Rental Agreement 

Credit Card Authorization Link for Damages & Direct Bookings


Beats Working LLC, dba BEATS WORKING VACATION RENTALS, and tenant/renter agree as follows:

Occupancy: Because providing fun, safe, and family-friendly vacations is our primary goal, BEATS WORKING VACATION RENTALS requires our renters to be responsible adults over the age of twenty-one (21); however, guests younger than twenty-five (25) need to have host approval. This requirement does not apply to parents traveling with children, but is targeted at young adults and teens trying to book a beach home without proper supervision. Reservations made under false pretenses will be subject to forfeiture of all funds paid.

Cancellation

Airbnb: Our cancelation policy for Airbnb bookings is STRICT. Guests may receive a full refund for cancellations made within 48 hours of booking, if the check-in date is at least 14 days away. A 50% refund will be issued for cancellations made at least 7 days before check-in. For cancellations made less than 7 days prior to the beginning date of the reservation, no refunds will be issued. Refunds will not be issued for late arrivals, early departures, or inclement weather conditions. 

That being said, life (and hurricanes) do happen. We do not allow guests in our rental homes during a named storm, as they obviously are not traveling with necessary preparations. In the event of a hurricane, refunds will be made if there is a mandatory or voluntary evacuation ordered by government authorities. Refunds will be granted from the day of issuance of the evacuation for the remaining nights left on the reservation.

If you have an extenuating life circumstance, we can either adjust your travel dates or issue a refund. We are a small business, and we are local residents in a small town. We take pride in building trusting relationships with all of our guests. We would never take advantage of one of our guests who was experiencing a crisis, and we trust they would never take advantage of us. However, we are also not an insurance company, and appropriate and affordable travel insurance can be purchased from third-party vendors. As things come up, it is important that we communicate accordingly and sometimes share the responsibility of any burdens. If you have any questions or concerns on this topic, please let us know.

Advance Rent Deposit: An advance rent deposit is required when placing your initial reservation. The rent deposit is equal to 50% of the reservation charges. The reservation balance, including lodging tax, is due in full at least sixty (60) days preceding check-in. Guests booking direct will receive an invoice via QuickBooks to make payment. We accept payment via ACH payment and major credit and debit cards. Bookings made via AirBnb and VRBO are subject to the payment schedule and terms set individually by those platforms.

Damages: The tenants are responsible for the care of the premises, appliances and furnishings, and for all damages caused by accidental, negligent, or wrongful acts by the tenant or tenant's guests. All reservations booked directly require a credit card to be held on file for a damage deposit. This credit card information is saved securely via QuickBooks, a PCI Compliant third party. At check-out, the home will be assessed for: damages to the property over and above normal wear and tear, late check-out, damaged linens, damaged or stained carpet or flooring, excessive cleaning needs due to untidy guests, and/or other breaches of this agreement. The tenants agree to reimburse BEATS WORKING VACATION RENTALS, for all losses, breakage, or damage that occurs during their stay.

Check-in/Check-out: Check-in is after 4 PM and check-out is before 10 AM. Parking on the property, the street, or the right-of-way is prohibited prior to the set check-in time and after the set check-out time. If a guest plans to request an early check-in or a late check-out, they need to ask before the day of check-in. We will do our best to accommodate all guests, but we cannot make any promises, especially during peak season.

Linens/Towels/Supplies: Linens, including beach towels, are furnished. Other than taking our beach towels to the beach, our bed and bath linens are not to be removed from the property. Missing or damaged linens and towels will be billed against the guest’s damage deposit. Please be advised that bloodstains, urine on sheets, etc, are also considered irreparable damage that will be charged against the guest’s damage deposit. A “starter pack” of supplies is provided, which includes: one toilet paper roll per bathroom, one hand soap per bathroom, and one paper towel roll in the kitchen. Trash bags, cleaning supplies, and basic detergents are generally stocked, though we do ask that our guests help us replenish these items as necessary. Guests are responsible for any additional supplies they may need for their stay.

Notice: The working conditions of the pools, hot tubs, golf carts, air conditioners, cable, internet, televisions, appliances, elevators, etc, are not guaranteed. There is no guarantee that the pools will be heated or in working order. No refunds or rate adjustments will be made for mechanical failures or malfunctioning equipment. These amenities are extras provided in addition to the home rental. We guarantee to make all efforts, to the best of our ability, to correct any and all deficiencies in conjunction with any third-party vendors or HOA that manage the services.

Property Entry: The owner or owner's agent (BEATS WORKING VACATION RENTALS) will not enter a home without prior consent from the guest, unless there is a clear and overwhelming safety or health violation. The home will be accessed for quarterly pest control, bi-annual HVAC servicing, and any other crucial maintenance issues. As always, you will be given prior notice before any technicians arrive. Occasionally, the property that you have rented may be for sale, and the property may need to be shown. We will coordinate with you to make sure this has minimal impact on your visit.

Rules and Regulations: The damage deposit may be forfeited, and the renter may be asked to vacate the property immediately with no refund, for a breach of this Agreement, which includes the failure to follow the rules set forth herein. Please read these rules carefully and discuss them with every renter and every guest. Many of the rules are very important safety issues. Your signature guarantees that you have fully read and understand the entire Agreement, including the following rules and regulations, and that you agree to comply with same:

1. This is a non-smoking property, and smoking is strictly prohibited inside the property. Any evidence of smoking (such as the smell of smoke, presence of any ashes, burns in furniture, etc.) in any room will result in forfeiture of the entire damage deposit, without exception. Additionally, do not leave your cigarette butts (or any other trash) on our beaches/mountains or on our property.

2. We do not allow parties or events at the home. Only the guests included in the reservation can occupy the home. Parties over the home’s maximum occupancy will be turned away upon arrival. Reservations made under false pretenses will be subject to forfeiture of all funds paid and/or immediate eviction.

3. Pets are not allowed in the property or on the site, even temporarily, unless approved by BEATS WORKING VACATION RENTALS. Any evidence of pets (such as pet hair, urine stains, fleas, etc.) will result in additional charges, no exceptions. The credit card you provided to BEATS WORKING VACATION RENTALS will be charged accordingly. 

4. Do not have or use fireworks, firecrackers, or fire pits on the property or on our beach. 

5. Do not leave your beach equipment on our beaches, on our property, on the side of the road, at the trash cans on the beach, or hanging out of our trash can as the waste management will not collect these items. Doing so will result in a loss of deposit. Items must be hauled away by you prior to departure. Drop off locations can be shared upon request. Doing so will result in a loss of deposit. If you want to donate an item to the house, please ask us before leaving it onsite. 

6. Do not leave windows or doors open while the air conditioner is on. This will cause the HVAC unit to freeze up and not work properly. Do not set the A/C below 72 degrees in the heat of the day; at night, do not set it below 68 degrees! If the unit freezes up due to misuse and/or disregard of these guidelines, the renter will forfeit their entire damage deposit and will also be charged the appropriate fees for all repairs and any excessive utility bills.

7. In the event that the police or sheriff's department is called to the property for any reason, including, but not necessarily limited to, excessive noise, domestic dispute, illegal drugs, underage drinking, etc., renters will be immediately evicted and will forfeit their entire damage deposit. There are no exceptions to this rule.

8. Maintaining control of the house keys is part of the Rental Agreement. Should a guest lock themselves out or lose the keys, the guest will be charged a fee. There is a $75 charge for BEATS WORKING VACATION RENTALS to get the guest back inside the house and a $200 charge if the guest loses the house keys.

9. Please only park in the designated parking area. Parking on the street, on the beach dunes, on the side of the mountain roads is prohibited and will result in being towed.

10. Please no illegal torrent downloads from the internet. We will pass all fines from the cable and internet company to the guests.

Please follow all posted pool and hot tub rules; these rules are located at pool and hot tub locations.

Limitations of Liability: To the maximum extent allowed by the law, the owner/host(s) or host's agent (BEATS WORKING VACATION RENTALS) is not liable for the renter’s property left behind or for any consequential, incidental, special, punitive, exemplary, or indirect damages from any cause whatsoever, regardless of whether they are foreseeable. The owner/host(s) and host's agent (BEATS WORKING VACATION RENTALS) in no way undertake any obligation or duty to provide any security and is not responsible for any loss or theft of the renter’s property.

Indemnification and Hold Harmless: The owner/hosts(s) of the property and the host's agent (BEATS WORKING VACATION RENTALS), do not assume liability for the loss, theft, damage or bodily injury (including death) to persons or their personal property. Renter(s)/Guest(s) agree to indemnify and hold the owner(s) harmless for any liabilities, theft, damage, cost, or expense whatsoever arising from or related to any claim, suit, or litigation that may arise out of or in connection with the renter’s use and occupancy of the rental property, including but not limited to claims for personal injury and/or property damage/loss.

Attorney's Fees: If the owner/host(s) or owner's agent (BEATS WORKING VACATION RENTALS) consults or engages legal counsel or a professional collection service, for collecting any amounts due, or to enforce any provision of this Agreement, Renter shall be responsible for all costs of litigation and/or collection in case of such, including actual attorney's fees.

Chargebacks: The tenants agree not to claim any chargebacks or credits from their credit card issuer for any fees charged to their credit card(s), including, but not limited to, advance rental payments, damage deposits, rental payments, taxes, or any additional fees for lost, stolen, or damaged items.

Waiver: The waiver by either party, hereto of a breach or any term or provision of this Agreement, shall not operate or be construed as a waiver of a subsequent breach of same.

Governing Law: This Agreement will be governed by and construed in accordance with the State of Alabama, without regard to the principles or conflict of laws. Each party consents to the exclusive jurisdiction of the courts located in the State of Alabama. Each party further waives any objection to the laying of venue for any such suit, action, or proceeding in such courts.

Invalid Provisions: If any provision of this Agreement is held to be illegal, invalid, or unenforceable under present or future laws effective during the term hereof, such provisions.
