Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement ("Agreement")

TODAY'S DATE: April 24, 2024

In lawful consideration of being permitted to voluntarily enter Reload Gun Range and all associated property ("RANGE") and use its facilities and/or equipment, for the purposes of shooting, target practice, training, observation, work, or recreation in any way or for any purpose; myself, and my guests, relatives, or personal representatives hereby abide by, and agree to the following:

I UNDERSTAND AND ACKNOWLEDGE THAT SHOOTING AND RELATED ACTIVITIES ARE INHERENTLY HAZARDOUS AND POTENTIALLY LIFE THREATENING. These activities involve known, unknown, and unanticipated risks that could result in damage or destruction of my property, physical or emotional injury, including paralysis or death to myself or others. These risks include, but are not limited to: being shot or shooting myself or others; total or partial loss of hearing and eyesight; burns; inhalation or other harmful contact with lead or other contaminants; and being struck by flying or falling objects. I am fully aware of the risks and hazards inherent in participating in any activities or events held at the RANGE.


I HEREBY ELECT TO VOLUNTARILY ENTER THE RANGE and engage in any/all activities therein, acknowledging the nature and present conditions and dangers of the RANGE facilities, equipment, and premises and further, I acknowledge that conditions and dangers may become more hazardous during the time in which I am on/in the RANGE or walking to and from thereof.


I HEREBY ASSUME ALL RISKS OF LOSS, DAMAGE, INJURY, OR DEATH that may be sustained while in or on the RANGE, including walking to or from vehicles, or on the premises in general, and I understand that such hazards and risks cannot be eliminated without compromising the essential qualities of the RANGE, it's facilities, equipment, premises, or environment.


I ACKNOWLEDGE THAT RELOAD, LLC MAKES NO WARRANTY AS TO THE DESIGN, MANUFACTURE, MAINTENANCE, CONDITION, OR FITNESS for any particular use or purpose of ANY RANGE facilities or equipment, including but not limited to: range equipment, firearms, ammunition, vision and hearing protection, or first-aid supplies.


I UNDERSTAND AND ACKNOWLEDGE THAT RELOAD, LLC, its owners, officers, management, employees, and representatives have NO DUTY OR LEGAL OBLIGATION TO UNDERTAKE FIRST AID or rescue operations or procedures in the event that ANY such physical or emotional injury, or property damage occurs. I acknowledge that any injuries received may be compounded or increased by rescue operations and procedures, whether negligent or otherwise, and I assume full responsibility thereof.


I WILL INSPECT THE RANGE FACILITY, immediately upon entering and continuously thereafter, and I agree that if I feel anything to be unsafe, I will immediately advise the officials or employees of the RANGE, and I will immediately leave and refuse to participate further in any such shooting, training, observation or related activities.


I AGREE TO ABIDE BY ALL RULES AND REGULATIONS, fire and safety requirements, and the direction of all employees, agents, officers of Reload, LLC and any/all emergency personnel. I acknowledge that I may be removed from the RANGE for failure to follow these Rules, Regulations, requirements or directives.


I EXPRESSLY AGREE TO HOLD HARMLESS Reload, LLC, its owners, officers, management, employees, and representatives, and to undertake to defend and to INDEMNIFY Reload, LLC from, ANY and ALL LIABILITIES, LOSS or DAMAGE OF PROPERTY, CLAIM OF INJURY, demands, expenses, counsel fees and costs, of whatsoever nature or kind BY ME OR MY RELATIVES, HEIRS, GUESTS, OR AGENTS, arising from the USE OF, EVENTS, or ACTIVITIES in/on the RANGE; whether caused by negligence of the staff, failure to act, negligent rescue or first aid operations, or otherwise. This Agreement shall extend to, and bind my next of kin, heirs, guardians, relatives, representatives, and assigns.


THIS AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY LAW. Both parties agree that if any paragraph or provision violates the law, is held to be invalid, void or unenforceable, the rest of this Agreement, Range Rules and Regulations, and Consent Form (when applicable) will remain valid and interpreted and applied to give maximum effect to the intent reflected herein.

This Agreement together with the Range Rules and Regulations and Consent Form (when applicable), represent the ENTIRE UNDERSTANDING between the parties and shall supersede any and all previous contracts, agreements, or understandings, written or oral, between the parties concerning the subject matter of this Agreement. This Agreement as well as any signed written amendments shall remain in full force and effect from the date of execution and ever after and shall be applicable to each and every occasion that I or my guests, relatives, or personal representatives enter the RANGE, use its facilities or equipment, or engage in shooting, training, observing or any related activities at the RANGE.

I understand and agree that Reload, LLC shall not be liable for any negligence whatsoever including the negligence of its employees, and I hereby, on behalf of myself, my family, invitees, licensees, employees, and permitees; release, discharge and acquit Reload, LLC for any and all claims for loss, damage or injury of any nature whatsoever to person or property resulting in any way from, or in any fashion arising from, connected with or resulting from occupancy of or use of the RANGE and property, whether caused by negligent acts of Reload, LLC, its agents or servants or otherwise, and I hereby further assume full responsibility for, and risk of, bodily injury or death, while in or upon the RANGE. I further waive for myself and my insurers, any and all right of subrogation that I may have against Reload, LLC.

I have read this Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement and I FULLY UNDERSTAND AND ACKNOWLEDGE the terms contained within. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS AGREEMENT, and I have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me in consideration of my signing this Agreement which I sign of my own free will. I further intend my signature to be a complete and unconditional release of all liability for Reload, LLC, and its owners, officers, management, employees, and representatives, to the greatest extent allowed by law.

 

RANGE RULES and REGULATIONS

TODAY'S DATE: April 24, 2024

GENERAL

1. ALWAYS WEAR EAR AND EYE PROTECTION WHILE IN THE RANGE.
2.Closed Toe Shoes must be wornon ranges at all times.
3. The partitions between the firing lanes are NOT BULLETPROOF!
4. NO SMOKING, eating or drinking while in the Range.
5. Consumption of alcohol or drugs prior to, or while at the Range, is STRICTLY PROHIBITED.
6. You must follow all Range Officer commands AT ALL TIMES.
7. Always report unsafe or suspicious behavior.
8. There are no pregnant women allowed in the range due to risk of lead exposure.
9. No children under Age 10 will be permitted in the range. All minors MUST be accompanied by a guardian AT ALL TIMES.
10. Never go forward of the firing line at any time, for any reason! Find a Range Officer to assist you with any dropped items.
11. No more than two people in a firing lane at any time. Only one person can shoot at any given time.
12. Do not change firing lanes.
13. You must always be attentive to the Range! Therefore cell phone calls and text messaging is PROHIBITED.
14. You agree to keep the facility free from unnecessary wear and tear, nuisance, or garbage while at the Range.

FIREARMS

15. TREAT EVERY FIREARM AS IF IT WERE LOADED!
16. Firearms will be kept in a case while transitioning from your vehicle to the Range, and back.
17. ACTIONS WILL BE OPEN AT ALL TIMES.
18. Guns will be kept unloaded until you are on the firing line, ready to shoot.
19. Remove the firearm from the case at the line, then place the case on the tables at the back of the range.
20. Guns shall be pointed in a safe direction (downrange) AT ALL TIMES.
21. Keep your finger off the trigger until you are ready to shoot.
22. Know your target and what is beyond your target at ALL times.
23. Ensure your gun is safe to operate. If you don't know, please ask.
24. If your firearm malfunctions. Place it down at the firing line, aimed downrange, and ask a Range Officer for assistance.
25. No rapid fire, shooting on the move, or firing from prone or kneeling positions. No drawing from a holster.
26. ALL firearms are subject to inspection by RELOAD staff at ANY time while on the premises.
27. Do NOT clean, repair, disassemble, or reassemble firearms while in the Range.
28. Load and unload firearms only at the firing line.
29. You will be required to show proof of legal authority to use ANY/ALL NFA firearms (including suppressors).
30. Fully automatic firearms are permitted on the 25-yard lanes with prior authorization.

AMMUNITION

31. Only factory produced ammunition is allowed in the Range. Hand-loads or private-loads are STRICTLY PROHIBITED.
32. Only full metal jacket/ball ammunition is allowed in the Range.
33. PROHIBITED AMMUNITION: RELOADS, BLACKPOWDER, wad cutters, incendiary, tracer, steel core, birdshot, armor piercing,
bi-metal, & steel penetrator (green tip). No Green Tip Ammo
34. Pistols and rifles up to .308 (7.62) are permitted on the 25-yard lanes.
35. Pistols up to .44 magnum are permitted on the 15-yard lanes.
36. Shotguns are allowed on the 25-yard lanes with buckshot or slugs only.
37. Rifles up .30-06 are permitted on the 100-yard lanes.
38. Rifles over .30-06 and up to .50 BMG are permitted on the 100-yard lanes with prior authorization.
39. Unspent ammunition is to be discharged or disposed of in the appropriate containers.

RELOAD, LLC reserves the right to refuse service to anyone at its discretion. The Range may be closed for maintenance, private parties, or special events at Reload, LLCs sole discretion.

I am not a prohibited person, nor am I disqualified or prohibited by any local, state or federal law, or court order from owning, using, possessing or handling firearms.

I UNDERSTAND that I have a responsibility to myself and others to use firearms safely and that I AGREE to follow ALL rules of firearms safety at all times while at the Range.

I agree, as a condition of this Agreement, to be familiar with and to obey ALL RANGE RULES and REGULATIONS as adopted, or amended from time to time. Upon request, a copy thereof will be provided to me. I shall be responsible for instructing my guests, family, licensees, employees and permitees to follow ALL RANGE RULES and REGULATIONS.

I UNDERSTAND AND ACKOWLEDGE that ANY violation of these Rules and Regulations will be cause for my immediate removal from the RANGE and the premises, and will result in prosecution by Reload, LLC and the state and federal authorities to the full extent of the law.  I agree, all damages to range are my responsability and will be held financial liable for any damage that occurs due to my negligent use of a firearm.
