TERMS and LIABILITY AGREEMENT

I Agree

Personal responsibility is assumed (and required) on our tours.  You agree to not hold Delmarva Board Sport Adventures, LLC, d.b.a. Delmarva Discovery Tours, NoBeach, LLC, Highway I Limited Partnership or any & all of it's tour partner venues liable for any loss, theft, damage or bodily injury you may incur as a result of your participation on our tours.  You also agree to release their employees, and affliates. 

We take all necessary steps to keep you safe.  We ask that you use common sense to keep yourself safe as well.  Parents must be responsible for their children at all times during the tour.  Client hereby waives / releases all claims against Delmarva Board Sport Adventures, LLC d.b.a. Delmarva Discovery Tours, NoBeach, LLC, Highway I Limited Partnership or any & all of it's tour partner venues and any of our venues for loss, theft or damage of any and all articles that are left in the vehicles. 

Please be advised that for your safety and the safety of others, our chauffeurs are to be given ample time for stops (i.e., restrooms, unscheduled pick-ups, or changes in destination). Opening and closing the doors of the limousine is the responsibility of the chauffeurs. Riders are to keep their arms and hands inside the vehicle away from doors opening and closing.

Delmarva Discovery Tours cannot be held responsible in any way for traffic conditions, mechanical difficulty, or any unforeseen circumstances. If the run is terminated early, all fees are deemed earned when paid.

COVID-19 

Anyone who has recently been quarantined or sick due to COVID-19, or has been in recent close contact with someone showing COVID-19 symptoms, should reschedule the engagement to help prevent the spread of COVID19.  At Delmarva Discovery Tours, we provide hand sanitizer, for all passengers and our driver.  The CDC suggests mask use inside group transportation vehicles.  We will also keep the windows cracks for air circulation.  Please see the full iist of our COVID - 19 safety procedures on our website under ABOUT US.    Initial Box

Terms & Conditions of the Limousine / Shuttle Service:

Delmarva Discovery Tours requires 2 Weeks's Notice of Cancellation to Receive a Refund.  Some administrative fees could be withheld.  Tours are held rain or shine.  The only exception may be when boating / watersports is included in the tour. Weather may require a reschedule.  Our boating / fishing partner will not give refunds; only rainchecks.

Smoking is strictly prohibited inside all vehicles.

We refuse to carry anyone possessing, or using drugs, or minors under 21 possessing or consuming alcoholic beverages.  We reserve the right to card all passengers.  If any illegal activity, disorderly conduct, or verbal/physical abuse is suspected or occurs during service, Delmarva Board Sport Adventures, LLC, d.b.a. Delmarva Discovery Tours reserves the right to terminate service immediately regardless of location without return to point of origin. Upon termination of service the client remains liable for the entire balance of service total and releases Delmarva Board Sport Adventures, LLC, d.b.a. Delmarva Discovery Tours of liability at the time of termination.

If a passenger feels ill, request that the chauffeur pull over immediately or at the first safe opportunity.  Vehicles are carefully inspected prior to each run. Liability/costs for any damages or for extensive clean up required, due to the actions of the passengers, shall be the sole responsibility of the client.

Passengers shall remain completely inside the vehicle while the vehicle is in motion. Passengers are expected to abide by the rules and regulations set forth by Federal and State Authorities. If the vehicle/driver is cited for violations due to the client/passenger(s), then the client will be responsible for all costs/fines.  We provide seat belts and encourge that everyone wear their seatbelt.

We would like to take photos.  We will share photos with clients after the tour for FREE.  We reserve the right to use complimentary photos for marketing purposes.

Client Authorization:  Client has read and understands the above terms and conditions. Client understands that the reserved limousine service is contingent upon acceptance and adherence to these terms and conditions. Initial Box

Anyone under the age of 21 may not be within 6 feet of a counter where alcohol is being served. This is Delaware State Law.

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
