In compliance with FS 327.395 Anyone born after December 31, 1987 is required to either have successfully completed a National Association of State Boating Law Administrators (NASBLA) approved boating education course or have passed a course equivalency or temporary certificate examination and have in their possession a boating education ID card and a photo identification card before operating a vessel with a motor of ICI HP or more in Florida. ASSUMPTION AND ACKNOWLEDGEMENT OF RISK AND RELEASE OF LIABILITY AGREEMENT Please initial in consideration of being allowed to participate in water sport events and activities and I or being provided with water sport recreational property or services, for myself and any minor children for whom I am parent, legal guardian or otherwise responsible and myself/our heirs, personal representatives or assigns: 1. Acknowledgement of the Risks: I hereby acknowledge that the activity contemplated by this contract. is dangerous by its nature- and result in personal injury, property damage or death. I hereby acknowledge the following list of associated risks, which illustrative and in no way to be considered as encompassing all of the risks associated with said activity. (1) Changing water flow, tides, currents, wave actiona and ships wake. (2) Collision with and of the following: other participants. the watercraft, other watercraft, manmade or natural object. (3) Wind shear, inclement weather. lightening, variances an extremes of wind, weather and temperatures, (4) by sense of balance. physical coordination, ability to operate equipment, swim, and/or flow direction: (5) collision, capsizing, sinking, or other hazards which results in wetness, injury, exposure to the elements, hypothermia and/or drowning. (6) The presence of insects and marine life forms (7) Equipment failure or operator error. (8) Heat or sun related injuries, including sunburn, sunstroke or dehydration: (9) fatigue, chill and/or dizziness which may diminish my/our reaction time and increase the risk of an accident. 2. Express Assumption of Risk and Responsibility. Agree to assume any responsibility for all the risks of the activity, and hold harmless and indentify whether identified above or not (even those risks arising out of the negligence of the releases named below) my/our participation in the activity is purely voluntary. I assume full responsibility for myself and any minor children for whom I am responsible and any bodily injury, accident, illness, paralysis, loss of limb, death, loss of personal property and expenses thereof as a result of any accident which may occur while I/we participate in the activity (even if caused in whole or in part by the negligence of the releases named above.) 3. I agree to wear US Coast Guard approved personal flotation device life jacket while participating in the activity or riding in any watercraft. 4.RELEASE. I hereby release Coastal Parasail Inc., its principals, directors, officers, agents, employees, volunteers and affiliates their insurers and each and every land owner municipal and for government agency upon whose property and activity is conducted and their insurers, from any and all liability of any nature, including but not limited to, liability for personal injury, property damage or loss of life which may occur as a result of my/our participation in the activity, even if caused by the releases named above or any other person, (including myself). I have read and fully understand this agreement and the possible consequences of my/our participation in said activity, and am fully aware of the release of all liability contained herein. I understand that I am waiving valuable legal rights as consideration for participation in said activity, including any and all rights which may accrue against the owners, operators their employees, agents, servants or assigns, whether or not such released parties are explicitly named herein. This contract contains the entire agreement of the parties with respect to the matters covered by said contract and no other agreement, statement, or promise made by any party, or to any employee, officer, or agent of any party which is not contained herein shall be binding or valid. If any term. covenant, condition or provision to this contract is held by a court of competent jurisdiction to be invalid, void or unenforceable the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired or invalidated. This agreement of assumption and acknowledgement of risk and release of liability, and have been given a copy of the operating roles and regulations. I understand that by signing this document I am waiving valuable legal rights, including any and all rights I may have against the owner, operator named above or their employees agents, servants or assigns. Damage Waiver/Damage Deposit: The renter of the vessel has an option to purchase a Damage Waiver that will make him/her exempt from damages to the vessel for an amount of $50. The damage waiver is valid as long as all local, State, and Federal regulations and/or company regulations are not violated. Any violations resulting in damage to the rented vessel will make the Damage Waiver void and the cost of the Damage Waiver will not be refunded. If Damage Waiver is not purchased, the renter is required to pay a refundable Damage Deposit in the amount of $200 (cash only). The Damage Deposit will only be refunded if the vessel is returned in the exact same condition the renter received it. The renter of the vessel is responsible for reporting to an employee any previous damages to the vessel before taking control of the vessel. The renter of the vessel is required to show proof of a boating license or boating education course to leave the Damage Deposit.
