RIVA ROW and LAKES EDGE BOAT HOUSE PET WAIVER OF RISK AND RELEASE OF LIABILITY

In consideration of being permitted to participate in any way in The Woodlands Township's and Riva Row and Lakes Edge Boat House kayaking and related activities ("Activities"), I, ("I," "me," "myself," "my"), as owner of the pet listed below ("Pet"), do hereby release and forever discharge as of the date hereof, The Woodlands Township, Riva Row and Lakes Edge Boat House, and their respective present and former agents, members, directors, officers, representatives, employees, successors and assigns (collectively, the "Released Parties") to the extent provided below:

  1. I understand that any and all injury or harm that may result to myself or my Pet from the Activities is my sole responsibility. I understand and agree that my Pet will remain on a leash at all times that I am participating in the Activities, including when my Pet is both inside and outside of the kayak, that my Pet will remain in any life vest provided by The Woodlands Township, and that, other than during loading and unloading, my Pet will remain in the kayak at all times and shall not be permitted to swim in the water. I fully and completely understand, have evaluated, and agree to voluntarily assume any and all inherent risks associated with the Activities, known or unknown, contemplated or uncontemplated, including, but not limited to, loss or damage to personal property, injury and possibly death to myself and my Pet and understand that participating in the Activities with my Pet may increase my inherent risk associated therewith.
  2. Knowing these inherent risk and dangers, I KNOWINGLY AND VOLUNTARILY RELEASE AND FOREVER DISCHARGE AND SHALL HOLD HARMLESS AND INDEMNIFY the Released Parties from any and all claims, controversies, actions, causes of action, cross-claims, counter-claims, demands, debts, compensatory damages, liquidated damages, punitive or exemplary damages, other damages, claims for costs and attorneys' fees, or liabilities of any nature whatsoever in law and in equity (all of the foregoing collectively referred to herein as the "Claims") related in any way to my participation in the Activities or caused in any way by my Pet.
  3. I represent that my Pet is fully vaccinated, in a condition to travel aboard a kayak, will not harm or injure any other person or pet and will not harm or damage any kayak, life vest, boating equipment or any other property belonging to Released Parties. I understand that I will be fully and wholly responsible for any damage or injury caused by my Pet.
  4. In signing this Release, I acknowledge and intend that it shall be effective as a bar to each and every one of the Claims hereinabove mentioned or implied. I expressly consent that this Release shall be given full force and effect according to each and all of its express terms and provisions, including those relating to unknown and unsuspected Claims (notwithstanding any state statute that expressly limits the effectiveness of a general release of unknown, unsuspected and unanticipated Claims), if any, as well as those relating to such other Claims hereinabove mentioned or implied.

MEDIA/PHOTO WAIVER: I hereby authorize and give my full consent to the Released Parties to take, copyright and/or publish any and all photographs, videotapes and/or film (the "Media") in which I, my child, and/or my Pet, may appear while participating in the Program. I further authorize the Released Parties to transfer, use or cause to be used, the Media in any exhibitions, public displays, publications, commercials, art and advertising purposes, without limitations or reservations.

BY SIGNING THIS RELEASE, I REPRESENT THAT I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE, AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW, AND AGREE THAT IF ANY PORTION OF THIS RELEASE IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
