The Weekend PE Assumption of Risk and Warning of Risk Waiver and Release of Claims

("Assumption & Release") Please sign to indicate your agreement to each of the following:

PARTICIPANT RELEASE, WAIVER OF LIABILITY,

ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

 

PLEASE READ THIS ENTIRE DOCUMENT CAREFULLY BEFORE SIGNING. THIS IS A LEGALLY BINDING AGREEMENT THAT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING BELOW, YOU AGREE TO GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

 

1. PARTIES TO THIS AGREEMENT

This Release, Waiver of Liability, Assumption of Risk, and Indemnification Agreement ("Agreement") is entered into between:

 

Weekend PE, LLC (or its applicable legal entity) (“Company”), including its owners, officers, directors, members, shareholders, employees, agents, volunteers, successors, heirs, assigns, affiliated entities, event venues, and partner organizations; AND

 The individual signing below ("Participant"), or the parent/legal guardian signing on behalf of a minor participant.

2. DESCRIPTION OF ACTIVITIES

Participant desires to participate in one or more activities organized, hosted, or facilitated by Weekend PE, LLC which may include but are not limited to:

• Party events, themed social gatherings, and group celebrations

• Sports and athletic recreation (e.g., flag football, soccer, volleyball, kickball, relay races, obstacle courses)

• Fitness and exercise classes, boot camps, or drills

• Team-building games and competitive recreational activities

• Any activities held at third-party or rented venues, parks, fields, or facilities

These activities are collectively referred to herein as the "Activities."

3. ASSUMPTION OF RISK

Participant acknowledges and understands that:

• Physical activity carries inherent risks, including but not limited to sprains, strains, fractures, bruises, cuts, cardiac events, heat-related illness, concussion, permanent disability, and in extreme cases, death.

• Risks may arise from the actions of other participants, uneven terrain, weather conditions, equipment failure, venue conditions, or unforeseen circumstances.

• Weekend PE, LLC may not be able to anticipate or prevent all risks associated with the Activities.

• Participation is voluntary. Participant is not required to participate and does so of their own free will.

 

PARTICIPANT EXPRESSLY AND VOLUNTARILY ASSUMES ALL RISKS, KNOWN AND UNKNOWN, ARISING FROM PARTICIPATION IN ANY WEEKEND PE ACTIVITY.

4. RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in Weekend PE Activities, Participant, on behalf of themselves and their heirs, personal representatives, executors, administrators, and assigns, hereby RELEASES, WAIVES, DISCHARGES, and COVENANTS NOT TO SUE:

 

Weekend PE, LLC, its current and former owners, principals, members, officers, directors, employees, agents, contractors, volunteers, insurers, successors, heirs, and assigns (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, judgments, damages, expenses, and costs, including attorneys' fees, arising out of or related to:

• Personal injury, bodily harm, illness, or death

• Loss, damage, or theft of personal property

• Any negligent act or omission by the Released Parties

• Conditions at any event venue or activity site

 

This release applies to claims arising by the Released Parties. Nothing herein is intended to release claims resulting from gross negligence or willful misconduct. 

5. INDEMNIFICATION & HOLD HARMLESS

Participant agrees to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from and against any and all third-party claims, liabilities, damages, losses, costs, and attorneys' fees arising out of or relating to:

• Participant's participation in Activities

• Participant's breach of this Agreement

• Any injury caused by the Participant to a third party during Activities

• Any property damage caused by the Participant at an event venue

6. MEDICAL AUTHORIZATION & HEALTH DISCLOSURE

Participant represents that they are in adequate physical health to participate in the Activities and are not aware of any condition that would make participation dangerous to themselves or others.

In the event of a medical emergency, Participant authorizes Weekend PE staff to contact emergency medical services and consents to emergency medical treatment being administered as deemed necessary by medical professionals. Participant acknowledges that Weekend PE is not liable for costs of any such treatment.

7. PHOTO, VIDEO & MEDIA RELEASE

Participant grants Weekend PE a non-exclusive, royalty-free, perpetual, worldwide license to photograph, film, and record Participant's likeness, image, and voice during Activities. Participant consents to Weekend PE's use of such content for promotional, marketing, social media, and general business purposes without additional compensation or further consent required. Participant waives any claims arising from such use, including claims related to misappropriation of likeness. If Participant objects to being photographed or filmed, it is Participant's responsibility to notify Weekend PE staff prior to the start of the Activity.

8. PARTICIPATION OF MINORS

If Participant is a minor (under 18 years of age), a parent or legal guardian MUST sign this Agreement. By signing, the parent/legal guardian:

• Consents to the minor's participation in Weekend PE Activities

• Executes this Agreement on behalf of the minor and assumes all obligations herein

• Agrees to indemnify Weekend PE for any claims brought by or on behalf of the minor

• Affirms they have the legal authority to enter into this Agreement on the minor's behalf

9. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by the laws of the State of Florida. Any disputes arising from this Agreement shall first be subject to good-faith mediation. If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and not through litigation in court, except where prohibited by law.

 

Participant waives any right to participate in a class action lawsuit or class-wide arbitration against Weekend PE.

10. SEVERABILITY & ENTIRE AGREEMENT

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior representations or discussions.

11. ACKNOWLEDGMENT

By signing below, Participant (or parent/guardian) acknowledges that:

• They have READ and FULLY UNDERSTAND this Agreement

• They have had the opportunity to ask questions and seek independent legal advice

• They are signing VOLUNTARILY and not under duress

• They are at least 18 years of age, or the legal parent/guardian of the minor participant

• This Agreement is binding upon them, their heirs, executors, and assigns
