Today's Date: July 26, 2024 1. Compliance with Rules:
I understand that my First Fitness, Inc. 24 hour membership can be taken away immediately by the manager for violation of the rules of the fitness center. A full copy of the rules for the fitness center is posted at the fitness center. As a member of First Fitness, Inc., I agree to abide by all of the membership rules, including the 24 hour rules listed below, which are also posted at the fitness center. Said rules may be amended from time to time in the sole discretion of First Fitness, Inc. The additional rules that apply to the 24 hour membership are: A. No guests can attend with you without prior approval.
B. Only one 24 hour member may enter the fitness center front door at a time. Every member that enters after staffed hours must register their entry by swiping their personal 24 hour membership card.
C. Card sharing is strictly prohibited and will result in a loss of membership.
D. 24 hour members under 18 must be accompanied by a parent or guardian between the hours of 10 PM and 5 AM
E. Only the front door can be used to enter and exit the fitness center, except in case of emergencies.
F. Any lost or stolen cards must be reported to the manager immediately.
G. Any lost or stolen card will result in a $10.00 charge for card replacement. I agree that improper unauthorized use of the fitness center may result in membership suspension or cancellation. I agree not to let anyone use my card for any reason. I agree to report any situation that appears to be card sharing to the manager. First Fitness, Inc. reserves the right to suspend or cancel the rights, privileges, and membership of any member who jeopardizes the use, safety, and enjoyment of the facilities. 2. Refunds and Failed Payments:
I understand that no refunds will be given for pre-paid or recurring memberships. Recurring memberships must be cancelled prior to the monthly payment date. No refunds will be issued for memberships cancelled on or after the monthly payment date. Failed payments may result in restricted 24 hour access. All failed payments will be automatically applied to the next renewal date for recurring memberships.
3. No Supervision:
I understand that I am purchasing a 24 hour membership at a fitness center that allows access at any time. I am aware that there will be NO SUPERVISION OR ASSISTANCE EXCEPT DURING STAFFED HOURS. Staffed hours may change solely at the direction of First Fitness, Inc. I am aware that if I become injured, become unconscious, suffer a stroke or heart attack, or any other medical emergency that there will likely be no one to respond to my emergency and that First Fitness, Inc. has no duty to provide assistance to me while I am at the fitness center. I understand that even though the fitness center is equipped with surveillance cameras, help will not be available during non-staffed hours. 4. Tanning: 1. AVOID OVEREXPOSURE. As with natural sunlight, overexposure can cause eye and skin injury and allergic reactions. Repeated overexposure may cause photoaging of the skin, dryness, wrinkling and in some instances skin cancer. We recommend that you do not tan outdoors on days you are tanning indoors, that you do not tan if you currently have a sunburn and you, at most, do not tan more than once in a 24 hour period. 2. CERTAIN MEDICAL MEDICATIONS, lotions and other products may cause your skin to be more sensitive to UV Rays. Check the posted list of drugs and products known to increase the photosensitivity of the skin. Check with your physician or pharmacist if you are unsure about any medications you are taking or if you have had a problem with indoor or outdoor tanning in the past. 3. WEAR PROTECTIVE EYEWEAR. Failure to wear protective eyewear may result in severe burns or long-term injuries to the eyes. 4. Consumers should report to the agency any injury for which medical attention was sought or obtained resulting from the use of registered tanning equipment. This report should be made within five working days. 5. Observe all posted rules. I have read the contents of this consent form carefully and state that I am not aware of any medical condition or other reason that would prohibit me from tanning. I understand that I will not be allowed to exceed the maximum allowable time posted on the tanning device. I have been given adequate instructions for the proper use of the tanning equipment, understand the risks involved, and use it at my own risk. 5. Acknowledgment of Risk and Waiver of Liability:
I voluntarily assume the risk of injury, accident, death, loss, cost, or damage to my person or property which might arise from my use of First Fitness, Inc. I agree to hold harmless and release First Fitness, Inc. and all affiliated entities, its officers, directors, board members, managers, members, employees and representatives from any and all liability which may occur, regardless of negligence, as a result of a) use of all amenities and equipment in the fitness center, and participation in any activity, class, program, personal training or instruction, b) the sudden and unforseen malfunctioning or any equipment, and c) slipping and/or falling while in the fitness center, including any adjacent sidewalks and parking areas. I agree to voluntarily give up or waive any right that I, my successors, heirs and assigns may have to bring a legal action against First Fitness, Inc. for negligence, personal injury, or property damage. This contract represents the complete understanding between myself and First Fitness, Inc. No representations either written, oral, other than those contained herein are binding upon the parties hereto. Should any part of this agreement be found by a court of law to be against public policy or in violation of any state statute or case, then only that wording is removed, and the remainder of this agreement will remain in full force and effect.
