WAIVER AND RELEASE OF LIABILITY FORM, and CODE OF ETHICS

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, The Free Movement Festival, or THESE CLASSES, Capoeira Batuque, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I certify that I am physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity.

In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: Free Movement Festival and Capoeira Batuque, (FMF&CB) and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers;

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

I acknowledge that FMF&CB and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

I acknowledge that this activity may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for volunteers.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

Every family has a CODE OF CONDUCT. This is ours. Please be mindful of all things below:


Mission


The objectives of Capoeira Batuque Tem Jogo Santa Ana/North Hollywood/Garden Grove are to share the art and the history of Capoeira; to recognize that Capoeira is an art created by enslaved Africans and marginalized people in Brazil, as a way to fight for freedom, maintain culture and identity, and for us, as a group and individually, to ensure that these values of resistance against injustice are reflected in our own solidarity with communities fighting for liberation. To this end, we work to maintain a healthy body, mind, and heart, and last but not least, we build community in this journey, based on empathy, care, and our shared values.


Values


Capoeira Batuque Tem Jogo commits to building a community where people of all ages, backgrounds, abilities, race, religion, citizenship status, socioeconomic status, sexual preference, and gender identities feel included, valued, and inspired to work toward a more inclusive and just future for all. Inside and outside of the roda, and training spaces, we train to empower each other and ourselves, build equity, converse and learn from one another, and develop skills and tools to identify and address injustice and breaches in care. We train to build strength, both in body and character; to increase confidence, both in physical ability and personal potential and to seek flexibility and resiliency, both in the roda and in life. 


As capoeiristas, we stand firmly with communities who are fighting for liberation including, but not limited to the people of: Palestine, DR of Congo, Sudan, all Black and Indigenous communities of the Americas, Yemen, Myanmar, Xinjiang, the trans community, and many more. We respect the sacredness of the earth and its creatures and believe in reducing our environmental impact. 


In our spaces, we have zero tolerance for speech, actions, and symbols that display hate or are an incitement to violence. Likewise, when certain speech or actions don’t fit the above descriptions but still cause harm, they will be challenged and addressed collaboratively by both the teacher and the student body. 


If at any time at a capoeira or related event, you encounter an interaction that is in violation of the above stated commitments, we encourage you to seek support from a member of the temjogo community. The incident will be handled with sensitivity, in an attempt to reduce harm through dialogue and transformative justice processes, and/or what is necessary to ensure the welfare of the complainant and the agency of all parties.




PERMISSION/

CONSENT

Permission should be sought throughout the process of all interactions.

  

Permission can be revoked at any time.

  

In martial situations, permission is given by stepping onto the training floor, mat, ring or roda.

In Martial situations, permission is revoked by leaving the above if possible, tapping out, or verbally revoking if leaving is not possible.

Asking for a Partner or a spot/physical assistance implies permission for the physical contact necessitated by the activity at hand, no more.

Asking for a Partner or spot/physical assistance does not imply permission for physical, contact, stalking or harassment after the activity at hand has ended.

No Means No. Silence Means No. Only a Yes Means Yes.


PHOTOGRAPHY

Photography and filming of Open Sessions, Rodas, and Jams is permitted.

Photography and filming of Classes is left to the discretion of the teacher.

The only exception to the above will be the official photographers designated by the organizers.

Participation in the festival indicates permission to be photographed and filmed by the organizers and designated official photographers.


VIOLENCE

Physical altercations and violence are inherent aspects of the martial arts as is the Mindful, Disciplined, and Ceremonial control of violence and physical altercations.

Our main goal is to nurture the discipline, respect and physical mastery of Martial and other arts and to control/contextualize the violence in a healthy way.

All altercations must begin, end, and be resolved in the training space, ring, roda.

Any physical attacks taking place outside of the above context will be dealt with swiftly through legal apparatus.

Non Physical forms of violence: not limited to, but including verbal abuse, sexism, racism, homophobia, ageism, will not be tolerated. 

STALKING is a form of harassment and a form of violence. It will not be tolerated and will be dealt with through legal measures.

Please speak up when something occurs. Silence Is Violence and prevents the organizers from protecting our guests.
