LBJJ Terms of service

The undersigned and any co-signer (hereafter referred to as a member) and Long Beach Jiu Jitsu (hereafter referred to as a school) agree as follows: In consideration of the school providing a member with the use of its instruction, services, consultation, facilities, and equipment during the term hereof, the member promises to pay the school, or its representatives, or assigns, a membership price in the amount and manner set below.

If you wish to cancel this contract, you must do so by mailing a written notice by certified or registered mail to the school. This notice must say that you do not wish to be bound by this contract and must be delivered or mailed before midnight of the third business day after signing this contract. The notice must be delivered to:

162 W Park Ave 2ndFloor Long Beach NY You may buy out the remainder of your obligation under this contract at any time therafter by 100% of your remaining balance here under. You may cancel this contract if you relocate your residence further than 20 miles from any school operated by Long Beach Jiu Jitsu You must provide proof of new address. This contract may also be cancelled in the case of death, or if the school moves its location more than 3 miles from the location at which you entered the contract. If you become disabled, you shall have the option of (1) being relieved of liability for payment on that portion of the contract term for which you are disabled by providing a doctors note, or (2) freeze the contract as specified below. You must prove such disability by a doctor’s certificate.

If you wish to freeze this contract, you may do so by mailing a written notice by certified or registered mail to the school. This notice must say that you wish to freeze this contract as of a specified date and must be delivered or mailed to: 162 W Park Ave2ndFloor Long Beach NY. You are still obligated to pay the remaining balance on your contract according to its original terms.  Your contract expiration date will be extended for a period of time equal to the duration of the time that the contract will be frozen. You may freeze this contract only once per year, for no longer than 6 months and no less than 1 month.


The following policies and regulations are intended to make the school as safe, enjoyable, and pleasant as possible for all our members, while permitting management to operate in an efficient and businesslike manner. The policies and regulations are applicable to all members and may be changed periodically as circumstances warrant.

POLICIES AND REGULATIONS

Registration – Before all classes, members are to pull their attendance card and hand it in to the instructor at the start of class.

Attire – Proper attire is required by all members. 

Classes and Group Activities – The school expressly reserves the right, from time to time, at its sole discretion to initiate, change, or amend class schedules. No representation, unless made in writing, shall obligate the school to offer classes at any special time.

Changes – The policies and regulations of the school are not inclusive and are subject to change from time to time at the sole discretion of the school.

TERMS AND CONDITIONS

Suspension – The school reserves the right to suspend or terminate any member for failure to comply with the terms and conditions or policies and regulations of the school, or for behavior that is in management’s opinion prejudicial to the welfare, good order, and character of the school. It is expressly understood that the loss of membership privileges shall be without refund of any fees already paid by the member.

Non-Use – The failure of the member to use the facility or services of the school shall not relieve the member from the obligation to make any and all payments required under this agreement.

Likeness B – Member hereby gives school the right to use member’s likeness and any recording of member(audio, video, still, and otherwise) in school’spromotional materials, including but not limited to print, web, and social media.

Unavailability – In the event that the school is substantially unavailable for use due to change by fire, accident, or an act of God, the member’s time shall be extended for a period of time equal to the time that the school is not in use.

Liability Waiver – The student, on behalf of his or herself, his or her family, heirs, executors, and administrators hereby forever release, discharge and hold harmless, 

Long Beach Jiu Jitsu representatives and agents for any injury, loss, or damage to person or property arising out of or in connection with taking part in martial arts classes and activities and notwithstanding that the same may have been contributed to or occasioned by the negligence of Long Beach Jiu Jitsu, representatives or agents.


This is the entire agreement covering the purchase price of your membership. If any part of this agreement is unenforceable, this will not make any other part unenforceable. The school can waive or delay any of its rights under this agreement without losing them.

The undersigned does promise to pay Long Beach Jiu Jitsu the sums of money stated herein, and does give the school permission to sell this agreement to an independent financial institution, or refer it to another company for collection. A member will not engage for a period of 10 years from the start of this agreement, either directly or indirectly, in the business of the provision of martial arts instructions and or sales of items related to the martial arts within a 20 mile radius of any school operated by Long Beach Jiu Jitsu or its affiliates or subsidiaries. Parties agree that if a member or signer initiates a competitive martial arts establishment, members shall immediately entitle Long Beach Jiu Jitsu to any injunction against member or signer upon proper application to an appropriate court.



LBJJ Covid Wavier 

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Long Beach Jiu Jitsu (LBJJ) has put in place preventative measures to reduce the spread of COVID-19; however, LBJJ cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending LBJJ activities could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending LBJJ event and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at LBJJ event may result from the actions, omissions, or negligence of myself and others, including, but not limited to, LBJJ volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at LBJJ events (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless LBJJ, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of LBJJ, its employees, volunteers, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any LBJJ event.

LBJJ Waiver

I, the undersigned hereby waive all claims against any and all persons associated with the Long Beach Jiu Jitsu or LBJJ. I understand that I am participating in a martial art which has body contact. I understand that this form of martial arts involves choke holds, arm locks, neck cranks, ankle locks, throws, slams, punches, kicks, elbows, knees, and such which could potentially cause serious injury or even death. I assume full responsibility for all my actions during and connected to the above organization. I understand the risk of participating in this form of martial arts training and hereby release Long Beach Jiu Jitsu or LBJJ and all of its agents, employees and associates of and from any and all liability, claims, demands, actions, medical bills, and causes of action whatsoever arising out of or relating to any negligent or other act or omission, and/or any loss, damage, or injury, including death, that may be sustained by the undersigned or any property of the undersigned in participating in this form of training. I, the undersigned also state that I am in good physical condition and know of no reason why I can not train in this form of training. I understand that in case of emergency, I hereby authorize any licensed medical personnel to perform any accepted medical assistance deemed necessary and I agree to bear the expense of any such treatment. As additional consideration for training at Long Beach JiuJitsu or LBJJ Academy, I agree that my attendance and/or performance at the academy and abroad at events and such may be photographed, filmed and/or taped and used by Long Beach Jiu Jitsu or LBJJ for marketing purposes and I authorize the use of my image and I waive any compensation thereof – even if I discontinue my training at Long Beach Jiu Jitsu or LBJJ. I acknowledge that I would like to receive correspondence from the academy via telephone, mail, and email. I, the undersigned, being duly aware of the risks and hazards inherent upon participating in this form of martial arts agree to all its rules, terms, and conditions. I acknowledge that I have received a copy of the Long Beach Jiu Jitsu or LBJJ’s sparring rules, have read them, understand them, and agree to honor and obey them. I understand that disobeying the rules may, at the instructor’s discretion, result in suspension or expulsion from the Long Beach Jiu Jitsu or LBJJ and that I will not be entitled to a refund and if expelled must pay the remainder of my contract if one has been signed. In signing the foregoing release, the undersigned hereby acknowledges and represents: that he/she has read the foregoing release, understands it and signs it voluntarily; that he/she is over 18 years of age and of sound mind. If under 18, parent/legal guardian in signing this release agrees to all its terms and conditions for their child.
