MEMBERSHIP AGREEMENT FORM

TERMS OF AGREEMENT:

All memberships are subject to a $29 initiation fee, except the 1-month only, 3 month Special and Virtual membership add on.

All memberships are subject to an annual facility fee of $79, charged 30 days from the activation date and each subsequent anniversary date. (Exlcuded: 1-Month only option, 3 Month Special, Training Memberships and Virtual Membership add on).

All memberships, trials, challenges, and bootcamps are non refundable and non transferable.

All yearly memberships are paid in advance and will automatically renew at the end of the yearly term EXCEPT Paid In Full Training Memberships.

The 12-month committment membership consists of 12 Monthly payments and is paid in advance each month and will automatically renew at the end of the original term to a no commit monthly membership at the 12-month commitment rate.

Training memberships run either on a 12-Month paid in full option NON-RENEWING, 6-month agreement paid on a monthly basis NON-RENEWING, month to month open ended and RENEWING each month or a 1 month only option.

Only no-commit monthly memberships may be frozen and are subject to a $15 per month freeze fee.This excludes training memberships and 12-month commitment membership. In addition, no commit monthly memberships can only be frozen for no longer than 3 months in a 12 month period and require a 15 day notice prior to freezing the account. All freeze requests MUST be done on a Membership Freeze Form prior to the freeze taking effect. Freeze requests must align with your billing date.

All monthly memberships, excluding the 12-Month Commitment Contract, are paid in advance each month and will be open ended and on going unless cancelled by completing a cancellation form.

VIM Fitness requires a 45 day notice of cancellation by way of completing a cancellation form for all auto-renewed memberships. A late cancellation fee of $100 dollar may be assess at the sole discretion of VIM FITNESS.

In addition to the membership dues, there is a $20 service charge for each DECLINED payment and $150 dollar charge for any CHARGEBACK issued against VIM FITNESS by the members bank or credit card company.

Member's Health Warranty: Member warrants and represents that he/she has no illness, physical or mental disability, impairment or ailment preventing him/her from engaging in active or passive exercise that will be detrimental to his/her health, safety or physical condition if he/she does so engage or participate. This representative is made by member knowing that management will rely upon the same respect to issuance of this membership. Member acknowledges and agrees that it is his/her responsibility to consult with his/her personal physician prior to and during the course of this membership.

VIM Fitness urges all members to obtain a physical examination from a doctor before using any exercise equipment, machinery, or apparatus designed for exercising. Any physical activity should be at members sole risk. Member understands that the agreement to use our facilities and services shall be members entire responsibility and that VIM Fitness is not liable for any claims, damages, demands, and (or) injuries to members person or property arising out of or in connection with the use of the facility, services, and property of VIM Fitness Member hereby will not hold VIM Fitness, its owners, or employees responsible for claims brought against them by member(s) on behalf of member for any such injuries or claims. VIM Fitness reserves the right to modify the terms of this agreement with a 30 day notice prior to changes. Consumers right to cancellation. You may cancel all memberships, with the exception of the 12-month commitment memberships, without any penalty or further obligation by submitting a cancellation waiver.

NOTE: If paying by ACH, the first payment will be withdrawn from your bank today or the following business banking day, then, subsequent payments on this day of each Month for all monthly memberships or this day annually for all yearly paid in full memberships for the duration of this authorization and term of your membership agreement.

If you wish to revoke this authorization and cancel this payment, or the amount withdrawn from my account is different than the amount authorized herein, please email membershipinquiry@vimfitness.com during the following business day to request a cancellation form provided all contractual obligations are met for cancellation of contract.
