Membership in the Nardis Gun Club (“NGC” or “Club”) is only available to persons who are legally able to possess a
firearm. NGC members must be in compliance with all federal, state and local laws concerning ownership and handling of
firearms and must follow the Range Rules of Nardis Gun Club as published or posted on the NGC premises from time to
time. The acceptance of members is at the sole discretion of NGC and membership may be revoked at it’s sole discretion.
In applying for membership in Nardis Gun Club, I hereby certify that
I am not and have never been the subject of a criminal or any other proceeding that prevents me from legally owning, handling or possessing firearms under Texas or Federal law I can lawfully own, handle and possess a firearm I will not purchase a firearm(s) from NGC as a ‘straw’ purchaser for anyone who cannot lawfully own, handle or possess a firearm I will follow the Range Rules of Nardis Gun Club while utilizing Club facilities I will pay all Club dues and fees that I incur as a member of NGC I will pay NGC the cost of repairing any equipment, lights, walls, structure or firearms which I damage while shooting All information given in this Application is true and correct to the best of my knowledge I have read, understand and agree to comply with the Terms and Conditions attached to this Application as well as the
Assumption of Risk & Indemnity Agreement and the NGC Range Rules Membership Terms & Conditions
Nardis Gun Club (“NGC” or “Club”) is available for use by all NGC Members, Guests of Members, private citizen groups and the general public. NGC Memberships are available to provide preferred access; discounts for merchandise, services and
Facility use; and other benefits. NGC Membership is subject to the Membership Terms and Conditions stated herein. Membership will be granted and may be revoked at the sole discretion of NGC.
As part of the consideration for Membership, the Member hereby agrees to remain a Member and pay the Monthly Maintenance Fee for a period of not less than one (1) year from the date of this Agreement. NGC is entitled to recover its costs, including reasonable attorneys’ fees, incurred in collecting sums due to NGC under this or any other Membership provision or otherwise. If member is unable to meet the one (1) year commitment, a $100 cancellation fee will be assessed. Following the first twelve (12) months of Membership, the member will continually be billed on a monthly basis and Membership will continue until 30 day written notice of cancellation is received by NGC Membership. All Memberships are subject to payment of a one-time non-refundable Initiation Fee and timely payment of Monthly Maintenance Fees. The Initiation Fee and Monthly Maintenance Fee for each level of Membership vary based on the level of Membership purchased, special NGC promotions and Membership availability. The first payment of Maintenance Fees shall include a pro-rated fee for the period between the date of the Membership Agreement and the last date of the month. Membership Fees and benefits may be reviewed and adjusted by NGC at any time. In the event of a Maintenance Fee change, the Member will be notified at least sixty (60) days in advance of such applicable change but it shall not affect Member within his/her first year of Membership. Subject to NGC’s current policy, Members may select one of the following methods of payment for their Maintenance Fee: Prepayment of the Annual Fee with a 5% Discount; an Automatic Bank Draft or an Automatic monthly credit/debit payment
from a VISA, MasterCard or Discover account. A $20 fee will be assessed for any rejected authorized charges. All Members, Guests, and other NGC facility users must obey the NGC Range Rules and must review, agree to the terms of, and sign the Assumption of Risk & Indemnity Agreement. Furthermore, all first-time Members, Guests, and other NGC Facility
users must participate in an NGC range orientation before shooting at the range. All Guests must be accompanied by a Member to be admitted to the firing line. Members are responsible for all actions taken by their Guests and will hold NGC harmless for property damage, accidents and injuries to or caused by Guests. All Members and Guests are subject to the general policies and rules of operation and administration of NGC, all of which are intended to provide a safe, professional, friendly and family oriented club. Any Member or Guest of a Member may be suspended or expelled from the range and/or Facility for violation of the Range Rules or for behavior deemed unsafe by NGC personnel. Decisions of NGC regarding suspension or expulsion are final. A Membership may be unilaterally terminated by NGC if, in the sole discretion of NGC management, the conduct of a Member or the member’s Guest presents a safety hazard to the Member or to any other user or employee of NGC or NGC Facilities. In
the event a Membership with a prepaid Membership Fee of greater than one month is terminated by NGC, the prepaid Fee will be pro-rated over the Membership period for which it was prepaid and refunded for the unused months. For purposes of this
paragraph, a “month” shall consist of any part of a month. For example, if a Membership with a prepaid one-year Maintenance Fee is unilaterally terminated by NGC anytime in the second month, the Member would receive a refund of 10/12 of the pre-
Paid Maintenance Fee. In no event will there be any refund of the Initiation Fee or any monthly Maintenance Fees for current or prior months. Failure to pay after the first year of Membership, such Membership shall be considered “abandoned” and terminated in the event of non-payment of the Monthly Maintenance Fee for two consecutive months. There is no refund of any portion of the
Initiation Fee, Pre-Paid Maintenance Fee or Monthly Maintenance Fee paid in the event Membership is abandoned. Any destruction of NGC property caused by a Member or a Member’s Guest, whether accidental, negligent, willful or otherwise, may result in the violator being removed from the range and/or facility, suspended or removed from Membership if a
Member, and/or criminally prosecuted. In addition, NGC reserves the right to assess to the Member a reasonable charge for any such damage, regardless of whether the damage is caused by the Member or the Member’s Guest. All Members must allow their photograph to be taken for NGC records and identification. A NGC Membership may not be transferred or sold. All Members and Guests must present a current photo ID in order to access the range.
