SHOOTING RANGE USE AND GUN RENTAL AGREEMENT

All persons using the Defense In Depth’s facilities or accepting training from Defense In Depth or its personnel must:

 

  • Complete this Agreement and included Waiver and Release;
  • Read and agree to the Range Rules and Policies;
  • Watch the safety video; and
  • Return this form and the Waiver to Defense In Depth personnel after completion of the video.

 

WAIVER AND RELEASE FROM LIABILITY FOR DEFENSE IN DEPTH LLC

I, as “CLIENT,” HEREBY WAIVE AND RELEASE, indemnify, promise to defend, hold harmless and forever discharge, all to the fullest extent of the law, DEFENSE IN DEPTH LLC, a West Virginia limited liability company, and its agents, managers, members, sponsors, employees, officers, directors, affiliates, successors and assigns (collectively, “DEFENSE IN DEPTH”), of and from any and all claims, demands, debts, contracts, expenses, causes of actions, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, foreseeable or unforeseeable, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, on the premises of, or for the benefit of, DEFENSE IN DEPTH provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct by DEFENSE IN DEPTH staff.

I UNDERSTAND THAT THE ACTIVITIES THAT I WILL PARTICIPATE IN ARE INHERENTLY DANGEROUS, THAT FIREARMS BY THEIR VERY NATURE ARE UNPREDICTABLE AND MAY CAUSE SERIOUS OR GRIEVOUS INJURIES, INCLUDING BODILY INJURY AND INCLUDING BUT NOT LIMITED TO INJURY TO HEARING, DAMAGE TO PERSONAL PROPERTY AND/OR DEATH. I UNDERSTAND THAT CERTAIN FORESEEABLE AND UNFORESEEABLE RISKS, DANGERS, AND INJURIES DUE TO INADEQUATE OR DEFECTIVE EQUIPMENT, AND ALL OTHER POTENTIAL DANGERS INHERENT TO ACTIVITIES INVOLVING FIREARMS EXIST. On behalf of myself, my heirs, assigns and next of kin, I waive all claims for damages, injuries and death sustained by me or to my property that I may have against the aforementioned released party to such activity whether caused by the ordinary negligence of the released party or otherwise, with the exception of acts of gross negligence or intentional acts or omissions as indicated above.

By this Waiver, I assume any risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with DEFENSE IN DEPTH, including but not limited to target shooting, using the facilities or equipment in any manner, form or fashion, and engaging in any other related activities. In the event that I cause injury to another person or their property at DEFENSE IN DEPTH, I agree to indemnify and hold harmless DEFENSE IN DEPTH and its agents, managers, members, sponsors, employees, officers, directors, affiliates, successors and assigns from any and all claims for injuries, damages brought by that injured person as a result of my acts or omissions whether negligent or otherwise.

CLIENT AND (if under the age of 18, or under the age of 21 and using any firearm other than a long gun – you must be 21 years of age to rent and/or utilize a fully automatic machine gun on the range) PARENT OR GUARDIAN INITIAL  

I hereby expressly consent to DEFENSE IN DEPTH and its agents, managers, members, sponsors, employees, officers, directors, affiliates, successors and assigns, the irrevocable and perpetual right to use my picture, image, voice and other reproductions of the same, (whether by still camera image or video film) in any manner for marketing, advertising purposes or for the purpose of trade. I waive and release any claim I may have against DEFENSE IN DEPTH and its agents, managers, members, sponsors, employees, officers, directors, affiliates, successors and assigns for defamation, invasion of privacy or publicity and any other claims in connection with such use by DEFENSE IN DEPTH and its agents, managers, members, sponsors, employees, officers, directors, affiliates, successors and assigns.

This WAIVER AND RELEASE contains the entire agreement between the parties, and supersedes any prior written oral agreements and discussions between them concerning the subject matter of this WAIVER AND RELEASE.

The provisions of this WAIVER AND RELEASE may ONLY be waived, altered, amended or repealed, in whole or in part, only upon the subsequent written consent of all parties. The provisions of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of DEFENSE IN DEPTH whether by agreement, by operation of law, or otherwise.

I have read, understand, and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am, or my parent or guardian is, 18 years of age or older and mentally competent to enter into this waiver.

If you are pregnant, suffer from seizures or are aware of any other physical limitation that use of the Defense In Depth's facilities may negatively impact, please consult your physician prior to using Defense In Depth's facilities:

RANGE RULES AND POLICIES

Read & sign:  Shooting Range Use and Gun Rental Agreement; Waiver and Release; and Range Rules and Policies.  Watch the Safety Video.

  • This must be done before using/entering the range.

Act responsibly at all times.
Monitor your assigned range time, be aware of your surroundings, and be courteous of others.
Report any unsafe conditions to a Range Safety Officer (RSO) immediately.
Obey age policies.

  • Individuals under the age of 10 are not permitted to shoot on the range or use the simulator.
  • Individuals under the age of 21 desiring to possess a handgun on the range must be accompanied by a parent or legal guardian who will sign a waiver and remain by individual’s side at all times.
  • Individuals under the age of 18 desiring to possess a long gun on the range must be accompanied by a parent or legal guardian who will sign a waiver and remain by individual’s side at all times.
  • Individuals desiring to possess an automatic gun must be 21, accompanied by a RSO at all times, and follow Defense In Depth’s fully automatic firearm/machine gun rules and policies.

Eye and ear protection is mandatory for everyone in the range.

  • Guns are loud and the sound can cause hearing damage. They can also emit debris and hot gas that could cause eye injury. For these reasons, shooting glasses and hearing protection must be worn by shooters and spectators.

Non-members must have ammunition and firearms approved by range staff.  Members’ ammunition and firearms are subject to inspection.
Use only the correct ammunition for your gun.

  • Use only the correct ammunition for your firearm as recommended by the manufacturer.  Most guns have the ammunition type stamped on the barrel.
  • Ammunition can be identified by information printed on the box and sometimes stamped on the cartridge.
  • Only BBs, pellets, cartridges or shells designed for a particular gun can be fired safely in that gun.
  • Do not shoot the gun unless you know you have the proper ammunition.

Only use ammunition approved for the range.

  • The following types of ammunition are not allowed to be shot at Defense In Depth:  tracer ammo, incendiary ammo, steel-cored ammo, armor piercing or penetrating type ammo, solid core ammunition, blended core ammunition, steel or aluminum cased ammo. Brass cased defensive ammunition is allowed.

Only use firearms and calibers approved for the range.

  • Any magnum caliber handgun or handgun caliber larger than .45 ACP must be declared and approved by range staff prior to entering the range.
  • Any rifle chambered to 7.62x39 and above, magnum caliber rifle, .338 caliber Lapua, .50 BMG, or rifle caliber of .308 or larger must be declared and approved by range staff prior to entering the range.
  • All shotguns must be declared and approved by range staff prior to entering the range.  Slug and buckshot are the only authorized shotgun ammunition types.
  • Fully automatic firearms or firearms with bump stocks must be declared and preapproved by the Range Manager prior to entering the range.  The owner must provide proper federal licenses and all required paperwork.  The Range Manager or an RSO may deny the use of fully automatic or bump stock shooting for any reason.  The operation of such firearms is subject to the same rules and policies regarding the rental of fully automatic firearms.

Only 1 door to the airlock may be open at a time.

  • Ensure each airlock door closes behind you before opening the next.

Shooters must utilize the booth and target for the assigned lane.
Non-shooters must stand behind the booth area.
Only instructors hired or contracted by Defense In Depth are permitted to provide for-hire training services at our business.
Never cross the firing line with any body part.

  • If you need to retrieve an item from in front of the booth, contact a RSO.

Keep all firearms holstered, cased, or bagged, until you enter, and before you exit, the shooting booth area.

  • Firearms may only be uncased or removed from a bag or holster within the shooting booth area.

No uncased firearms are permitted behind the shooting booth area.

  • Do not transfer uncased, non-holstered, or non-bagged firearms from lane to lane.

Do not pass firearms directly from person to person.

  • Place the unloaded firearm on the bench, pointed down range, and allow the next person to pick it up.

Ensure guns are not accessible to unauthorized persons.

  • Mechanical locking devices, like the mechanical safeties built into guns, can fail and should not be used as a substitute for safe gun handling and the observance of all gun safety rules.

Load and unload all firearms at the bench inside the shooting booth.
Know how to use the gun safely, ensure it is in good and safe working order, and understand and use its safety features.

  • Before handling a gun, learn how it operates. Know its basic parts, how to safely open and close the action, and remove any ammunition from the gun or magazine. Remember, a gun's mechanical safety device is never foolproof. Nothing can ever replace safe gun handling.
  • Any individual failing to demonstrate proper knowledge of firearm operation and safety may be restricted from utilizing the range, referred to a Defense In Depth safety class or instructional video or session, and not permitted to utilize the range until which time he/she can demonstrate proper knowledge.
  • Just like other tools, guns need regular maintenance to remain operable. Regular cleaning and proper storage are part of the gun's general upkeep. If there is any question concerning a gun's ability to function, consult a knowledgeable gunsmith.
  • Your gun should be cleaned every time it is used. A gun brought out of prolonged storage should also be cleaned before shooting. Accumulated moisture and dirt, or solidified grease and oil, can prevent the gun from operating properly.
  • Before cleaning your gun, make absolutely sure that it is unloaded. The gun's action should be open during the cleaning process. Be sure no ammunition is present in the cleaning area.

Know your target and what is beyond.

  • Be absolutely sure you have identified your target beyond any doubt. Equally important, be aware of the area beyond your target. This means observing your prospective area of fire before you shoot. Never fire in a direction in which there are people or any other potential for mishap. Think first. Shoot second.

Only shoot your target.

  • Shooting the wall, ceiling, floor, retrieval system, lighting, baffle, shooting booth, another lane’s target, or anything other than your target is prohibited.

Always keep the firearm pointed down range in a safe direction.
When not shooting, keep firearm’s action open, magazines removed, and safety engage.  Only load when ready to commence firing.
Always keep fingers off the trigger and outside the trigger guard until you are ready to fire.
Fire only when safe conditions exist.
If your firearm jams or malfunctions, place it on the bench, pointed down range, and contact a RSO.
Rapid fire of multiple shots is not permitted, unless preapproved by a RSO.

  • The shooter must demonstrate proper knowledge, technique, and safety to a RSO.  It is at the RSO’s discretion as to whether such knowledge, range conditions, appropriate shooting booth availability, and comfort of other guests will permit rapid firing.

Upon the command “CEASE FIRE,” stop all shooting immediately, put down your firearm pointing down range, and back away from the firing line.

  • Do not re-approach the firing line or pick up any firearm until a Range Safety Officer gives the “ALL CLEAR” signal.

All shooting must be in a safe, controlled, and accurate manner.

  • Be aware that certain types of guns and many shooting activities require additional safety precautions.

“Dual wielding” or “two gun shooting” is not permitted.
Shooting beneath the bench is not permitted.
Shooting from the holster must be preapproved by a RSO.

  • The shooter must demonstrate proper knowledge, technique, and safety to a RSO.  It is at the RSO’s discretion as to whether such knowledge, range conditions, appropriate shooting booth availability, and comfort of other guests will permit shooting from the holster.

Never consume alcohol, take drugs, or use other mentally or physically impairing substances before or while shooting.

  • Alcohol, drugs, over-the-counter or prescription medicine, or other substances that may impair your judgment, motor skills, attention, balance, coordination, perception, reactionary skills, health, behavior, or ability to shoot, must not be used before or while handling or shooting guns.

During your assigned range time, you may collect brass inside and to the immediate rear of the shooting booth area but not in front of the firing line.
Food, drink, gum, and tobacco products are prohibited in the range.
Wash your hands immediately after you leave the range and prior to eating.
Lane availability is at the discretion of range staff.

  • RSOs and range staff may reassign lanes based upon factors including but not limited to:  # of shooters, skill level, types of firearms and ammunition, training, private events, etc.

Range bay availability is at the discretion of the Range Manager.

  • Range bays are subject to limitation/closure due to training, private events, cleaning, maintenance, etc.

Any violation of the Range Rules and Policies may result in immediate removal from the range and forfeiture of Membership.
