Liability Waiver and Release of Liability

Calibers, LLC and its agents, officers, directors, shareholders, employees, instructors, volunteers, or representatives (collectively, “Calibers”) shall have the right in its sole discretion to (a) deny entry into its shooting range location at 6910 Downwind Road, Greensboro, North Carolina 27409 (the “Shooting Range”), (b) refuse or limit the occupancy or use of the Shooting Range, (c) terminate the use or occupancy of or remove participants from the Shooting Range at any time without notice for a violation of any applicable law, rule or regulation, or for no reason in its sole discretion.

By electronically signing this Liability Waiver and Release of Liability (this “Release”), and/or by occupying or using the Shooting Range, I acknowledge and agree to the following:

Assumption of Liability

  1. Occupying and using the Shooting Range and shooting firearms is dangerous and may expose me to dangerous circumstances, substances or materials, including, but not limited to, lead and lead particles. I further understand that no matter what precautions I may take, including, but not limited to, the wearing of various types of protective gear, I could be injured and/or die as a result of an accident or incident. I know, am aware of and assume all of the risks and dangers, whether or not known, foreseen or otherwise, that are or may be associated with occupying or using the Shooting Range, including, but not limited to, the risk of being injured by other participants.
  2. I certify and represent that I am 21 years of age or older, that I am under no kind of restraint against the ownership, possession, or use of a firearm, including any sort of domestic violence restraining order, and that I am legally free to own, possess, or handle firearms.
  3. I certify and represent that I have not been convicted of any Federal or State felony or for violation of 18 U.S.C. Section 922.
  4. I acknowledge that I have reviewed the video required by the Shooting Range, and received, reviewed, and understand all rules and regulations related to using the Shooting Range and agree to comply with all rules and regulations governing the use of the Shooting Range and all applicable federal, state, municipal and local laws, ordinances and regulations while occupying or using the Shooting Range.
  5. I understand that Calibers may terminate my use and occupation of and remove me from the Shooting Range at any time without notice for a violation of any applicable law, rule or regulation, or for any other reason in its sole discretion.
  6. I understand that use of the Shooting Range is limited to firearms and related training and I will not occupy or use any portion of the Shooting Range for any business or purpose which is unlawful, disreputable or deemed to be extra hazardous on account of fire or other hazard or permit anything to be done which would in any way increase the rate of fire insurance coverage on the Range or its contents beyond its intended purpose as a firearms range.
  7. I have determined and hereby certify to Calibers that by applicable standards, my shooting and safety equipment, ammunition and all related items are in good condition and suitable for the use in which intended and do not pose a risk to myself or others by its use.
  8. I will not make alteration to, deface or damage the Shooting Range or any portion thereof and shall be liable for, and pay to Calibers upon demand for, any and all property damage I cause to the Shooting Range. I shall be responsible for all damages to or loss of my own equipment while using or occupying the Shooting Range.
  9. I understand that it is my responsibility to consult with a physician prior to and regarding my participation at the range. I represent that I am physically fit and I have no medical, psychological, or other condition which would prevent my full participation at the shooting range.
  10. I realize that my liability may arise from negligence or carelessness on the part of the person or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault.
  11. In consideration of being permitted to use or occupy the Shooting Range, I agree to assume full responsibility for any and all risks, injuries, or damages, known or unknown, of whatsoever kind and nature, which I might incur as a result of my use or occupation of the Shooting Range.

    Waiver and Release of Liability
     
  12. In further consideration of being permitted to occupy and use the Shooting Range, I knowingly, voluntarily, and expressly waive any and all claims that I, my estate, my heirs, or any person claiming under me, may have against Calibers from any and all injuries or damages that I may sustain as a result of participating in shooting range activities at the Shooting Range.
  13. I knowingly, voluntarily, and expressly waive any and all claims that I, my estate, my heirs, or any person claiming under me, may have against Calibers which arises or may hereafter arise on account of my occupation or use of the Shooting Range for any first aid or medical treatment rendered for me or on my behalf. I understand that Calibers does not carry or maintain health, medical, or disability insurance coverage for me, and I am expected and encouraged to obtain my own medical or health insurance coverage.
  14. I, and on behalf of my estate, my heirs, or any person claiming under me, knowingly, voluntarily, and expressly forever release, waive, discharge and covenant not to sue Calibers for any personal injury, death, disability, property damage, property theft or acts and/or omissions of whatsoever kind and nature including, but not limited to, those caused by its negligence or other acts including, but not limited to, those acts and/or omissions of other participants or persons at the Shooting Range.
  15. I, and on behalf of my estate, my heirs, or any person claiming under me, agree to indemnify, hold harmless, and defend, Calibers from any and all fault, liabilities, costs (including but not limited to attorneys’ fees and court costs), expenses, claims, demands, or lawsuits, arising out of, related to or connected with any of the following activities at the Shooting Range: the discharge of firearms; the course of instruction; my participation in the course of instruction; the range, buildings, land and premises used for the Shooting Range (the “Premises”); my presence on or use of said Premises; and any and all of my acts or omissions.

    General Provisions
     
  16. This Release shall remain in full force and effect so long as I use or occupy the Shooting Range with no expiration for time or other reasons.
  17. This Release shall constitute the entire agreement between me and Calibers and any prior understandings or representations of any kind preceding the execution of this Release shall not be binding upon either.
  18. This Release may only be amended or modified by written instrument executed by both me and Calibers.
  19. If any term or provision in this Release is deemed invalid or unenforceable by any recognized tribunal, including a certified mediator, arbitrator or court of competent jurisdiction, the remainder of this Release shall be valid and enforceable to the extent permitted by law. This Release shall be construed and enforced under the laws of the State of North Carolina. Any claim or conflict arising out of this Release shall be adjudicated in Guilford County, North Carolina.

I HAVE READ THIS LIABILITY WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL WAIVER AND RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY THE LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT.

All members, guests, and authorized users must read the following Range & Safety Rules and shall abide by them at all times. Failure to adhere to any of the following may result in serious injury, death, and/or dismissal from the range.  Please talk with our staff if you have any questions.

Rules

 

          General Rules

All shooters must sign a waiver and release of liability before receiving range access.

  1. The handling of any firearm after consuming alcohol or drugs is strictly prohibited.
  2. Tobacco use and vaping is not permitted inside of building or within 25 feet of any entrance.
  3. Food and beverages are prohibited on the range.
  4. Only Calibers members with a State of North Carolina Concealed Handgun permit may carry loaded, concealed firearms on the premises. 
  5. All Federal, State, and local firearm laws must be obeyed – no exceptions.
  6. Valid photo identification is required for use of the range.
  7. All members are responsible for their guests and must have them under direct supervision at all times, including minors under the age of 21.
  8. Children must be supervised AT ALL TIMES while on the premises.  Shooters under the age of 21 must be accompanied by their parent or guardian.
  9. All members and guests must read all safety rules posted in the premises.
  10. Members must present their membership card upon entry to Calibers. 
  11. Every member of Calibers is designated as a safety officer and has the authority and responsibility to inform any other member or guest of any rule violation and to offer them guidance on rectifying the situation.
  12. If a shooter does not rectify the situation and continues to violate the range rules, immediately inform range staff.

    Firearm Safety Rules
     
  13. All firearms are always considered loaded.
  14. Never aim a firearm at anything you are not willing to destroy.
  15. Keep your finger off of the trigger until you are pointed at your target and ready to shoot.
  16. Rapid fire must be approved by range staff.
  17. All pistols and rifles must be kept pointing down range when preparing to fire and never pointing at the ceiling. 
  18. A “Cease Fire” may be called at any time and for any reason.  In the event of a “Cease Fire,” immediately stop firing your firearm and wait for further instruction from range staff.  Do not begin firing again until the range staff has given permission.
  19. Never load or fire a firearm if there is any doubt of its ability to operate safely or you are unfamiliar with its operation.
  20. Never leave a loaded firearm unattended.
  21. Always ensure that their firearms and ammunition are compatible.
  22. All firearms must be clear and bagged or cased before exiting the firing line.

    Range Rules
     
  23. Always wear eye and ear protection while on the firing range.  This applies to shooters and non-shooters.
  24. Acceptable eye protection includes shooting glasses, goggles, or eyeglasses with shatter proof lenses.
  25. Acceptable ear protection includes ear plugs or ear muffs with a minimum rating of 28NRR.
  26. Always be sure of your target and what is behind it; all bullets must impact the rear berms only.
  27. Shooting across the range at other targets is not permitted.  Only shoot at the target directly in front of your lane.
  28. No more than 1 person may stand in the shooting stall at one time.
  29. No person will be allowed to cross the firing line at any time for any reason.  Contact range staff if you need assistance.
  30. Always sweep all shell casings in front of the firing line, also remove targets and trash when finished shooting. 
  31. No outside targets are permitted.  All targets must be purchased from Calibers.

         Prohibited Ammunition

The following types of ammunition may not be used at Calibers at any time:

  • Steel cased ammunition 
  • Any caliber for rifled barrels greater than .45 caliber;
  • Shotguns or pistols firing shotgun shells;
  • Bottleneck ammunition such as 223, 5.56, 7.62, 338 or any other “rifle round;”
  • 50 BMG caliber center-fire rifle cartridges;
  • Tracers, incendiaries, or armor-piercing ammunition
  • Any explosive or pyrotechnic device.

 

By checking this box I fully understand that I will be banned from the facility if I decide use steel cased, or any other prohibited ammunition.

Classroom Safety

  • No firearms or live ammunition are permitted in the classroom at any time. Unless directed to do so by instructor.
  • Safe firearm handling procedures must be exercised at all times in the classroom.

Emergency Action Plan

  • In the event of an injury:
    • Call an immediate “Cease Fire” and ensure that all firearms are unloaded and clear with all actions open.
    • CALL 911 and provide the following information:
      • Location: Calibers—6910 Downwind Rd Greensboro, NC 27409
      • Number of the phone you are calling from
      • Number injured and their condition
      • Type of first aid being provided
      • Do not hang up the phone until dispatch says you may.
  • Provide immediate first aid, within your capabilities, to the injured person using the Trauma and/or First Aid kits available (see below).
  • If possible, assign someone to wait outside for EMS/Sheriff to arrive.
  • The firing range is equipped with a Trauma Kit, containing the following or equivalent:
    • CAT tourniquet
    • QuikClot Combat Gauze
    • Israeli bandage 4”
    • 3” roll of compressed gauze
    • 2 chest seals
    • Nasal pharyngeal airway
    • Mylar blanket
    • Trauma shears
    • 2” medical tape
    • 4 pairs of nitrile gloves
  • The lobby is equipped with a first aid kit, containing the following:
    • Knuckle adhesive bandages
    • Fingertip adhesive bandages
    • ¾” and 1” adhesive bandages
    • Burn dressing
    • Steri-strips
    • Eyewash
    • Aspirin
    • Advil
    • Antiseptic spray
    • Antiseptic wipes
