DEED OF DECLARATION, WAIVER, RELEASE AND INDEMNITY

 

General

1. RampAttak is operated by Nelsams Qld Pty Ltd as trustee for The Larks Family Trust (RampAttak) A.C.N. 141 046 246 and by providing this signed document you enter into this agreement with Nelsams Qld Pty Ltd as trustee for The Larks Family Trust (RampAttak) A.C.N. 141 046 246, its directors, owners, employees, principals, agents and independent contractors.

2. For the purposes of this agreement, the persons or parties referred to in this clause (except you) will be known collectively as “RampAttak” from here on in.

3. You will not be able to use the RampAttak facilities, at 3 Mary Street, Blackstone, unless and / or until this form has been signed by you (or your Guardian) and processed by RampAttak.

4. If you are under 18, then this form must be signed and the agreement entered into on your behalf by a parent or legal guardian who is over 18. It must also be witnessed by a person who is over 18.

5. If you intend to become a member of RampAttak for 12 months, it is intended that this agreement will remain in force for the period of that membership HOWEVER, RampAttak may require you to resign this document (or an updated version of it) at any time. If you are attending on a one-off basis, you will be required to provide this document and enter this agreement with RampAttak again on each attendance, at the discretion of RampAttak.

6. You will be directed to terms and conditions which apply to ALL attendees at RampAttak AT ALL TIMES. By signing this agreement, you expressly agree to abide by those terms and conditions which include:

  • Obeying immediately any direction to you by RampAttak,:
  • Wearing all necessary safety equipment at the direction and discretion of RampAttak.

7. If you sign this document you will be bound by this agreement. If you do not understand any part of it, then do not sign, but ask or seek advice regarding any part of which you are not sure. 


​Waiver, Release and Indemnity

8. I understand that by attending RampAttak and participating in the recreational activities within the premises occupied by RampAttak, I will be undertaking activities (or come near to others undertaking such activities), including (but not limited to) such thing as skating, skateboarding, scooter riding and BMX riding, upon ramps and equipment supplied by RampAttak (the “activities”).I understand that I enter this agreement in consideration of RampAttak allowing me to participate in these activities.

9. I understand that these activities are dangerous and may cause serious injury or even death to me or someone else, by my (or someone else’s) participation in them.

10. I understand that by signing this document and entering this agreement, and by participating in the activities, I accept all risk of injury (including death), damage both personal and to property and/or liability for injury to others which occurs as a result of my participation in the activities at RampAttak.

11. I understand the concepts of release and indemnity. Accordingly, I release RampAttak and all persons or entities associated with RampAttak, from any claim, demand or proceeding arising out of my participation in the activities AND I indemnify RampAttak and all persons or entities associated with RampAttak against any liability (including liability indemnity will extend to persons who may be associated with RampAttak from time to time only – for example sponsors, alternative club competitors, spectators or promoters.

Further Consents and Declarations

12. I consent (or do so as parent or legal guardian) to appropriate medical treatment being provided to me or organised for me (which may include an ambulance at my cost) by or on behalf of RampAttak at their absolute discretion, in the event of injury arising as a result of my (or the minor’s) participation in the activities, or by reason of the attendance at the RampAttak premises.

13. I will provide or hire all necessary safety equipment to the satisfaction of RampAttak.

14. I (or the minor) am physically fit to participate in the activities.

15. I understand this is a legal contract and is part of my agreement to enter the RampAttak premises and partake in the activities. I understand this document may affect and limit my right(s) to claim against RampAttak in some circumstances.

16. I have not been induced to enter into this agreement in any way. I have read and understand this document. It is entered into as a Deed and the information provided in the document is true and correct in every respect.

17. I consent to RampAttak using my image and likeness for promotional purposes connected with the activities.
