By participating in an Escape Room, Puzzle Room, or any other activity hosted or arranged by Hint Hunter LLC d/b/a/ Hint Hunter (sometimes referred to herein as "RELEASEE"), and any related events and activities (the "EVENT"), the undersigned acknowledges and agrees that:

1. I represent that I am 18 years of age or older, and of sound mind, and excellent physical health, and that I am physically, mentally, and emotionally capable of performing the tasks and activities related to participating in an Escape Room event and other related events and activities hosted by RELEASEE AND AGENTS (as defined below). I further agree that if at any point I am not physically, mentally or emotionally capable of performing the tasks and activities related to volunteering for the RELEASEE AND AGENTS, that I will inform the RELEASEE and remove myself from participation.

2. The risk of injury from participating in activities for, with, or related to the RELEASEE is significant. I understand that this activity has potential inherent risks including but not limited to:

  1. Use of simple tools;
  2. Potentially moving or lifting objects of not more than thirty pounds;
  3. Mental stress and anxiety;
  4. Being in a small room for prolonged periods of time with up to 10 persons;
  5. Possibility of failure to escape the room in the allotted time;
  6. Ducking, bending, and crawling;
  7. Having too much fun.

3. I understand while participating in the EVENT, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose as determined at the sole discretion of the RELEASEE, and it's assigns.

4. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS involved with participation in an EVENT, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OR MISCONDUCT OF THE RELEASEE, its officers, officials, agents. and/or employees, other participants, advertisers, owners and lessors of premises upon which the EVENT and other related activities occur (collectively, "RELEASEE AND AGENTS") and assume full responsibility for my participation and activities; and,

5. I willingly agree to utilize the utmost care, and my own personal discretion while participating in activities for and/or related to REALEASEE AND AGENTS. If, however, I observe any unusual significant hazard during my presence or participation, I will bring such to the attention of the RELEASEE and RELEASEE's agents and remove myself from participation; and,

6. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS, RELEASEE AND AGENTS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OR MISCONDUCT OF THE RELEASEE AND AGENTS, OR OTHERWISE.

7. SEVERABILITY. I agree that should any part of this WAIVER AND RELEASE OF LIABILITY be determined to be illegal or unenforceable, all other provisions hereof shall be given effect separately therefrom and shall not be affected thereby. To the extent that a court determines that any provision herein is unreasonable in light of the circumstances, the court shall revise such provision in a manner that the court determines to be reasonable and to most clearly implement the intention of the provision and this document.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT. I FULLY UNDERSTAND ITS TERMS AND I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT; AND I HAVE SIGNED THIS DOCUMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT FROM ANY REPRESENTATIVE OF Hint Hunter LLC, OR ANYONE ELSE.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18): This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above (except that s/he is not 18 or older), and for myself, my heirs, assigns and next of kin, I release and agree to indemnify and hold harmless the RELEASEE AND AGENTS from any and all liabilities incident to my minor child's involvement or participation in the activities as provided above, EVEN IF ARISING FROM RELEASEE AND AGENTS NEGLIGENCE OR MISCONDUCT. I further agree that I WILL SUPERVISE THIS MINOR CHILD AT ALL TIMES while s/he is participating with and/or performing any activities related to RELEASEE AND AGENTS, and that I will not allow this minor child to participate with EVENTS of RELEASEE AND AGENTS while I am not actively supervising this minor child.
