risks that cannot be eliminated completely and may involve unforeseen or unknown hazardous conditions and or risks. You acknowledge that the playing area (field of play) is limited to other participants, referees and equipment used for said event. The surrounding area (outside the field of play) may include but is not limited to spectators, walls, fences, goals, nets, doors, power boxes, light poles, benches, vehicles and other equipment. By accepting this agreement you acknowledge and accept such conditions. Participant agrees to play in a controlled manner within the designated inside bounds of the field of play or activity. It is also understood that participants will be engaging in strenuous physical activities that may involve risk of serious injury, permanent disability, sever social or economic loss or death. You further acknowledge that injury or loss may result from you or others actions, inactions or negligence. As a participant (or legal guardian representing said participant) you accept and agree to assume all risks to body, life, limb and property as well as all financial liabilities that may incur from participating in any type of event whether sponsored or non-sponsored by the Utah Sports Lodge. You along with any registered party, heir(s), personal representative(s), or assigns of you or the registered party do herby waive, discharge, release and promise under covenant not to sue the Utah Sports Lodge or any of its subsidiaries, owners, employees, contractors, volunteers for any and all liability from any and all claims arising from participation in any event held or Sponsored by the Utah Sports Lodge.
If you are a participant or spectator in any type of rental(s), league(s) or tournament(s) at the Utah Sports Lodge, individual players and their families must obtain and provide their own insurance and or accident policy which will cover the participant and or spectator(s) should they be injured or receive harm in any way while participating or observing at the Utah Sports Lodge facility. Individual players and or their parents/guardians assume all risk and liability while participating in rental(s), league(s) or tournament(s) or any event whether sponsored or non-sponsored by the Utah Sports Lodge.
3-You certify that participant(s) and parent/legal guardian have read the rules and regulations of the Utah Sports Lodge which are contained in this agreement and can also be found at www.utahsportslodge.com and as the participant and legal guardian do agree to abide by them. You acknowledge and agree to release, indemnify, and to hold harmless The Utah Sports Lodge and its event hosts, officials, sponsors, coaches, referees, employees, volunteers, owners, landowners and/or representatives from any claim(s) or demands including reasonable attorney's fees arising from any participant(s). As a Utah Sports Lodge participant you (& the legal guardian) assume all risk and liability on and off the field of play including but not limited to the parking lot, restrooms, lobby, office and all other areas at the Utah Sports Lodge for said participant & parents/guardian(s) while at the Utah Sports Lodge.
4-In the event that a participant sustains injury or illness while participating at the Utah Sports Lodge you agree to notify a Utah Sports Lodge staff member immediately. You further authorize emergency first aid, medication, surgery or any type of medical treatment necessary by qualified or licensed medical personnel to sustain the health, life and limb of said participant.
5-Participant and the parent/legal guardian agree to give consent and allow your image, voice or likeness thereof to appear in any official or non-official documentary, promotion, marketing or media coverage through the use of print, television, radio, web, film or other forms of media outlet without any compensation or recourse whatsoever. You also agree to email communication from the Utah Sports Lodge, and its associated affiliates and or partners.
6-You agree that this Waiver, Release and Agreement is considered to be a legal and binding document and is intended to be as broad and inclusive as is permitted by law. This Wavier, Release and Agreement must be renewed annually for authorized and continued use of the Utah Sports Lodge facility and its events. If any provision of this Waiver, Agreement and Release shall be found unlawful or for any reason deemed unenforceable, then that particular provision shall be deemed severable from this Wavier, Release and Agreement and then in turn shall not affect the validly and enforceability of any of the remaining provisions contained therein. In such circumstances/situations you hereby agree that the liability and financial responsibility first and for most falls upon the individual (parent/guardian) and their personal resources, next their own insurance policy (as required by this agreement), and finally their team, club, group or association to which they belong and its policies.
7-You agree to submit this Waiver, Release and Agreement via electronic signature and that it will be considered legal and binding. You acknowledge and agree that this must be filled out and submitted by you as the legal and authorized individual agent, parent or legal guardian and that you will not allow or permit any other person or individual to act in your behalf except as legally permissible. At the time of this singing you may print out a copy of this Waiver, Release and Agreement. You may also see a copy at www.utahsportslodge.com or request a copy at any time. By indicating your acceptance of this Agreement, Waiver and Release, you acknowledge that you have read and understand this Waiver, Release and Agreement and that you fully understand the terms and conditions contained therein. You understand that you are giving up substantial rights including the right to sue and that you do this voluntarily of your own free will and volition. This Waiver, Release and Agreement is intended to be a complete and unconditional release of all liability to the greatest possible extend allowed by law. Your waiver must be agreed to and signed annually for continued use of the USL facility. The Utah Sports Lodge, LLC (USL) is a private member based sports facility. It is designed for the young and old, serious and casual athlete of a variety of sports. USL reserves the right to refuse or deny service and use to anyone for any reason.
All guests and participants of the USL Facility must observe the following rules, policies, procedures and conditions:
1-USL is under constant video surveillance.
2-All participants (Anyone on the field or directing those on the field: coaches, trainers, players) using the USL facility must be an invited guest with a signed guest waiver or registered member and must renew their membership annually.
3-Single use participants or their guardians must fill out a “guest waiver” form found at www.utahsportslodge.com Memberships:
USL Memberships are required unless otherwise specified by all users of the USL facility excluding guests who use the facility less than two days in a 6 month period for a tryout, camp or other single use event. Memberships run as follows:
1-Summer April –September
2-Winter October – March
3-Annual 12 month membership from time of purchase
$36 * Winter Membership Youth-Adult Required by all participants with winter rental time Oct. – March (6 month winter pass)
$60 * Summer Membership unlimited Open Play or use Pass (April – September)
$120 * Winter Unlimited open play membership (during open play days/times)
$150* Unlimited Open Play for a 12 month period from the time of purchase to be used anytime the field is not being used in the dome or out on the open field which includes open play days/times as listed for youth and adult.
*April – September Unlimited open play Monday - Saturday Weather permitting the turf field and grass field may be used anytime from dawn-dark. Excluding scheduled or special events, maintenance or the setting up or taking down of the dome.
*Oct. - March in the dome general open play times 6:00am – 4:00pm & 9:00pm – 11:30pm Open play is on a first come first share basis. USL reserves the right to change or limit open play days & times based on the number of attending participants, special events and or USL scheduling. Additional fees apply for Rentals, Leagues, Tournaments and Camps. All Members (coaches, trainers, players) must check in prior to each use or event. USL participant registration card is included in the initial registration. All replacement cards are $5. USL issued ID cards belong to the individual and remain the property of USL and may be revoked at our discretion without refund at any time.
USL Rules:
All Participants must agree to the following:
1-Fighting is not permitted and may be cause for permanent expulsion without refund and a fine of up to $250
2-Gum and seeds of any type, are not permitted on the Turf Field. Individuals will be responsible for any mess or damage they may cause.
3-If you bring an animal you accept full responsibility for their actions; you are responsible to clean up after your animal.
4-Do not jump the fence; hang on cables, nets, goals or any other equipment.
5-Do not stand on the rubber sock surrounding the turf field.
6-No one is permitted in the training room without a USL approved coach, trainer or other adult. USL guests or athletes or legal guardians assume all risks when using USL training facility and equipment.
7-Alcohol, drugs and smoking are not permitted anywhere on the USL site.
8-Foul language, poor sportsmanship and mean spirited conduct are not permitted.
9-Referees have jurisdiction over USL league and tournament games. All other games, scrimmages, pick-up games and training not organized or monitored by USL are to be self-governed by individual players, coaches, trainers and or parents who accept responsibility for the conduct therein.
10-Proper equipment and safety gear must be worn at all times when participating on the field of play.
11-Field training and game equipment must be checked out and returned upon completion.
12-Reckless or uncontrolled behavior is prohibited. Individuals are responsible for any injury or damage they may cause to themselves or others.
13-Exit doors are never to be opened in the Dome except in an emergency or as directed by a USL Staff member.
14-All Sales for rentals, leagues, tournaments, camps, events and any other activities are final and without refund for any reason.
15-General Conduct beyond those listed are to be governed by common sense, and general courtesy. Please report any suspicious activity or nefarious conduct immediately to USL staff member or law enforcement.
Our Primary source of communication is via email. Waiver must be filled out and signed online by a parent or legal guardian if under 18. You must provide a valid email address so we can keep you up to date on all of our leagues, tournaments, camps, rentals, other events as well as reschedules, cancelations waiver and legal updates. Do not provide an email address for anyone under the age of 13. If you do not wish to receive email updates you will have the option to opt out at any time. By providing an email you agree to receive emails from the Utah Sports Lodge and our partnered affiliates.
Failure to abide by any of these policies may result in a fine of up to $250, expulsion and or permanent ban from the USL Facility. You acknowledging that you are of legal age or the parent/guardian of said minor participating at the Utah Sports Lodge (USL) and understand that checking "I agree/accept" and or typing/signing your signature constitutes your digital signature and agree to the terms and conditions of this digital waiver and release. You also acknowledge that it will be recognized as a legal and binding contract. If you do not agree you as the individual and or minor to whom you represent are not authorized to use or participate in any type of event at the Utah Sports Lodge Facility.
Players & Spectators should take special care when at the Utah Sports Lodge. Parents must keep young children and babies with them at all times and behind the safety nets. Do not let them use the revolving door without your help; do not let them play in the door. When entering and exiting the dome use extreme caution when using the revolving door. Enter and exit very slowly always looking out for children and others who may be on the other side. Take note that there is a landing at the revolving door and you must make a step up or down to enter or exit the dome. The landing is outlined in yellow. Please assist elderly and young children. Wheelchairs can enter through the green double emergency doors with the help of a USL staff member.
All sales, registrations, rentals, leagues, tournaments & other use are considered final and without refund for any reason to the paying individual, team or group with the following exceptions listed below.
The following exception will apply for credit or refund of fees:
- Should the facility be deemed unusable by fire, flood, earthquake, wind, unforeseen or uncontrollable events or circumstances, the Utah Sports Lodge will issue a credit for unused time that may be used at another time or location.
-The Utah Sports Lodge will issue a refund if it was unable to provide a Rental Time, League or Tournament Bracket after payment was received (online or credit card Processing Fees cannot be refunded). Note: USL does not guarantee league & tournament days, times and opponents nor that the opponent in a league/tournament games will not forfeit their schedule game(s). USL cannot take scheduling requests and therefore these are not valid reasons for a refund. In some instances/circumstances (at the discretion of USL) additional league games, tournament games, rental times or other use may be given in place of refunds to accommodate a scheduling error, no-show by opposing team or referee or other issue.
The Utah Sports Lodge, LLC (USL) reserves the right to cancel or terminate rentals, leagues, tournaments, special events, open play or any other use at any time for any reason without recourse by the using party and offer a refund of the remaining balance for unused time to which they paid. Bubble Balls:
Waiver and Release The Utah Bubble Balls Assumption of Risk and Warning of Risk Waiver and Release of Claims ("Assumption & Release") Please sign to indicate your agreement to each of the following: 1. I understand that participating in Utah Bubble Balls is a potentially hazardous activity. 2. I agree not to participate unless I am medically and physically able, which I am solely responsible to determine. 3. I agree to abide by any decision of an official relative to my ability to safely complete the race, which decision is at the sole discretion of the race official and I agree lack of a decision does not create any liability whatsoever. 4. I assume all risks associated with competing in Utah Bubble Balls, including, but not limited to, slips, falls, contact with other participants, negligent or wanton acts of other participants, any defects or condition of premises, or color zones, the effects of the weather including high heat, cold temperatures, storms and/or humidity. All such risks being known, assumed and appreciated by me. 5. I consent to emergency medical care and transportation in order to obtain treatment in the event of injury to me as medical professionals may deem appropriate. This Assumption and Release extends to any liability arising out of, or in any way connected with, the medical treatment and transportation provided in the event of an emergency. 6. I understand and agree that pets are not permitted to accompany me in Utah Bubble Balls, and children under the age of 12 are not permitted to participate or accompany me in the league unless a parent or guardian signs a waiver on their behalf. 7. Participants are expected to exhibit appropriate behavior at all times, including obeying all laws. This includes respect for all people, equipment and facilities and cooperative, positive participation. Utah Bubble Balls may dismiss, without refund, anyone whose behavior endangers safety or negatively affects Utah Bubble Balls, a person, a facility or property of any type or kind. 8. I agree to indemnify Utah Bubble Balls, its affiliates and assigns, from any and all third party claims caused in whole or in part by my actions. 9. I assume risk of wild animals and insects that may be present on the field. All Participants Waiver & Release of all claims and assumption of risk I recognize and acknowledge that there are certain risks of physical injury to participants in Utah Bubble Balls, and I voluntarily and knowingly agree to assume the full risk of any and all injuries, damages or loss, regardless of severity, that I may sustain as a result of said participation. I further agree to waive and relinquish all claims I may have (or which may accrue to me) as a result of participating in these activities against Utah Bubble Balls including its owners, managers, officers and employees, the officials, agents, volunteers, sponsors, and the owners and operators of the venue (hereinafter collectively referred to as "Administrators"). Participants registering for Utah Bubble Balls’ programs/activities must recognize that there is an inherent risk of injury when choosing to participate in recreational activities/programs. I agree that I am solely responsible for determining if I am physically fit and/or skilled for the race or activities contemplated by this Assumption and Release. It is always advisable, especially if the participant is pregnant or disabled in any way or recently suffered an illness, injury or impairment, to consult a physician before undertaking any physical activity. I, for myself and my heirs, do hereby fully release and forever discharge the Administrators from any and all claims for injuries, including death or incapacity, illnesses, damages, expenses or loss that I may suffer arising out of, connected with, or in any way associated with the race, program or activities including injuries caused or associated with transportation to and from the event. I have read and fully understand the above important information, warning of risk, assumption of risk and waiver and release of all claims. Utah Bubble Balls is authorized to use any photographs, motion pictures, recordings or any other record of this event for any purpose including, but not limited to, promoting, advertising and marketing purposes. Any and all photographs, motion pictures, recordings or other records of the event are the sole property of Utah Bubble Balls. Signee is the legal representative for the participant/minor who is participating in this activity. On behalf of the participant/minor, the signee assumes any liability associated with using the bubble ball.
